DECLARATION
of 23 March 2004
amending Decree No. 428 / 2001 Coll., implementing Act No. 274 / 2001 Coll., on water and sewage for public use and amending certain laws (Law on water and sewage)
According to Article 40 of Act No. 274 / 2001 Coll., on water and sewage for public use and on the amendment of certain laws (Water and Sewerage Act) (hereinafter referred to as "the Act"), the Ministry of Agriculture provides for the implementation of Sections 5 (6), 8 (12), 13 (5), 17 (8) and 38 (6) of the Act:

Decree No. 428 / 2001 Coll., implementing Act No. 274 / 2001 Coll., on Water and Sewerage for Public Use and amending certain laws (Water and Sewerage Act) is amended as follows:
1. in Paragraph 1 (d):
"(d) a set of objects and equipment with water treatment technology (water treatment plant) by construction; for the purposes of the selected data, the property or operating records shall be considered as a water treatment building, with any water protection equipment without water treatment technology, ';
2. In Article 1, at the end of point (h), the dot is replaced by a comma and the following points (i) and (j) are added:
"(i) the responsible representative of the operator, the person mentioned in the authorisation of the Regional Authority for the operation of the water duct or sewerage (Section 6 of the Act);
(j) the reference method for measuring the determination of the principle or procedure for determining the monitored raw surface water indicators. "
3. In Paragraph 6 (1), the word "digital 'is replaced by" prescribed electronic'.
4. Paragraph 6 (3) reads as follows:
"(3) The owner of the water duct or sewage system shall transmit the collected data from the property register to the water authority in accordance with Section 27 of the Act in whose territorial jurisdiction the water duct or sewerage is situated; where the water pipeline or sewerage interferes with the territorial competence of several water authorities, the data collected from the property register shall be transmitted to the water authority in whose territorial competence the maximum annual consumption of drinking water is situated or the maximum amount of waste water is being transferred from its territorial competence. ';
5. the following paragraphs 4 and 5 are added to Article 6, including footnote (1a):
"(4) The validation of the transmission of the selected data from the property register shall be carried out electronically provided with the guaranteed electronic signature 1a) by the statutory authority of the owner of the water duct or sewerage, by the transmission of the data carrier with the collected data from the property register validated by the statutory authority of the owner of the water duct or sewerage, including a statement of the correctness of the transmitted data or by the transmission of printed individual forms of the data from the property register signed by the member of the statutory authority of the owner of the water duct or sewage.
(5) The collection of the collected data shall be transmitted to the regional authorities by the Ministry of Agriculture (hereinafter referred to as the Ministry) for the preceding calendar year by the end of June.

7. Paragraph 7 (3) and (4) reads as follows:
"(3) The owner of the pipeline or sewerage shall transmit the selected data from the register to the competent authority in accordance with Article 27 of the Act in whose territorial jurisdiction the pipeline or sewerage is located; where the water supply or sewage system interferes with the territorial scope of several water law offices, the data collected from the operating register shall be transmitted to the water authority in whose territorial competence the maximum annual consumption of drinking water or the geographical scope of which the maximum amount of waste water is paid.
(4) Where more than one water pipeline or sewage system is a functional unit in which the water quality can be considered to be approximately equal, with one operator owned by several persons, the selected data from the register shall be transmitted to the water authority for that functional unit or part thereof. The data collected from the register shall be transmitted by the owner of the highest-priced functional unit referred to in point 5 of Annexes 1 to 4. ';
8. In Article 7, paragraphs 7 and 8 are added:
"(7) Confirmation of the accuracy of the selected data from the operating register shall be carried out electronically provided with the guaranteed electronic signature (1a) by the responsible representative of the water duct operator or sewerage operator, by the transmission of the data carrier with the selected data from the operating register, confirmed by the responsible representative of the water duct or sewage operator, including a statement of the accuracy of the data transmitted or the printed individual forms of the selected data from the operating register, signed by the responsible representative of the water duct operator or sewage operator.
(8) The file of the selected data shall be transmitted by the Ministry to the regional authorities for the preceding calendar year by the end of June. "
9. In Article 9, at the end of paragraph 4, the dot is replaced by a comma and the words "for example, the arbitration method of analysis according to the specific legislation.7a)

