THE LAW
of 11 June 1998
on the protection of classified information and amending certain laws
Parliament has decided on this law of the Czech Republic:
Act No. 166 / 1993 Coll., on the Supreme Audit Office, as amended by Act No. 331 / 1993 Coll., Act No. 117 / 1994 Coll., Act No. 224 / 1994 Coll., Act No. 58 / 1995 Coll., Act No. 236 / 1995 Coll. and the Constitutional Court Act No. 296 / 1995 Coll., is amended as follows:
Paragraph 21 (c), including footnote 4, reads as follows:
"(c) acquaint themselves with classified information if it is demonstrated by a certificate for the relevant classification level of such facts, issued in accordance with the Specific Act .4)

1. In Article 8 (3), the words "State and economic secrecy 'are replaced by the words" the secrecy of classified information protected by a special law'.
2. In Paragraph 35, the following paragraph 3 is added:
"(3) In criminal proceedings in which classified information is discussed protected by a special law, the law-enforcement authority shall be obliged to instruct the lawyer under such law. The same shall apply to persons whose participation in proceedings cannot be excluded. They shall record the lessons learned in the file. ';
3. Paragraph 50 (3) reads:
"(3) Only a designated person under a special law or a person under such a law may be instructed by an authorised person or a person under such law."
4. Paragraph 65 (5) reads:
"(5) When authorising access to files, measures shall be taken to preserve the secrecy of classified information protected by a special law. ';
5. In Paragraph 99 (1), the words "which constitute state secrets' are replaced by the words" concerning classified information protected by a special law '.
6. In the second sentence of Paragraph 99 (3), the words "the facts constituting the subject of professional secrecy 'shall be replaced by the words" classified classified classified in a separate law as "Confidential' or" Reserved '.';
7. In Paragraph 200 (1), the word "secret 'is replaced by" classified information'.
8. In the last sentence of Paragraph 201 (2), the words "secret protected 'are replaced by the words" classified information protected'.
9. In Article 201 (3), the words "state, economic or professional secrecy 'are replaced by the words" classified information protected by a special law'.

1. In Article 2 (1), the dot is replaced by a comma after point 9 and the following point 10 is added:
"10th National Security Bureau."
2. in Article 12 (1), point (l) is deleted and after point (k) the comma is replaced by a dot;
Repeal
Act No. 102 / 1971 Coll., on the Protection of State Secrets, as amended by Act No. 383 / 1990 Coll. and Act No. 558 / 1991 Coll.
Efficacy
This Law shall take effect on the first day of the fourth calendar month following the date of its publication, except for Article 7, which shall take effect on the 30th day following its publication.
