The Government mandates pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., Act No. 441 / 2005 Coll. and Act No. 291 / 2009 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll.:

CONDITIONS FOR THE SUBSIDY TO IMPLEMENTATION OF THE MEASURES TO IMPROVING THE GENERAL CONDITIONS FOR PRODUCTS INCLUDING, AND OF THEIR MARKET PARTICIPATION
§ 1
Subject matter
This Regulation, following the directly applicable provisions of the European Union1 (hereinafter referred to as the "European Union Regulation '), provides for more detailed conditions for the granting of subsidies for the implementation of measures to improve the general conditions for the production and marketing of apiculture products originating in the Czech Republic by bees registered under the Breeding Code (hereinafter referred to as" the subsidies').
§ 2
Types of measures
The subsidy may be granted for the following measures:
(a) technical assistance;
(b) the fight against varroasis;
(c) rationalisation of bee-keeping;
(d) reimbursement of the costs of honey analysis; and
(e) the restoration of hives.
§ 3
Application for subsidy
(1) The application for a subsidy for a measure under Article 2 (hereinafter referred to as "the application") shall be submitted by the applicant for a subsidy under Article 4 to 12 to the State Agricultural Intervention Fund (hereinafter referred to as "the Fund") on the form issued by him before 1 August in beekeeping year 3, requesting a subsidy for a measure under Article 2 (hereinafter referred to as "the relevant apiculture year").
(2) The applicant for the subsidy provided for in Sections 4 to 12 shall indicate in addition to the information provided for in Section 37 (2) of the Administrative Regulation:
(a) the measure under Article 2 for which it applies for a subsidy under Article 4 to 12; and
(b) other information necessary for the assessment of the application provided for in Sections 4 to 12.
(3) The applicant shall provide supporting documents as provided for in Sections 5 to 12.
(4) The relevant apiculture year shall be the period from 1 August 2022 to 31 December 2022 after 31 July 2022.
(5) The application referred to in paragraphs 1 and 2 may not be lodged with the Fund for a period beginning in 2023.
§ 4
Technical assistance
The amount of assigned revenue in accordance with Article 21 (3) of the Financial Regulation is estimated at EUR 150000. (a) the Fund shall:
(a) the organisation of an educational event for bee breeders focusing on the topics listed in Part A of Annex 1 to this Regulation;
(b) the management of the apiculture ring for children and youth on the subjects listed in Part B of Annex 1 to this Regulation;
(c) the acquisition of new equipment for bee breeders for which no subsidy has yet been granted pursuant to Parts C and D of Annex 1 to this Regulation, at least CZK 20,000,
(d) the organisation of an exhibition or participation in an exhibition and other cultural event according to Parts E and F of Annex 1 to this Regulation, at least worth CZK 20 000 eligible costs; and
(e) the production and issue of promotional material according to Part G of Annex 1 to this Regulation, at least 20 000 CZK of eligible costs.
§ 5
Training events for bee breeders
(1) An applicant for a subsidy under Article 4 (a) may be a legal person who:
(a) for at least 2 calendar years immediately preceding the calendar year in which the application for a subsidy referred to in Article 4 (a) is submitted, teach the apiculture course (4);
(b) it has a data box accessible,
(c) has an Internet reservation system in place to plan and log in educational events for bee breeders; and
d) has established a register of lecturing events for bee breeders.
(2) The applicant for the subsidy referred to in Article 4 (a) shall, in addition to the information referred to in Article 3, provide evidence of the application:
(a) the original of the instrument of presentation on which it appears
1. topic of training for bee breeders listed in part A Annex No 1 to this Regulation,
2. the name and, where applicable, the name, surname and address of the place of permanent residence or the seat of the lecturer for bee breeders;
3. place of training for bee breeders,
4. the date and time of the training event for bee breeders; and
5. the names and surnames of the participants present in the training event for bee breeders, their registration numbers and their signatures; and
(b) an extract from the registers referred to in paragraph 1 (d) on 1 August of the apiculture year concerned.
