of 30 October 1989
on the remuneration of workers in small organisations
The Federal Ministry of Labour and Social Affairs provides, pursuant to § 123 (1) (a) and (b) of the Labour Code No. 65 / 1965 Coll. (full version No. 52 / 1989 Coll.), in agreement with the Central Council of Trade Unions and after consultation with the Ministry of Finance, Prices and Wages of the Czech Socialist Republic and the Ministry of Finance, Prices and Wages of the Slovak Socialist Republic:
Scope
(1) Under this decree, members and staff of cooperative organisations are remunerated, 1) which are not associated with cooperative associations.
(2) Under this decree, workers and members of cooperative organisations may be remunerated
(a) in small organisations and cooperatives with a number of up to two hundred workers (members), with the agreement of the superior body;
(b) in small establishments of national committees (2) and in the budgetary facilities of national committees for municipal services, with the agreement of the relevant national committee;
(c) in enterprises, economic establishments, special-purpose establishments and basic organisations of social organisations, with the agreement of the competent central body of the social organisation.
(3) Under this decree, other organisations may reward workers who carry out working and commercial operations in the organisational units of an ancillary or service non-production character (for maintenance, repair, service, etc.) with a number of usually up to 50 employees. The range of workers who are remunerated under this decree and the effective date for such workers shall be determined by the organisation in the internal wage regulation or collective agreement.
(4) The consent referred to in paragraph 2 shall be given by the competent authority in writing and shall indicate the date of application of the decree in the organisation (s).
(5) This decree does not apply
(a) members and staff of single agricultural cooperatives and joint ventures, 3)
(b) professional and administrative staff of public administrations and certain other budgetary organisations, 4)
(c) teaching staff;
(d) health care professionals.
Wage classification of workers
The organisation referred to in Paragraph 1 (hereinafter referred to as "the organisation ') shall classify the worker and member of the cooperative (hereinafter referred to as" the worker') in accordance with the agreed type of work and the work carried out at the appropriate tariff level in accordance with Annex 2 to this Decree.
Tariffs
(1) The organisation shall determine the wage to the worker within the tariff range set out in Annex 1 to this Regulation for the tariff grade to which the worker is classified; differentiates it within the tariff range according to the complexity, responsibility and difficulty of the work carried out within the level, the worker's qualification and his long-term performance, as well as the aggravating work effects, working conditions and working arrangements not taken into account in the allowances; for personnel assigned to V or VI, shall also take account of any overtime work.
(2) If the organisation of the worker is placed at a lower tariff level, he shall be entitled to a fare according to that level from the date of application of the measure. The organisation may make a reduction in the rate wage within the tariff range if its justification is notified and delivered in writing to the worker at least one calendar month before its effect.
(3) The provisions of paragraph 2, first sentence, shall not apply to the reduction of the tariff salary made on the basis of a final disciplinary measure or a final judicial decision.
(4) If an organisation increases a worker's fare within a specified range or classifies him in a higher tariff grade, it shall be subject to a higher fare or a higher fare from the date of application of the measure.
(5) The management body shall determine the fare to be paid within the specified tariff range.
Wage forms
(1) The application of wage forms is governed by internal wage regulations issued by the organisation in accordance with the relevant regulations of the Federal Ministry of Labour and Social Affairs. 5) Workers remunerated under this decree may not be granted a personal evaluation; However, other wage forms may also take into account the professional skills, personal skills and worker initiative.
(2) The manner in which managers of organisations are personally involved is governed by special wage rules. 6)
Remuneration of school graduates
(1) School graduates preparing to carry out technical economic work corresponding to their educational attainment shall be determined by the organisation of a tariff wage for the duration of the initial practice, but for a maximum period of one year, as follows:
(a) graduates of secondary education within a range of 1,300 to 1,500 CZK per month;
(b) graduates with full secondary education within a range of 1,500 to 1,900 CZK per month; and
(c) graduates with higher education within a range of 1,900 to 2,400 CZK per month.
(2) Teachers who have completed compulsory education and have not received secondary education or have received vocational training in the field of education shall be determined during the period of first entry into service, within a range of 1 100 to 1 300 CZK per month.
(3) Within the margin, the organisation shall determine the tariff wage in accordance with the criteria set out in Article 3 (1).
Wage for overtime work
(1) For an hour of overtime, the staff member shall be paid a flat-rate payment and shall be paid a monthly salary.
1 / 185 of the monthly tariff wage at 42,5 and 42 hours per week,
1 / 180-month tariff wage at 41.25-hour working hours,
1 / 175 of a monthly tariff wage for 40 hours working hours.
