GOVERNMENT REGULATION
of 6 December 1961
on the provision of a military exercise by members of uniform agricultural cooperatives and artists
The Government of the Czechoslovak Socialist Republic hereby orders, pursuant to Article 65 (2) of Act No. 55 / 1956 Coll., on Social Security, and Article 11 (1) of Act No. 64 / 1950 Coll., on Social Security of persons called upon to serve in the armed forces and their family members:
(1) Where members of single agricultural cooperatives or other permanent workers in such cooperatives who are not employed or members of the cooperative ("cooperatives'), military exercises or other armed forces, with the exception of military basic and alternative services (" military exercises'), and their pension insurance under the pension scheme (insurance) of members of the uniform agricultural cooperatives before the military training is started, they shall be entitled to an allowance of at least three months. Compliance with the pension requirement for at least three months shall not be required if this condition could not be met for reasons of general interest or for other serious reasons.
(2) The allowance for each month of military training shall be:
(a) 50% of the cooperative's average wage, unless he looks after any family member;
(b) 65% of the cooperative's average working salary, taking care of one family member;
(c) 90% of the cooperative's average salary, taking care of two family members;
(d) 95% of the cooperative's average working salary, taking care of three or more family members.
For the part of the calendar month during which the cooperative performed military exercises, there is a proportion of the provision allowance.
(3) The allowance shall be reduced by an amount equivalent to the value of the remuneration payable by the cooperative to the family of the cooperative during his military training; in so doing, no allowance shall be paid to children provided by the cooperative to the cooperative.
(4) The average remuneration shall be 12 per cent of the income from the work activity (both cash and in kind) received from the cooperative during the last 12 calendar months prior to the start of the military exercise; the period of recognised incapacity for disease or accident is excluded from that period. For workers who are seconded to the cadre strengthening of single agricultural cooperatives, a supplement to the remuneration paid by State resources shall be included in the income from the work. If membership of the cooperative continues for a period of less than 12 months, the average wage for this shorter period shall be calculated from the planned remuneration.
(1) Artists who have been called for military training and their family members shall, for the period of military training, have a provision allowance which shall be made for each month of military exercise:
(a) 700 CZK, unless the artist cares for any family member,
(b) 900 CZK, if the artist takes care of one family member,
c) 1200 CZK, if the artist takes care of two family members,
(d) 1300 CZK, if the artist takes care of three or more family members.
For the part of the calendar month during which the artist performed the military exercises, there is a proportion of the provision allowance.
(2) The provision of the artist's contribution is reduced by his income from artistic activity at the time of military training.
(3) For the purposes of this Regulation, writers, music composers, artists, architects, researchers, performers and artists shall be regarded as artists, recognised by the relevant senior organisation, who, for at least three months, carry out their artistic activities as a profession constituting a permanent and principal source of income, but not in employment.
(1) The following shall be considered as family members of the cooperative (artist):
(a) wife,
(b) children until completion of compulsory education;
(c) children from the end of compulsory education to the age of 25, provided that they are continuously trained or studied for a future occupation or are permanently incapacitated for illness or physical or mental illness;
(d) a companion who has been living with a cooperative (artist) in the same household for at least three months.
(2) The following shall be considered family members:
(a) shelters, grandchildren and siblings until the end of compulsory education;
(b) shelters, grandchildren and siblings from the end of compulsory education until the age of 25, provided that they are continuously trained or studied for a future occupation or are permanently incapacitated for illness or physical or mental illness;
(c) parents, grandparents, father-in-law and mother-in-law,
(d) a nurse or a daughter who leads to a widowed or divorced (separated) cooperative (s) of his household, in which he looks after his children until the end of compulsory education, unless they have their own income in excess of 200 Cds per month;
(e) ex-wife of a cooperative (artist), if the cooperative (artist) has a designated maintenance obligation; However, the allowance may not be more than the remuneration due to it to meet its personal needs.
If, after the completion of one type of service, the cooperative (artist) performs the same or another type of service in the armed forces, the downstream service shall be considered as a continuation of the previous service in terms of entitlement to the provision allowance.
(1) The provision allowance is provided by the Regional National Committee; is paid monthly.
(2) Entitlement to the provision allowance shall be applied by application lodged with the local national committee. The application shall include the confirmation of the single agricultural cooperative of the average remuneration of the cooperative called for military training and the replacement of the remuneration provided to the cooperative's family for the duration of his military training; if it is an artist, a confirmation of the ultimate idea of belonging to the organisation, the pursuit of an artistic activity and the income of the artist from that activity during his military exercise.
(3) The local national committee shall verify the facts contained in the application and forward the application to the district national committee.
(4) The provision allowance shall be paid from the budget of the national committees for social security purposes.
The rights of persons called upon to engage in military exercises and their family members for the provision allowance provided for in this Regulation shall be governed by this Regulation; However, if the existing rules are more favourable, the rights of those persons shall be governed by the existing rules.
Under this Regulation, the rights of cooperatives and artists who exercised military exercises between 1 September 1961 and the date of publication of this Regulation and their family members shall also be assessed. The amounts paid in respect of the provision allowance for that period shall be equal to the amounts due under this Regulation; overpayments don't come back.
This Regulation shall enter into force on the day of its publication.