(3) The Fund will grant a grant for a training event for bee breeders in accordance with Article 4 (a), provided that the applicant delivers, by the end of the relevant apiculture year at the latest, documents proving that:
(a) the training event for bee breeders has been conducted by a lecturer who has a higher education, a vocational training teacher for the field of apiculture education or a secondary education with a certificate in the field of education of the beekeeper and is kept in the register of speakers referred to in paragraph 1 (d);
(b) the training of bee breeders on the subjects listed in Part A of Annex 1 to this Regulation took at least 150 minutes of teaching each day during which it was organised;
(c) at least 15 bee breeders who have been present for at least 80% of the total duration of the event have visited the training event for bee breeders; and
(d) has the competence referred to in paragraph 1 (a).
§ 6
Beekeeping rings for children and youth
(1) An applicant for a subsidy under Paragraph 4 (b) may be a legal person who:
(a) for at least 2 calendar years immediately preceding the calendar year in which the grant application is submitted pursuant to § 4 (b), teach the apiculture course (4);
(b) it has a data box accessible; and
(c) it has a register of heads of apiculture rings for children and youth.
(2) The applicant for the subsidy referred to in Article 4 (b) shall, in addition to the information referred to in Article 3, provide evidence of the application:
(a) the list of members of the apiculture club for children and youth; and
(b) the original of the instrument of presentation on which it appears
1. the topic of the apiculture ring listed in Part B of Annex 1 to this Regulation,
2. the name, names, surname and address of the permanent residence or registered office of the head of the apiculture club for children and youth;
3. the venue of the apiculture club for children and youth,
4. the date and time of the apiculture club for children and youth; and
5. the names and surnames of members of the apiculture club present for children and youth and their signatures.
(3) The Fund will grant a subsidy for the management of the apiculture ring for children and young people in accordance with Article 4 (b), provided that the applicant delivers, at the latest by the end of the relevant apiculture year of the Fund, evidence that:
(a) the apiculture ring for children and youth has been led by a manager who shall be kept in the register of the heads of apiculture rings referred to in paragraph 1 (c);
(b) the apiculture club for children and youth has been taught at least 20 hours in the relevant apiculture year;
(c) the apiculture ring for children and youth has visited at least 5 members of the apiculture ring for children and youth who have been present for at least 80% of the total duration of that ring; and
(d) has the competence referred to in paragraph 1 (a).
§ 7
Acquisition of new equipment for bee breeders
(1) The applicant for a subsidy under § 4 (c) may be a registered association which:
(a) operate in the field of bee husbandry for at least 2 calendar years immediately preceding the calendar year in which the grant application referred to in Article 4 (c) is submitted;
(b) on the date on which the application is submitted and for a period of 1 calendar year immediately preceding the calendar year in which the application for the grant referred to in Article 4 (c) is received, it shall bring together at least 500 bee breeders in the Czech Republic registered under the Breeding Code (2); and
(c) the data box is accessible.
(2) The applicant for the subsidy referred to in Article 4 (c) shall, in addition to the information referred to in Article 3, provide evidence of the application:
(a) a list of bee breeders with their registration numbers, including information on which of these bee breeders is also a member of the association;
(b) the number and type of new establishment for which it applies for a subsidy;
(c) an undertaking by the bee-keeper that the new establishment for which he requests a subsidy will hold and operate for at least five years from the date on which the decision to grant the subsidy became final; and
(d) an undertaking by the bee-keeper to have, for a period of 5 years from the date of the acquisition of legal power, a decision to grant a grant for the acquisition of a new establishment referred to in Part D of Annex 1 to this Regulation registered under the Breeding Law (2), by 1 September of the calendar year, more than 150 hives which will be kept throughout that period.
(3) The Fund grants a subsidy for the acquisition of new equipment listed in Part C of Annex 1 to this Regulation pursuant to § 4 (c),
(a) if, by the end of the relevant apiculture year of the Fund, the applicant has delivered documents proving the acquisition of such a new establishment by the bee farmer; and
(b) if the applicant gives the identification data of the bee-keeper who has acquired the new establishment and which is registered under the Breeding Law (2) for at least two calendar years immediately preceding the calendar year in which the application for a subsidy is submitted pursuant to Article 4 (c),
1. the natural person, the name or, where applicable, the name, surname, date of birth, the address of the place of permanent residence or registered office and the identification number of the person, if assigned; or
2. a legal person, a business firm or name, registered office and identification number of the person.