„§ 13
(1) In addition to the general requirements, the water supply contract shall include the following elements:
(a) the determination of the site of the construction or of the land connected by the water pipeline connection;
(b) limit the quantity of water supplied, including the quantity determining the capacity of the water meter or the profile of the connection;
(c) the method of determining the quantities of water collected, including the requirements for customers resulting therefrom (e.g. water meter location requirements, personal participation in deduction);
(d) the quality of the water supplied;
(e) the method of fixing the price and the manner of its publication;
(f) the method of invoicing, including any advances, and the method of payment;
(g) where the owner of the pipeline is different from the operator, the extent of their liability to the customer in accordance with the contract provided for in Article 8 (2) of the Act;
(h) the period of performance.
(2) In addition to the general requirements, the contract for the discharge of discharges contains the following elements:
(a) the determination of the site of the construction or of the plot connected by the sewerage connection;
(b) permissible levels of quantity and pollution of effluent discharge;
(c) calculation of the quantity of withholding water;
(d) the method for determining the quantities of waste water disposed of;
(e) the possibility of applying a reduction in the quantities of waste water delivered, including by the supplier of the method used to calculate the reduction (Section 19 (7) of the Act),
(f) the level and balance of pollution of discharges;
(g) the method of fixing the price and the manner in which it is published;
(h) the method of invoicing, including any advances, and the method of payment;
(i) where the owner of the sewerage is different from the operator, the specification of their liability to the customer in accordance with the contract provided for in Article 8 (2) of the Act;
(j) the period of performance. ';
11. in § 16 (j), the comma at the end is replaced by a semicolon and the words "sludge is also residual sludge from sewage treatment plants, both processed and unprocessed," are added.
12. in Paragraph 21 (4), the word "digital" shall be replaced by the words "prescribed electronic," the words "Ministry of Agriculture (hereinafter referred to as" Ministry ")" shall be replaced by the words "Ministry" and the words "through the administrator of the relevant subsection 22)," including footnote 22, shall be deleted;
13. in Article 22 (2), the words "its transport to the plant" shall be replaced by "the construction for water treatment."
14. in Article 22 (5), the word "new" shall be deleted;
15. in Paragraph 28 (2):
"(2) If the water meter is not functional, the quantity of water collected shall be determined according to the amount of the previous sampling in a comparable period. In the case of new sampling, the quantity of water to be taken shall be determined according to subsequent sampling in a comparable period. If the conditions of the customer have changed, the quantity of water collected shall be determined by reference numbers of the annual water needs listed in Annex 12. ';
16. In the first sentence of Article 36 (1), the words "Technical audit of the water duct and sewerage shall contain the following parts: 'shall be replaced by the words" Technical audit of the water duct and / or sewage shall indicate only the parts of the material relevant to the assignment as follows:'.
17. in Paragraph 36 (2), the word "classification" is replaced by "registration."
18. Paragraph 36 (3) to (5) reads as follows:
"(3) Applications for entry in the list of technical auditors shall be submitted to the Ministry. The application shall also include consent to the publication of personal data, educational data, an inventory of its own publications in the field, the professional status and publications issued and a description of the professional activity to date, together with other information that is included as evidence in the application for inclusion in the list of technical auditors.
(4) The Ministry shall enter the applicant in the list of technical auditors if he meets the requirements laid down by law and is selected by the Commission (Section 38 (5) of the Act), on 30 June each year, following the selection of the Commission.
(5) When selecting applicants for inclusion in the list of technical auditors, the Commission shall take into account the inventory of its own publications in the field, issued by professional bodies and publications, and the description of the professional activities to date. ';
19. Paragraph 36 (6) to (9) is deleted.