(2) In addition to the tariff salary referred to in paragraph 1 and any other elements of the salary achieved, it shall be for the worker who has not been granted an extra leave for overtime, 8)
(a) at the rate of 25% of that tariff wage; or
(b) at the rate of 50% of this flat-rate wage, if there is overtime at night or on days of continuous rest in the week; or
(c) at the rate of 33% of this tariff wage, when it comes to working with alternating daily, night, Saturday and Sunday shifts, regardless of when overtime took place.
(3) Staff assigned to V or higher shall be entitled to overtime in accordance with the previous provisions, only if overtime is paid at night or on the day of work, except for a management organisation for which overtime is included at that time.
Extra charge for work at heights
The organisation shall provide workers who work in a restricted working space or in forced positions of the body resulting from a specified working procedure at altitudes above 150 m with an additional charge of 5 to 8 Kns and at altitudes above 300 m with an additional charge of 8 to 13 Kns per hour of work.
Additional charge for work under special working conditions
Workers who are working under extremely difficult and risky working conditions when insulating breathing equipment is to be used, or when working under water, at very high temperatures, shall be remunerated in accordance with a special wage regulation. 9)
Remuneration for standby
(1) Orders10) The organisation of the worker shall, or shall agree with him to be prepared to be called to the workplace outside of the working hours, provide him with a remuneration of 1, - CZK per hour on call and a day of rest of 2, - CZK. The organisation may provide that the minimum remuneration for on-call time shall be 10, - Cds and if the day of work is 25, - Cds per calendar day; This reward is in addition to the wage of the work done.
(2) The organisation shall provide a 50% remuneration to the worker per hour of the duty when the duty is ordered or agreed at the place of work and 100% of the fee or the relevant part of the fee (Paragraph 6 (1)) for the work for which the emergency is ordered or agreed.
(3) The worker shall be responsible for the work; the remuneration for the emergency during the period of work does not apply. In addition to the remuneration referred to in the preceding paragraphs, no remuneration or surcharges may be granted for on-call time.
(4) The remuneration under the previous provisions is not for workers in cases where they are not entitled to overtime (Section 6 (3)).
Extra charge for work on Saturdays and Sundays
(1) The organisation shall provide workers who work on Saturday and Sunday within the fixed weekly working hours with a surcharge of 50% of the tariff wage or the relevant part of the tariff salary (Section 6 (1)) and shall go for work above the fixed weekly working hours of 25%; when unloading and loading railway wagons, the organisation may increase the surcharge up to 50% of the tariff wage or the relevant part of the tariff wage. A supplement of 50% of the fee or the corresponding part of the fee may also be granted if the organisation provides overtime for the worker on Saturday and Sunday.
(2) No supplement shall be granted for work on Saturdays and Sundays, which are working days under a special rule.
Providing additional allowances and remuneration of hours worked fractions
(1) The organisation may, exceptionally, also pay overtime in accordance with Sections 7, 8 and 10 and, on the basis of the analysis and compliance with the relevant provisions, provide the workers with an average in advance for 6 to 12 months determined by the flat-rate amounts fixed for the monthly period or for the hour worked or shift. The amount thus determined may be cumulated by the organisation to a uniform amount fixed per month, hour or exchange, as appropriate. In determining the monthly standard amounts, the organisation shall also establish a reasonable method of reducing the amount for the period of absence at work. If the conditions under which the flat-rate amount has been fixed change substantially, the organisation shall review and adjust the amount.
(2) Within the fixed weekly working hours, fractions of hours worked shall be added and reimbursed for remuneration purposes in the accounting period. If the organisation agrees to work overtime on a daily basis for a quarter, half or three quarters of an hour, only these fractions of hours shall be added up and paid in the accounting period.
Domestic workers
For domestic workers 11) the provisions of Section 6 on overtime allowance and Sections 7 to 11 shall not apply.
Common and final provisions
(1) The authority of the superior body shall be exercised by the competent cooperative body in respect of the State and cooperative undertaking of the founder, against the cooperative associated with the cooperative association of cooperatives and against the cooperative not associated with the cooperative association of cooperatives, by the competent cooperative body.
(2) The authority of the superior authority shall be exercised by the competent national committee in respect of the establishments and establishments referred to in Article 1 (2) (b) and by the competent authority in respect of undertakings and establishments referred to in Article 1 (2) (c).
(3) For the duration of participation in training, teaching, studying at work, and checking in order to improve the qualification for the performance of the agreed type of work (§ 126 (3) and § 141a of the Labour Code), the organisation shall provide the worker with a salary as in the course of work or, if it is not possible to determine it for that period, a wage equal to the average wage without overtime wage.
(4) The measures provided for in this Decree shall be taken by the superior bodies and organisations in accordance with the rules governing the competence of trade unions in the field of pay.
(5) The organisation shall inform the workers remunerated under this Order, allowing them to consult it and notify the workers of their inclusion in the tariff level and the amount of the fixed tariff wage.