(4) The Fund grants a subsidy for the acquisition of new equipment listed in Part C or D of Annex 1 to this Regulation pursuant to § 4 (c),
(a) if, by the end of the relevant apiculture year of the Fund, the applicant has delivered documents proving the acquisition of such a new establishment by the bee farmer; and
(b) where the applicant provides identification data for the bee-keeper who has acquired this new establishment and has registered more than 150 hives on 1 September of the relevant apiculture year according to the breeding code (2);
1. the natural person, the name or, where applicable, the name, surname, date of birth, the address of the place of permanent residence or registered office and the identification number of the person, if assigned; or
2. a legal person, a business firm or name, registered office and identification number of the person.
§ 8
Organisation of the exhibition, participation in the exhibition and other cultural events and production and publication of promotional material
(1) An applicant for a subsidy under § 4 (d) or (e) may be a registered association which:
(a) operate in the field of bee husbandry for at least two calendar years immediately preceding the calendar year in which the subsidy application referred to in paragraph 1 is submitted;
(b) at the date on which the application is submitted and for a period of 1 calendar year immediately preceding the calendar year in which the application for subsidy referred to in paragraph 1 is received, it shall bring together at least 500 bee breeders in the Czech Republic registered under the Breeding Code (2); and
(c) the data box is accessible.
(2) The applicant for the subsidy referred to in Article 4 (d) or (e) shall, in addition to the information referred to in Article 3, provide evidence of the application:
(a) a list of bee breeders with their registration numbers, including information on which of these bee breeders is also a member of the association; and
(b) an overview of the exhibitions organised, an overview of the exhibitions and cultural events attended by the applicant and a list and type of promotional material created and issued.
(3) The Fund provides a subsidy for:
(a) the reimbursement of the costs of organising exhibitions or participating in exhibitions and other cultural events as referred to in Article 4 (d), provided that the applicant has, at the latest by the end of the relevant apiculture year of the Fund, supplied documents proving that he has organised the exhibition or participated in an exhibition or other cultural event which he has not organised himself; or
(b) the reimbursement of the costs of the production and issue of promotional material referred to in Article 4 (e), provided that the applicant delivers, by the end of the relevant apiculture year of the Fund, documents proving that he has produced and issued promotional material concerning bees and apiculture to the public at the latest.
§ 9
Combating varroasis
(1) The subsidy for the measure referred to in Article 2 (b) will be granted by the Fund to cover the costs of acquiring the active substance against varroase listed in Annex 2 to this Regulation.
(2) The applicant for the subsidy referred to in paragraph 1 may be a registered association which:
(a) operate in the field of bee husbandry for at least two calendar years immediately preceding the calendar year in which the subsidy application referred to in paragraph 1 is submitted;
(b) at the date on which the application is submitted and for a period of 1 calendar year immediately preceding the calendar year in which the application for subsidy referred to in paragraph 1 is received, it shall bring together at least 500 bee breeders in the Czech Republic registered under the Breeding Code (2); and
(c) the data box is accessible.
(3) The applicant for the subsidy referred to in paragraph 2 shall, in addition to the information referred to in Article 3, provide evidence of the application:
(a) a list of bee breeders with their registration numbers, including information on which of these bee breeders is also a member of the association; and
(b) the number and type of device it applies for.
(4) The Fund shall grant a subsidy to cover the costs of acquiring the means referred to in paragraph 1,
(a) if, by the end of the relevant year of the Fund, the applicant delivers documents proving the acquisition of the device at the latest; and
(b) if the applicant gives the identification data of the bee-keeper who has acquired the device for the treatment of the bees kept by him, that is to say:
1. the natural person, the name or, where applicable, the name, surname, date of birth, the address of the place of permanent residence or registered office and the identification number of the person, if assigned; or
2. a legal person, a business firm or name, registered office and identification number of the person.
§ 10
Rationalisation of beekeeping
(1) The subsidy for the measure provided for in Article 2 (c) is granted by the Fund for the acquisition of new equipment in accordance with Annex 3 to this Regulation for the diving of hives outside a permanent post with a total cost of at least CZK 20,000 and for which no subsidy has yet been granted.
(2) The applicant for the subsidy referred to in paragraph 1 may be a registered association which:
(a) operate in the field of bee husbandry for at least two calendar years immediately preceding the calendar year in which the subsidy application referred to in paragraph 1 is submitted;
(b) at the date on which the application is submitted and for a period of 1 calendar year immediately preceding the calendar year in which the application for subsidy referred to in paragraph 1 is received, it shall bring together at least 500 bee breeders in the Czech Republic registered under the Breeding Code (2); and
(c) the data box is accessible.
