DECLARATION
Ministry of Labour and Social Affairs
of 3 July 1995
amending Decree No. 82 / 1993 of the Ministry of Labour and Social Affairs Coll., on reimbursement for residence in social care establishments, as amended by Decree No. 138 / 1994 Coll.
The Ministry of Labour and Social Affairs provides, pursuant to § 58 (c) of the Act of the Czech National Council No. 114 / 1988 Coll., on the jurisdiction of the Czech Socialist Republic bodies in social security, as amended by the Act of the Czech National Council No. 144 / 1991 Coll. and the Act of the Czech National Council No. 582 / 1991 Coll., and under § 177a (1) of the Act No. 100 / 1988 Coll., on social security, as amended by the Act of the Czech National Council No. 37 / 1993 Coll.:
Decree of the Ministry of Labour and Social Affairs No. 82 / 1993 Coll., on payments for residence in social care establishments, as amended by Decree No. 138 / 1994 Coll., is amended as follows:
1. Article 1 (1) (b) and (c) read:
"(b) for housing
| 1. v obytné místnosti se třemi a více obyvateli | 9 Kč | |
| 2. v obytné místnosti se dvěma obyvateli | 14 Kč | |
| 3. v obytné místnosti s jedním obyvatelem | 22 Kč, | |
(c) necessary services
| 1. při celoročním nebo týdenním pobytu v ústavu | 16 Kč | |
| 2. při denním pobytu v ústavu | 8 Kč; | |
cleaning, washing and cooking shall be deemed necessary. ';
2. In Article 2 (3), "Article 5 of the Law 'is replaced by" in the Law'.
3. Paragraph 6 (4), including footnote 5, reads as follows:
"(4) Where a youth institution is paid under a special rule (5), the child allowance shall be reduced by the amount of the payment referred to in paragraph 3.
5) § 17 et seq. of Act No. 117 / 1995 Coll., on State Social Support. '.
4. Article 15 (2) reads as follows:
"(2) The basic rate of payment for 1 m2 of floor area is maximum of CZK 7 per month; the fixed remuneration may be increased by up to 20% under local conditions. ';
5. In the second and third sentences of Paragraph 18 (3), "100 CZK 'is replaced by" 110 CZK'; in the second sentence, the amount "70 CZK 'is replaced by" 75 CZK'.
6. Article 21 (3) reads as follows:
"(3) The remuneration paid shall not be refunded for the unannounced period of stay outside the youth institution or institute. '.
7. Paragraph 21 (4) is deleted.
This Decree shall take effect on 1 August 1995, except for point 3, which shall take effect on 1 January 1996.