The effective date of this decree in the organisation shall cease to apply to workers who are subject to this decree, to the effectiveness of other wage regulations for the use of insulating breathing apparatus (reg. 8 / 1982 Coll.) and to the Federal Ministry of Labour and Social Affairs of 1 June 1971, No II / 3- 190 / 7208 / Sm on workers' remuneration for training period (reg. 13 / 1971 Sb., published under No 13 / 1971 Ú. v. ČSR and No 27 / 1973 Ú. v. SSR).
This Decree shall take effect on 1 January 1990, with the exception of the establishments and establishments referred to in Paragraph 1 (2) (b) for which it shall take effect on 1 January 1991.

1. If the work activity, the example of which in Annex 2 is marked at the end of "*)," is carried out in very difficult and difficult working conditions or requires extreme physical effort, the organisation may increase the fare by up to 10% above the upper limit of the tariff range of the relevant tariff level.
2. In the case of the predominance of demanding research, development, project and engineering activities or of very demanding conceptual, normative, methodological and similar activities, the organisation of a V and VI grade worker may set a fare of up to 15% above the upper limit of the tariff range of the relevant tariff grade; a staff member who has reached the rank of doctor of science may, in the performance of such work, establish a fare within the margin of duty of grade VI.
(3) The head of the organisation unit (establishment, operation, establishment) shall be designated by the organisation of the tariff pay within the tariff range by one step lower than that laid down for the head of the organisation of the same scale or, where applicable, within the tariff range of tariff level V, where the head of the organisation unit is composed of less than 25 employees.
4. The fee shall be paid by a representative of the head of the organisation, a representative of the head of the organisation unit and a head of the department and department within a lower range and, where appropriate, in degrees than specified for the head of the organisation (s).
5. The number of staff employed by the organisation according to the planned recalculated status may, for the purposes of the inclusion of the management organisation in the tariff range, include the number of external staff determined according to the formula p = OONPM.0,5, where p = number of external staff, OON = planned annual amount of other personnel costs of external staff and PM = planned annual average wage of the organisation worker; for social cultural establishments, one fifth of their voluntary staff may also be counted.
6. The organisation shall use hourly or monthly wage tariffs as necessary to monitor and report the work done and its remuneration.

Collection of characteristics of tariff levels and examples of work activities
Preliminary provisions
1. The characteristics of the tariff levels and examples of work activities are a binding basis for the inclusion of workers' working activities, technical economic and commercial operators in the tariff levels within the meaning of Article 2 of the Decree.
2. Labour, technical and commercial operations are assigned to 6 tariff levels. The tariff level expresses the general characteristics and individual examples of work activities of around the same level of qualification intensity, responsibility, workload and difficulty. The organisation shall determine the performance of the management functions in accordance with the applicable rules.
3. The organisation shall include the worker in the appropriate tariff step on the basis of a comparison of the mostly performed work with the following characteristics and examples of work activities.
4. If the inclusion in the tariff level cannot be reliably identified (new activity, substantial change in complexity, difficulty of work or working conditions, etc.), the organisation shall submit a proposal for inclusion to the competent superior body and the organisation which the superior body does not have, to the Ministry of Finance, Prices and Wages of the Czech Socialist Republic or the Slovak Socialist Republic for a decision; in the proposal for inclusion, indicate the description of the work activity, the name and the tariff number and the aggravating or exceptional work effects. Pending the decision of the competent authority, they shall determine the provisional classification of the work according to the characteristics of the tariff stages of the organisation.
5. For the performance of individual work activities and functions in the III and higher tariff stages, the characteristics of the tariff stages include binding assumptions of theoretical training (education); the specific focus of this qualification assumption - learning in the field or study direction, or the required length of experience, shall be determined by the organisation. The organisation may establish additional qualification requirements for the performance of the work and function. For the performance of certain work activities and functions, the qualification conditions (education, practice, age, official examination, training, etc.) are laid down in specific legislation. For the performance of simple work activities and functions included in 1st and 2nd grade, the organisation shall, as appropriate, establish a qualification requirement (training, 2-year learning).
6. The organisation may waive the qualification presumption of education or any other qualification requirement for a worker who has the necessary skills to carry out the work or function; However, professional training and an official or other test may not be waived in accordance with specific legislation to permit the performance of certain work activities and functions (driving authorisation, welding test, etc.).
Characteristics of tariff levels and examples of work activities
Tariff grade I - auxiliary worker
Characteristics
Simple repetitive work with less physical effort carried out according to detailed instructions of the supervisor.
Examples:
1. Light and heavy cleaning of allocated areas. *)
2. Supervision of the entrusted building, supervision of parking lots and markets.
3. Delivery of shipments and money.
4. Providing snacks, drinks and their transport (money handling).
5. Ensuring the operation of dressing rooms including cleaning.
6. Check the arrivals and exits of workers and visitors, arrivals and departure of vehicles, release keys.
7. Preparation of sports sites, small maintenance work, rental of sports equipment, cleaning of swimming pools and playgrounds.
