GOVERNMENT REGULATION
of 16 April 2008
amending Government Regulation No 239 / 2007 Coll., laying down conditions for the granting of subsidies on afforestation of agricultural land, and Government Regulation No 308 / 2004 Coll., laying down certain conditions for the granting of subsidies on afforestation of agricultural land and on the establishment of crops of fast growing timber on agricultural land intended for energy use, as amended by Government Regulation No 512 / 2006 Coll.
The Government mandates pursuant to § 2c (5) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 85 / 2004 Coll., to implement § 2c (2) (b) of this Act, and pursuant to § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll.:
Amendment of the Government Regulation on the conditions for granting subsidies for afforestation of agricultural land
Government Decree No. 239 / 2007 Coll., on the establishment of conditions for the grant of subsidies for afforestation of agricultural land, is amended as follows:
1. In Article 3 (1), the words "for the calendar year concerned" shall be inserted after the words "granting aid for afforestation."
2. in Article 3 (2) (e), the words "the receipt of an application for subsidy to be made" shall be deleted;
3. in Article 3 (2) (f), the words "(k) and (l)" shall be inserted after the words "(e)."
4. In Article 3 (2) (f), the words "the receipt of an application for subsidy to 'are deleted.
5. in Article 4 (1) and (2), the words "under the single application (11)" shall be deleted;
footnote 11 is deleted.
6. in Article 6 (1), point (b) shall be deleted;
Points (c) and (d) shall be renumbered (b) and (c).
7. In Article 6, at the end of paragraph 2, the dot is replaced by a comma and the following point (c) is added:
"(c) the number of viable individuals spread evenly across the area shall not fall below 90% of the minimum number of individuals of each species per hectare of land from the date of receipt of the application for afforestation grant by 14 May of the calendar year following the calendar year in which afforestation was carried out, if it is for the renewal of the forest and afforestation provided for in the Decree governing the details of the transfer of seeds and seedlings of forest trees, the registration of the origin of the reproductive material and the details of the restoration of forest crops and the afforestation of the parcels declared for the implementation of forest functions (15)."
8. In Article 7 (1), the words "reduce the afforestation grant by leafy or coniferous trees on the basis of the area determined by twice the difference found, provided that the difference exceeds 3% but not more than 30% of the area determined 'are replaced by the words" grant for afforestation by leafy or coniferous trees provided that the difference does not exceed 30%'.
9. In Article 7 (2), "paragraph 1 (b) 'is replaced by" paragraph 2 (c)';
10. in Paragraph 7 (2) (a), "10" is replaced by "5."
11. in Article 7 (2) (b), "20" is replaced by "10."
12. in Article 7 (3), "paragraph 1 (b)" is replaced by "paragraph 2 (c)";
13. in Paragraph 7 (4):
"(4) If the Fund finds a breach of the condition laid down in Article 6 (1) (b) for granting aid for forest management and compensation for the cessation of agricultural production, the number of viable individuals spread evenly across the area has decreased
(a) below 80% to 70%, the forest management subsidy and the compensation for the cessation of agricultural production shall be reduced by 10%;
(b) below 70% to 60%, the forest management subsidy and the compensation for the cessation of agricultural production shall be reduced by 20%;
(c) under 60%, no subsidies for forest management and no compensation for the cessation of agricultural production shall be granted. ";
14. in Article 7 (6), "(d)" is replaced by "(c)";
15. in Article 7 (7), "(d)" is replaced by "(c)";
16. in Article 8 (2), "(c)" is replaced by "(b)";
17. in Paragraph 8 (2) (a), "10" is replaced by "5."
18. in Paragraph 8 (2) (b), "20" is replaced by "10."
19. in Paragraph 8 (2) (c), "50" is replaced by "30."
20. Paragraph 8 (5), including footnote 24, is deleted.
Amendment of the Government Regulation on certain conditions for granting subsidies on the afforestation of agricultural land and on the establishment of crops of rapidly growing timber on agricultural land intended for energy use
Government Decree No. 308 / 2004 Coll., laying down certain conditions for the granting of subsidies on the afforestation of agricultural land and on the establishment of crops of rapidly growing timber on agricultural land intended for energy use, as amended by Government Decree No. 512 / 2006 Coll., is amended as follows:
1. In Paragraph 8 (1), the word "or 'shall be deleted at the end of point (b).
2. In Article 8, at the end of paragraph 1, the dot is replaced by "or '.
3. In Article 8, point (d) is added at the end of paragraph 1, including footnote 15a:
"(d) restitution15a).
15a) For example Act No. 229 / 1991 Coll., on the modification of property relations with land and other agricultural property, as amended. '
EFFECTIVE
This Regulation shall enter into force on 1 May 2008.
