DECLARATION
of 4 April 2006
implementing Act No. 676 / 2004 Coll., on compulsory alcohol labelling and amending Act No. 586 / 1992 Coll., on Income Tax, as amended, as amended, as amended, Act No. 545 / 2005 Coll.
The Ministry of Finance provides pursuant to Section 32 of Act No. 676 / 2004 Coll., on the compulsory marking of alcohol and on the amendment of Act No. 586 / 1992 Coll., on income taxes, as amended, ("the Act ') for the implementation of Sections 5 (5), 6 (2), 7 (9) and 11 (5) of the Act:
This Decree was notified in accordance with Directive 98 / 34 / EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and rules and of rules on information society services, as amended by Directive 98 / 48 / EC.
Subject matter
This decree sets out the design, dimensions, contents and safety features of the control tape, the way in which the control tape is placed on the consumer packaging of alcohol, the design of the application for registration and the design of the registration, the model and details of the application for the allocation of the control tapes, the way in which the volume concentration of ethanol is added, the way in which the control tapes are collected, the way in which the control tapes are returned and the way in which they are recorded.
Model, dimensions, accessories and safety features of the tape
(1) Control tapes are manufactured in three dimensions specified in millimetres
(a) 90 × 16,
(b) 150 × 16,
(c) 210 × 16.
(2) The control tape intended for the marking of alcohol in consumer packages with an ethanol content of less than 20% vol. contains a 10-digit control tape entry code, comprising a four-digit registration sampling number, an application for the allocation of control bands and an entry code for the ethanol content.
(3) The control tape intended for the marking of alcohol in consumer packaging with ethanol content in the product from 20% vol. shows:
(a) a 10-digit control tape registration code comprising a four-digit registration sampling number, an application for the allocation of control tapes and an entry code for ethanol content; and
(b) twice the word "NEW."
(4) The check tape is made of a price paper with an original continuous watermark. The price paper is free of its own fluorescence in the UV spectrum area at 366 nm and is secured by one kind of invisible fibres shining in the UV spectrum area at 366 nm. The tape is printed with offset and liner copper. The offset is printed with specific line subprinting frames containing iris transitions covering the entire area of the control tape and the words "Czech Republic."
(5) All texts and the control tape registration code are placed parallel to the longer side of the control tape. The giloš containing microbismo is printed with liner copper. The protective holographic strip is parallel to the shorter side of the control tape.
(6) The models of the surveillance tapes are set out in Annex 1 to this Decree.
Method of placing the control tape on the consumer packaging of alcohol
(1) The control tape must be applied to the consumer's packaging of alcohol by the face side up through the consumer package closure so that the central part of the tape is on the top of the cap and that the right and left parts of the tape are glued along the neck of the consumer packaging of alcohol, unless otherwise specified. If the shape of the consumer package makes it possible, the check tape shall be applied in the form of a letter U; if this is not possible in view of the atypical shape of the consumer package, the tape shall be glued in the form of a letter L. The check tape shall not be re-glued or covered in such a way that it would not be possible to control it without infringing it.
(2) The adhesive used to apply the control tape to the consumer packaging of alcohol must have characteristics such as to prevent the control tape from being unglued without infringing it, even as a result of weather or other external influences.
(3) The control tape shall be placed on the consumer packaging of alcohol in such a way that it is not possible to open or use its contents without damaging the consumer packaging of alcohol. In the case of refundable bottles, the left and right part of the tape, which remained on the neck of the container, shall be removed under the cap before refilling.
Model of application for registration and model of registration
(1) The model of the application for registration of an undertaking is set out in Annex 2 to this Regulation and the model of the application for registration of a legal person is set out in Annex 3 to this Regulation.
(2) The model of the registration of the natural person undertaking is set out in Annex 4 to this Regulation and the model of the registration of the legal person is set out in Annex 5 to this Regulation.
Forms of application for the allocation of surveillance tapes
(1) In the application for the allocation of surveillance tapes (Section 11 of the Act), the registered person shall indicate:
(a) name and surname or business name;
(b) a four-digit registration sampling number from the marketing authorisation;
(c) the number of control tapes ordered in a minimum number of 500 control tapes or in multiples of that minimum number;
(d) the content of the consumer packaging of alcohol,
(e) classification at volume concentration level of ethanol in volume% (§ 7);
(f) the draft date for the collection of the surveillance tapes at the customs office.
(2) The model of the application form for the allocation of the surveillance tapes is set out in Annex 6 to this order.
Method of classification according to ethanol content
The alcohol is divided into 4 levels depending on the ethanol content of the product:
(a) from 15% by volume ethanol below 20% by volume ethanol,
(b) from 20% by volume ethanol to 34% by volume ethanol,
(c) above 34% by volume of ethanol up to 37% by volume of ethanol,
(d) above 37% by volume of ethanol.
Method of sampling of control tapes
(1) The control tapes ordered shall be sent by the customs office to the person registered, packed and labelled, indicating the 10-digit control tape registration code, comprising the registration sampling number, the application code for the allocation of the control tapes and the classification code by volume concentration level of ethanol.
(2) The inspection tapes shall be transmitted by the customs office with which the application for the allocation of the control tapes was submitted and confirmed to the person registered on the basis of a confirmed application for the allocation of the control tapes and a document certifying the payment of the control tapes on the day and hour specified in the confirmed order.
(3) In the case of cash payment at the office of departure, the customs office shall issue to the registered person an accounting document certifying the payment of the checks.
(4) If a registered person is empowered by written authority to collect the surveillance tapes by another person (Section 11 (3) of the Act), this power of attorney is annexed to the sampling sheet.
(5) The model of the sample sheet of the surveillance tapes is set out in Annex 7 to this Decree.
Return of control belts
(1) Unused control tapes shall be returned by the registered person to the customs office at which the control tapes were taken, together with a form the model of which is given in Annex 8 to this Order.
(2) The registered person returns the damaged or contaminated control tapes to the customs office at which the control tapes were taken, improved on loose sheets; where justified, the customs office may allow another method.
(3) Individual sheets with glued control tapes shall be numbered and form an annex to the form, the specimen of which is given in Annex 8 to this Order.
Method of recording the control tapes
(1) The registration of accepted, issued, destroyed and returned surveillance tapes pursuant to Article 14 of the Act is kept by the holder (Article 12 of the Act) on a prescribed form, the specimen of which is set out in Annex 9 to this Decree.
(2) A sampling sheet is part of the check tape records.
Repeal
Decree No. 147 / 2005 Coll., implementing Act No. 676 / 2004 Coll., on compulsory marking of alcohol and amending Act No. 586 / 1992 Coll., on income taxes, as amended, is hereby repealed.
Efficacy
This decree shall take effect on the day of its publication.
