Central management of geodesy and cartography
of 30 June 1964
on the issue of basic conditions for the supply of geodetic and cartographic works
The central administration of geodesy and cartography in agreement with the participating central authorities and after approval by the main arbiter of the Czechoslovak Socialist Republic provides pursuant to Section 392 of Economic Code No. 109 / 1964 Coll.:
Scope
This decree regulates all supplies of geodetic and cartographic works *); However, it shall not apply to supplies from and for exports.
Economic contracts
The supply of geodetic and cartographic works shall be accompanied by:
(a) contracts for the preparation of supply of geodetic and cartographic works;
(b) contracts for the supply of geodetic and cartographic works.
Contract for the preparation of supplies of geodetic and cartographic works
(1) The contract on the preparation of supplies of geodetic and cartographic works is designed by the customer and the supplier to stabilise their economic relations, improve planning, make geodetic and cartographic works more economical and reduce delivery times.
(2) A draft contract for the preparation of supplies shall be submitted by the buyer to the supplier by 31 July for the following year or years. The draft contract shall be sent by the buyer in three copies.
(1) The contract for the preparation of supplies is usually concluded for a period of one year.
(2) The Treaty contains information concerning future supplies, in particular:
(a) the determination of the required work in terms of the place, nature and order of importance;
(b) the estimated scope of work in technical units;
(c) the expected financial volume of the work.
Contract for the supply of geodetic and cartographic works
(1) The contract for the supply of geodetic and cartographic works is normally concluded for a period of one year, exceptionally for a shorter period, for the whole volume of work to be carried out during the period concerned.
(2) The draft contract for the supply of geodetic and cartographic works shall be submitted by the buyer no later than 45 days before the beginning of the quarter in which the work is to be started in three copies.
(3) As a general rule, the organisation shall agree in the contract:
(a) the type of work and its brief technical description;
(b) scope of work in technical units;
(c) the financial volume of the work;
(d) precise identification of the location on the attached map (drawing, etc.), region, district, municipality,
(e) the content of the cartographic works, their purpose, the format of the original, etc.,
(f) the deadline for completion and, where appropriate, the time-frame for work and delivery of partial results;
(g) the extent and time limits of the customer's involvement, in particular the provision of supporting documents.
If the supplier is to carry out work at the customer's workplaces for which emergency safety measures are required, the customer shall be obliged to inform the supplier specifically designated by the supplier of all safety regulations applicable to such workplaces. He shall also be obliged to carry out appropriate security measures for the supplier's personnel and to provide them with the means and equipment prescribed free of charge, where appropriate, at the place where the works are carried out.
If an urgent need so requires, work may, to the extent necessary, commence with the consent of the customer already on the basis of a draft contract; If the contract is not concluded, the supplier shall have the right to reimbursement of the costs incurred in these works.
The originals of both measurement and written elaborates remain a material for technical documentation, unless otherwise agreed by the organisation.
Property sanctions
A collector who, within the agreed time limits, does not hand over to the supplier the supporting documents necessary for carrying out the work or does not provide any other necessary cooperation (§ 6 (3) (g)) shall be obliged to pay the supplier a penalty payment of 0,5% of the delivery price for each month of delay, but no longer than 6 months.
Efficacy
This Decree shall take effect on 1 July 1964.
