Central Trade Union Councils

on amendments to the Order of the Central Council of Trade Unions No 165 / 1979 Coll., on sickness insurance of certain workers and on the provision of sickness insurance benefits to citizens in special cases, as amended
The Central Council of Trade Unions, in agreement with the Federal Ministry of Labour and Social Affairs, provides, pursuant to § 2 (3) (c), § 9, § 51 (1) and § 63 (2) of Act No. 54 / 1956 Coll., on sickness insurance for employees, as amended by Act No. 16 / 1959 Coll., Act No. 87 / 1968 Coll. and Act No. 148 / 1983 Coll.:
Čl. I
The Order of the Central Council of Trade Unions No 165 / 1979 Coll., on the sickness insurance of certain workers and on the provision of sickness insurance benefits to citizens in special cases, as amended by Regulations No 155 / 1983 Coll., No 79 / 1984 Coll., No 135 / 1984 Coll. and No 59 / 1987 Coll., is amended as follows:
1. In Paragraph 48 (1), the word "fourth 'is replaced by" sixth'.
2. In Paragraph 49, the following paragraph 2 is inserted after paragraph 1:
"(2) Receipts belonging to them under the regulations on the financial and physical security of these pupils (1) and which are deductible under the provisions of Sections 1 to 3 of Decree No 143 / 1965 Coll. The value of the physical security and, where applicable, the natural benefits of these pupils shall not be included in the deductible earnings. ';
Paragraph 2 shall become paragraph 3.
3. The following Section 50a is inserted after Section 50:
„§ 50a
Pupils of secondary or special vocational training
(1) The date of transition from the preparatory period to the period of professional development shall be assessed in the same way as entry into employment for the determination of the relevant period. (2) Where, at the time of school holidays (except for winter and spring break) followed by a period of professional development, the pupil has practised a professional practice for which he is remunerated as a period of professional development, the date on which he began such training shall be deemed to be the date of transition from the preparatory period to the period of professional development.
(2) In order to establish the net daily wage under Paragraph 6 (1) of Decree No. 143 / 1965 Coll., the working days divided by the deductible earnings settled in the relevant period include the working days in which the teacher attended the theoretical course; However, working days relating to school holidays (except winter and spring holidays) are not included if the pupil did not practice in them.
(3) The school pupils are entitled to sickness at the earliest from the date on which they no longer receive remuneration under the regulations on the financial and physical security of pupils; (1) the grant of the sickness does not, however, prevent the grant of a child allowance to the pupil (s). 3) It is also provided on working days in which the teacher was to attend theoretical teaching and on working days for winter and spring holidays. However, it shall not be granted for working days relating to the main school holidays, except for those working days when a pupil of the teaching centre was required to conduct a professional practice for which remuneration is due as in the period of professional development. However, support periods shall be calculated from the first day of incapacity for work.
(4) Paragraph 50 (3) applies mutatis mutandis to pupils of the school. "
4. The following Section 51a is inserted after Section 51:
„§ 51a
Financial assistance in the motherhood of pupils of secondary or special vocational schools
(1) Paragraph 50a (1) and (2), Paragraph 51 (1), (2) and (5) apply mutatis mutandis to monetary assistance in the maternity of pupils.
(2) Money assistance in motherhood is provided to the teacher for all working days, including working days for school holidays.
(3) If the amount of maternity allowance per working day determined from the teacher's net daily pay (remuneration) is less than 42 CZK for a five-day working week and less than 35 CZK for a six-day working week, the teacher shall be provided with cash assistance for a five-day working week in the amount of 42 CZK for a six-day working week in the amount of 35 CZK for a working day.
(4) The previous paragraphs shall apply mutatis mutandis to the grant, amount and provision of financial assistance to the pupil of the school. ';
5. The second sentence of Paragraph 55 (1) reads: "If the pupils are pupils of a teaching institution, the following obligations are fulfilled by an organisation which provides the pupil with remuneration under the regulations on the financial and material security of these pupils (1)."

„§ 56
Paragraph 46 to 55 shall not apply:
(a) students and students of military schools (schools, academics) participating in armed forces sickness care;
(b) in the form of study at work which is already involved in sickness insurance (insurance) because of other activities;
(c) a student in a combined study already participating in sickness insurance (insurance) because of other activities. "
7. In § 89, the second sentence is: "If there is a caregiver with a changed working capacity, a caregiver with a single, widowed, divorced or for other serious reasons, who does not live with a partner and cares for at least one unprovided child, or a caregiver who looks after at least one unprovided child, it is required that the earnings in the calendar month be at least 400 Kčs."

Efficacy
This Decree shall take effect on 1 October 1988.
