on the protection of economic and professional secrecy
The Government of the Czechoslovak Socialist Republic orders pursuant to § 23 paragraph 3 of Act No. 102 / 1971 Coll., on the Protection of State Secrets:
Subject matter of economic and professional secrecy
(1) The facts forming the subject of economic and professional secrecy are contained in the lists of economic and professional secrecy issued and supplemented by the Minister of the Interior of the Czechoslovak Socialist Republic for each field and sector. The competent federal and Republic central authorities and organisations shall participate in the processing and replenishment of these lists.
(2) The lists referred to in paragraph 1 shall be drawn up together with the lists of facts constituting the subject matter of the State Secrets issued pursuant to the provisions of Paragraph 3 (1) of Act 102 / 1971 Coll., on the Protection of State Secrets (hereinafter referred to as "the Act").
Protection of economic and professional secrecy
The protection of economic and professional secrecy in the institutions and organisations (hereinafter referred to as the "organisations') shall be the responsibility of their managers, who are in particular required to create appropriate conditions for ensuring the protection of economic and professional secrecy, to ensure compliance with the provisions issued and to draw the relevant conclusions and measures from their infringement.
(1) Only persons who, in the performance of their duties, guarantee their professional and personal characteristics that economic and professional secrecy will not be compromised or divulged and who have been designated by the Head of the Organisation for Economic and Professional Relations may be made aware of the economic and professional secrets of the organisation.
(2) The head of the organisation or his authorised staff shall keep an overview of the persons who come into contact with economic and professional secrecy in their work.
A stranger and a stateless person may only become familiar with economic and professional secrecy with the agreement of the head of the organisation, unless otherwise provided by an international agreement or agreement.
The organisation shall ensure that the person who comes into contact with economic and professional secrecy in the performance of his or her duties is aware of the duties and tasks which result from the provisions governing the protection of such secrets, including the relevant lists of economic and professional secrets.
Obligations of persons intended to come into contact with economic and professional secrecy
(1) A person who comes into contact with economic and professional secrecy in the performance of his / her duties shall be obliged to keep confidential the facts forming the subject of economic and professional secrecy which he / she has become aware of and to ensure that they are not compromised or disclosed, in particular that those secrets do not come into the hands of unauthorised persons.
(2) A person who comes into contact with economic and professional secrecy in the performance of his or her duties shall be released from the head of the organisation if requested by the competent national authority; This shall be without prejudice to the provisions of the criminal rules and other provisions.
Tasks of the Federal Ministry of Interior
The Federal Ministry of the Interior, in ensuring the protection of economic and professional secrecy, shall carry out the tasks which it carries out under the provisions of Section 7 of the Act in the protection of state secrets.
Entry into organisations
If the interest in protecting economic and professional secrecy so requires, the management organisation shall lay down the conditions for entering the organisation's premises.
Efficacy
This Regulation shall enter into force on 1 January 1972.
