DECLARATION
Ministry of Transport and Communications
of 10 April 2001
on recreational yachts
The Ministry of Transport and Communications provides, pursuant to § 85 (1) of Act No. 61 / 2000 Coll., on maritime navigation, ("the Act ') for the implementation of § 57 (2) of the Act:
Subject matter
This decree provides
(a) conditions for the technical competence of recreational yachts;
(b) keeping records of pleasure yachts;
(c) the allocation of registration markings;
(d) the conditions for issuing a recreational yacht licence (hereinafter referred to as "licence").
Conditions of technical competence of recreational yachts
(1) The provisions of the special Regulation shall apply to the conditions for the technical eligibility of recreational yachts (hereinafter referred to as "yachts') for maritime navigation in the area of authorised maritime navigation of yachts, determined according to the distance of the sea navigation of the yacht from the coastal line of land or coast, determined by the mean tidal height (hereinafter referred to as" technical competence '), with regard to its construction, equipment, safety and environmental requirements. 1)
(2) Compliance with the conditions for the technical competence of a yacht shall be demonstrated by the documents submitted by the Maritime Authority (hereinafter referred to as the Office), by the yacht logbook, by a list of persons on the yacht and by a certificate of technical competence issued by the Office or by a legal person authorised by the Office, valid from the date of issue for a maximum period of five years.
(3) The technically eligible yacht shall be classified by the Office in the Record of pleasure yachts (hereinafter referred to as "Records"), assigned by the registration mark and issued by the Office with a certificate of fitness for cruise yachts for sea navigation (hereinafter referred to as "yacht identification"). The model of the yacht pass is set out in Annex 1.
(4) The yacht card shall be issued for the period of validity of the certificate of technical competence. Before the expiry of the yacht licence, the owner (2) of the yacht, which is also its operator (the owner), has the possibility to apply for the issue of a new licence for seagoing recreational yacht.
Keeping records of recreational yachts
(1) The register is a publicly available list containing the following information:
(a) the owner;
(b) authorised sea navigation area;
(c) the basic technical details of the yacht listed in Annex 2;
(d) date of inclusion in the Register.
(2) The application for inclusion in the Register is submitted by the owner. The application shall be accompanied by:
(a) proof of ownership of the yacht;
(b) an honest declaration that the yacht is not registered in any maritime register;
(c) a certificate of technical competence of the yacht,
(d) yacht logbook,
(e) by a ship's certificate, a provisional accompanying note, a yacht register or a yacht pass previously issued to that yacht, unless it is a new construction,
(f) a list of persons on a yacht during the previous three-year period, in the absence of a new construction;
(g) proof of payment of the administrative duties.3)
The model application is set out in Annex 2.
(3) The owner shall notify the Office of any changes relating to the particulars and documents provided for in the application for registration and provide evidence thereof within 30 days of the date of the amendment. The Office shall, as the case may be, amend the data in the Register or decide to suspend the yacht licence.
Allocation of the registration mark
(1) The registration number allocated after the inclusion of the yacht in the register is four-digit and is preceded by the abbreviation CZE and assigned the letter R (CZE0000R).
(2) The assigned registration number, the name of the yacht, the name of the port of registration of the yacht, which is PRAHA, shall be marked by the owner with figures of a minimum height of 10 cm with a light colour on a dark base or dark on a light, in a clearly visible position at the back of the yacht and on the rescue equipment of the yacht. In addition, the name of the yacht owner shall appear on both sides of the bow of the yacht.
Conditions for issuing a licence
(1) The Agency shall issue a licence on the basis of a written request from a natural person (the applicant) which:
(a) has demonstrated professional competence to conduct a yacht by passing a successful test and experience on a yacht of at least 100 nautical miles' length under the supervision of the master of the yacht;
(b) has demonstrated fitness to conduct a yacht;
(c) has reached the age of 18;
(d) is eligible for legal action;
(e) has paid the administrative payment.3)
(2) The licence application must be accompanied by:
(a) a certificate of successful test;
(b) proof of sailing experience;
(c) a valid medical certificate not more than 3 months old;
(d) a valid restricted licence of a radio-telephonist, or a valid restricted certificate of a radio-telephonist issued by the Czech Telecommunications Authority;
(e) colour photographs with dimensions of 3,5 cm x 4,5 cm, which correspond to the actual form of the applicant,
(f) proof of payment of the administrative charge. (3)
(3) The test to demonstrate the competence to conduct a yacht shall be carried out within the scope of the theoretical and practical knowledge required for obtaining a C-approved licence for the management of seagoing yachts under the special legislation and referred to therein. 4)
(4) Applicants for the issue of a licence already holding a seagoing yacht licence shall be granted a licence if they submit:
(a) a valid seagoing yacht licence;
(b) a valid medical certificate not more than 3 months old;
(c) proof of payment of the administrative duties.3)
(5) The validity of the licence is 10 years.
(6) The model of the licence, the model of the licence application and the model of the application for the test is set out in Annex 3.
Efficacy
This decree shall take effect on the day of its publication.