(3) The applicant for the subsidy referred to in paragraph 2 shall, in addition to the information referred to in Article 3, provide evidence of the application:
(a) a list of bee breeders with their registration numbers, including information on which of these bee breeders is also a member of the association;
(b) the number and type of new nomadic establishment for which it applies for a subsidy;
(c) an undertaking by the bee-keeper that the new nomadic establishment for which the grant is requested will hold and operate for at least five years from the date on which the decision to grant the subsidy becomes final;
(d) confirmation by the bee breeder of the medical fitness of hives for diving in the period referred to in Article 3 (4);
(e) an undertaking by the bee-keeper to keep a continuous record of the trapping of the bees kept by him for at least 5 years from the date on which the decision to grant the subsidy became final; and
(f) an undertaking by the bee keeper to have, for a period of 5 years from the date of the acquisition of legal power, a decision to grant a grant for the acquisition of a new establishment referred to in point 2 of Annex 3 to this Regulation registered in accordance with the Breeding Law (2), by 1 September of the calendar year, more than 150 hives which will be kept throughout that period.
(4) The Fund will provide a subsidy for the acquisition of a new bee-keeping facility referred to in paragraph 1,
(a) if, by the end of the relevant apiculture year of the Fund, the applicant has delivered documents proving the acquisition of such a new establishment by the bee farmer; and
(b) if the applicant indicates the identification data of the bee breeder who has acquired this new establishment for the diving of bees outside a permanent post which, on 1 September of the relevant apiculture year, is registered in accordance with the breeding code (2) at least 20 hives and which is registered under the breeding code (2) for at least 2 calendar years immediately preceding the calendar year in which the application for a subsidy is submitted pursuant to paragraph 1,
1. the natural person, the name or, where applicable, the name, surname, date of birth, the address of the place of permanent residence or registered office and the identification number of the person, if assigned; or
2. a legal person, a business firm or name, registered office and identification number of the person.
§ 11
Reimbursement of honey analysis costs
(1) The subsidy for the measure referred to in Article 2 (d) will be granted by the Fund to cover the costs of:
(a) a physico-chemical analysis of mede5); or
(b) analysis of honey for the presence of Paenibacillus larvae spores, carried out in laboratories accredited under the legislation governing technical requirements for products6).
(2) The applicant for the subsidy referred to in paragraph 1 may be a registered association which:
(a) operate in the field of bee husbandry for at least two calendar years immediately preceding the calendar year in which the subsidy application referred to in paragraph 1 is submitted;
(b) at the date on which the application is submitted and for a period of 1 calendar year immediately preceding the calendar year in which the application for subsidy referred to in paragraph 1 is received, it shall bring together at least 500 bee breeders in the Czech Republic registered under the Breeding Code (2); and
(c) the data box is accessible.
(3) The applicant for the subsidy referred to in paragraph 2 shall, in addition to the information referred to in Article 3, provide evidence of the application:
(a) a list of bee breeders with their registration numbers, including information on which of these bee breeders is also a member of the association;
(b) an overview of the number and type of honey analyses referred to in paragraph 1 for which it applies for the subsidy; and
(c) the name and address of the accredited laboratory, including a copy of the accreditation certificate.
(4) The Fund shall grant a grant to cover the costs of the honey analyses referred to in paragraph 1,
(a) if the applicant delivers, by the end of the relevant year of the Fund, documents proving the number of honey analyses carried out; and
(b) if the applicant gives the identification of the bee breeder who had the honey analysed,
1. the natural person, the name or, where applicable, the name, surname, date of birth, the address of the place of permanent residence or registered office and the identification number of the person, if assigned; or
2. a legal person, a business firm or name, registered office and identification number of the person.
(5) The Fund will provide a grant for a maximum of 4 honey analyses for 1 bee farmer.
§ 12
Restoration of hives
(1) Subsidy for measures under Article 2 (1) of the basic Regulation (e) The fund shall provide for breeding of bees from a recognised breeding programme (7) in the Czech Republic.
(2) The applicant for the subsidy referred to in paragraph 1 may be a recognised breeding association which:
(a) operate in the breeding of bees for at least two calendar years immediately preceding the calendar year in which the application for the subsidy referred to in paragraph 1 is submitted; and
(b) the data box is accessible.