8. Preparation and partial work in the treatment of interpreters, exhibitions and exposures.
9. Service of public toilets including cleaning and cleaning of waste. *)
10. Manual simple work in agriculture using commonly used tools. *)
11. Service of lifts for transport of persons and material.
12. Preparatory and partial work in commercial operations including the carriage of goods by hand.

Tariff grade I - Administrative technical and operational personnel
Characteristics
Simple or partial administrative technical work of administrative, operational or technical focus.
Examples:
1. Service of simple operating equipment (copying, offset).
2. Expedition of products, goods, materials from hand warehouses.
3. Delivery of various types of consignments.
4. Working on simple data transfer devices.
5. Ensuring the operation of cultural, social and physical facilities, including the introduction of visitors, the check of tickets, the provision of information and the provision of promotional material, the organisation of the work of relevant staff, the billing of sales from the programme.
6. Placing and handling of decorations and musical instruments.
7. Collection of articles from newspapers, checking bibliographic records, keeping records.
8. Labelling and sorting of documents (invoices).
Tariff level II - independent worker
Characteristics
Simple work done separately, simple work physically strenuous or simple work done under unfavourable working conditions (monotony, forced body position, repulsive environment, etc.).

1. Machine and manual machining of materials in workshop tolerance IT 10 and higher, small parts (casings, seeds) with functional requirement.
2. Grinding and polishing metal components in workshop tolerance.
3. Pressing plastic parts including machine adjustment.
Construction
4. Kopáčské's work in digging down the construction lines, pits, shafts, forges with or without arms in all rocks. *)
5. Preparation of mortars, transfer of building materials, adding work, paking, coating of construction structures and other similar preparatory and finishing work. *)
6. Tiles work of all kinds, e.g. paving and repairing paving pavement, roads, riverbed, wood blocks including pairing and making of pavement and road surfaces with cast asphalt, coated with crushing and asphalt carpets of all kinds. *)
7. The insulation of buildings carried out by various types of insulating materials, including acid materials, and their repair. *)
8. Installation and dismantling of tubular and similar metal scaffolds, motor platforms and lifts up to 10 m

Textile, apparel, leather and plastic production
10. Preparation of upholstery padding materials, sewing of upholstery covers of smooth products, stripping.
11. Minor repairs and modifications of scenic costumes and accessories including the manufacture of simple civil and period costumes and clothing components (skirts, petticoats, berths, military hats, headgear, headgear, altar rooms).
12. Repair of laundry, clothing, work aids and stockings.
13. Repair of all types of umbrellas including making necessary parts and coatings (except historical umbrellas).
14. Preparation of wicker, knitting and sewing of simple basket products.
15. Repair of footwear.
Transport
16. Driving and using motor carriages including handling of costs and additional mechanisms.
17. Driving and operating cranes with dredges, conveyors, cranes up to 10 t.
18. Transport of persons on boats complying with the Code on the Safety of Persons and Underground (Punkva) associated with the replacement of parts of the boat and the possible repair of the engine.
19. Service, repair and security of cableway, ski lift and suspension cableways including ticket sales.
20. Washing, lubricating and preserving road motor vehicles.
21. Regular maintenance, cleaning and lubrication of lifts.
22. Warranty work including loading and unloading of material or goods and others as instructed by the driver. *)
Glass and ceramics
23. Basic work in the production of ceramics - polishing of designated places by machine and by hand including glazing by dipping, coating, decorating decals, spraying, stamping and planting of products from furnaces, casting of simple products (stoppers, tiles, washers).
Agriculture and forestry
24. Manual physically strenuous work in agriculture, operator of cutting machines, simple hanging tools, handling work on agricultural machines. *)
25. Collection of seeds of forest trees and their cleaning and polishing, professional work in forest nurseries in the treatment and protection of seedlings.
26. Agricultural work using horse coat.
27. Treatment of livestock including sheep cutting and cheese production.
Trade and public catering
28. Sale of small goods (tobacco, printing, souvenirs, frozen products, beverages, tickets) in canteen, buffet, kiosk.
29. Various works in business operations, hotel and catering (shipping of goods, dishes, pastry products, inventory care and hotel linen, orders for accommodation, fuel, small services, etc.).
30. Conservative processing of raw materials, production of musts and distillates.
Other
31. Implementation of normal home works including replacement of light bulbs, fuses, locks, glass tables, minor repairs of plaster and coatings.
32. Service and maintenance of central heating boilers with a mass flow rate up to 2,22 kg / s
33. Service of exchange and reduction stations including routine maintenance.
34. Manual cleaning of roads even in winter and operation of sprinkler and cleaning mechanisms.