These limit values of indicators in the table limit the classification in the relevant quality category. Indicative values of indicators are those to which the rendering and protective activity is to be directed in the river basin, in particular in the water source protection zone.

Serial No 33 indicator is expressed as the sum of the concentrations: benzo (b) fluorantene, benzo (k) fluorantene, benzo (ghi) perylene, indeno (1,2,3-cd) pyrene, benzo (a) pyrene, fluoranthene.

Indicator No 34 is expressed as the sum (values above the limit of detection) of all specified pesticides. Pesticides likely to occur in a given source are identified.

For indicator 31, no limit shall apply if no organoleptic defects of drinking water occur.

1) In order to register and evaluate the effectiveness of water treatment, this category is divided into two subcategories:
(a) one-stage treatment
(b) classical two-stage treatment
PART 3.
METHOD OF ASSESSMENT AND ESTABLISHMENT OF RAW SUPPORT WATER INTO CATEGORIES
(1) Raw surface water is considered to comply with the relevant indicators in the category concerned if samples of such water taken at regular intervals and at the same sampling point comply with the values of the indicators for the appropriate water quality, namely:
- 95% of samples for indicators M (limit value),
- 90% of the samples in all other cases,
- and if, in the case of 5 or 10% of non-compliant samples:
(a) the water quality does not deviate by more than 50% from the parameters given in Table 1a, except for temperature, pH, dissolved oxygen and microbiological indicators;
(b) there may be no threat to public health;
(c) water samples taken subsequently at a statistically appropriate interval shall not deviate from the relevant indicator values.
(2) The requirements referred to in paragraph 1 may be waived:
(a) in the case of floods or other natural disasters or abnormal weather conditions (in calculating the percentage referred to in paragraph 1, values higher than those for the relevant water),
(b) in cases where surface water is subject to natural enrichment by certain substances which may result in the limits set out in Table 1a of Annex No 13 for categories A1, A2 and A3 being exceeded; natural enrichment means a process in which, without human intervention in surface water, they pass from the soil of the substance contained therein;
(c) for standing surface waters or for surface waters in shallow tanks, for the characteristics listed in Table 1a of Annex No 13, marked (1); the derogation applies only to tanks with a depth of up to 20 m, with a water exchange in the tank of less than one year and with no waste water inflow, followed by sampling from different horizons,
(d) if, for a maximum of two indicators, the value determined corresponds to or exceeds the limit values of category A3 and the other indicators correspond to Category A1 or A2, the value determined shall be verified by further analyses. If the result of a technological test (according to the type of modification) proves that this water can be adjusted by a simpler process than that of category A3, then raw water is classified in the category corresponding to that of the technological test.
(3) The inclusion of groundwater in the category shall be carried out in accordance with paragraphs 1 and 2 (d).
METHOD FOR DETERMINING THE EXTERNAL ADDITIONAL INDEX FOR STANDARD METHODS OF WATER ADJUSTMENT
1. For the purpose of the water treatment plant, where due to the increased variation in raw water quality, the source cannot be included in only one category during the year, the operator may determine the average index of the adjustment of the selected indicators according to the relation:

Iu = Iu1 a100 + Iu2 b100 + Iu3 c100 + Iu4 d100,
where a, b, c is the percentage frequency of the indicator in categories A1, A2, A3 and d is the frequency of the indicator in categories above A3.
2. The index of fixability (Iu) is a number between 1 and 3 corresponding to categories A1 to A3. For values greater than those of category A3, IU is = 4. The increasing index of adaptability is proportional to the deteriorating quality of the source and therefore raw water requires more demanding treatment.
3. The adjustment index corresponds to the load index of the water treatment technology IT, which has a value of 0 (without modification) up to 3,75 (e.g. two-stage treatment with filtration through grain activated coal and oxidation).