(3) The applicant for the subsidy referred to in paragraph 2 shall, in addition to the information referred to in Article 3, provide evidence of the application:
(a) the name of the recognised breeding association;
(b) the designation of an authority recognised by a breeding association which authorises the inclusion of a bee-keeping body in breeding kept by a recognised breeding association;
(c) an officially certified copy proving the recognition of the breeding association; and
(d) an overview of the number of bred bees from the recognised breeding programme referred to in paragraph 1 to which the grant is requested.
(4) The Fund shall grant a subsidy for breeding of bees from a recognised breeding programme referred to in paragraph 1,
(a) where the applicant delivers, by the end of the relevant apiculture year of the Fund, documents proving the number of bees sold by the breeder from a recognised breeding programme to a bee breeder in the Czech Republic,
(b) if the applicant indicates the identification data of a bee breeder included in a recognised breeding programme which has sold these bred bee mothers to a bee breeder in the Czech Republic,
1. the natural person, the name or, where applicable, the name, surname, date of birth, the address of the place of permanent residence or registered office and the identification number of the person, if assigned; or
2. a legal person, a business firm or name, registered office and identification number of the person.
§ 13
Publication of the subsidy amount
(1) The amount of the subsidy for the measures provided for in paragraphs 4 to 12 will be published by the Fund by 31 January of the apiculture year concerned at the latest on the Fund's website.
(2) For the period referred to in Article 3 (4), the Fund shall publish the data referred to in paragraph 1 by 31 January 2023 at the latest.
§ 14
Amount of the subsidy per measure
(1) The amount of the subsidy for the measures provided for in Articles 5 to 8 is maximum
(a) CZK 4,000 for the organisation of not more than one training event for bee breeders under § 4 (a) in one day in one place, even if more than one training event is organised in one day in one place, but not more than 1 200 for the relevant apiculture year for one applicant for the subsidy under § 4 (a),
(b) 6 000 CZK for the relevant apiculture year for the management of a single apiculture ring for children and young people in accordance with § 4 (b), but not more than 2 apiculture rings for children and young people led by one head apiculture ring for children and youth,
(c) 90% of the actual costs incurred for each new installation pursuant to Article 4 (1) (b) of the basic Regulation. (c) not more than the amount referred to in Part C or D of Annex No 1 to this Regulation and for all new establishments not exceeding CZK 100 000 for the relevant apiculture year for one bee breeder; or
(d) 90% of the actual costs incurred in organising exhibitions, participating in exhibitions and other cultural events, or in the creation and issue of promotional materials pursuant to Article 4 (d) and (e) for the relevant apiculture year, not more than 2% of the subsidy amount referred to in Article 13.
(2) The amount of the subsidy for the relevant apiculture year for the measure provided for in Article 9 is 40% of the actual cost of the medical or preventive measures against varroasis listed in Annex 2 to this Regulation.
(3) The amount of the subsidy for the relevant apiculture year for the measure referred to in Article 10 shall be 90% of the actual cost of the individual installations referred to in Article 10 (1), not exceeding the amount referred to in Annex 3 to this Regulation and for all installations not exceeding CZK 150 000 per bee farmer.
(4) The amount of the subsidy for the apiculture year concerned for the measure provided for in Article 11 is:
(a) 800 CZK per honey analysis according to § 11 (1) (a); or
b) 400 CZK per honey analysis according to § 11 (1) (b).
(5) The amount of the subsidy for the relevant apiculture year for the measure provided for in Article 12 is CZK 200 per bee mother sold from breeding from a recognised breeding programme (7).
(6) If the sum of all the eligible entitlements referred to in paragraph 1 (d) exceeds 2% of the financial amount declared under paragraph 13 and adjusted under paragraph 15, the Fund shall reduce the funding for the payment of the subsidy referred to in paragraph 1 (d) proportionately.
(7) If the sum of all eligible entitlements referred to in paragraphs 1 to 5 exceeds the financial amount published in accordance with Paragraph 13, adjusted in accordance with Paragraph 15 and reduced by the amount referred to in paragraph 1 (d), which will be paid as a priority, the Fund shall subsequently pay the subsidy referred to in paragraph 1 (a) and (b), and paragraphs 2, 4 and 5, and the remaining funds for the payment of the grants referred to in paragraph 1 (c) and 3 shall reduce proportionally.
§ 15
Reduction of subsidy
