State Planning Commission
of 30 June 1964
on a more detailed definition of the scope of planning, pricing and control
The State Planning Commission, in agreement with the participating central authorities, provides in accordance with Sections 8 and 10 of Government Decree No. 60 / 1959 Coll., on the scope of planning, pricing and control:
§ 1
Preliminary provisions
The institutions and organisations shall exercise their competence in the field of planning, pricing and control to the extent specified in this Order.
§ 2
State Planning Commission
(1) The State Planning Commission shall submit to the Government:
(a) proposals for political and economic directives on the overall adjustment of wholesale prices for products and those prices for works and performance (hereinafter referred to as "services") which have the character of wholesale prices (hereinafter referred to as wholesale prices);
(b) draft political and economic directives for the overall adjustment of retail prices for products and services which are of a retail price (hereinafter referred to as retail prices);
(c) draft policy-economic directives for the overall adjustment of the buying and selling prices of agricultural products;
(d) draft principles for defining the scope of planning, pricing and control and principles of the pricing methodology;
(e) reports on the implementation of the political and economic directives referred to in (a).
(2) The State Planning Commission shall manage, coordinate and control planning and pricing; establishing in particular:
(a) on a proposal from the supply central authorities in which prices of the product group (s) concerned are indicated (hereinafter "gestor"), drawn up in an agreement with the Ministry of Finance, the main customer central authorities and the central authorities of other major suppliers,
1. changes in wholesale prices made under government policy-economic guidelines;
2. changes in wholesale and sales prices between total adjustments, with the exception of changes in wholesale prices of products (services) produced (provided) and collected by organisations subordinate to a single central authority (§ 11 (3)), changes in wholesale prices necessary to unify the prices in the regions (§ 12 (2) (c) (3)), changes in incorrectly determined wholesale and sales prices (§ 20) and changes in prices of worn or partially degraded products or surplus basic resources (§ 21),
3. groups of repeatedly produced (provided) products (services), the prices of which shall be determined by supplier or commercial organisations pursuant to Article 16 (1) and (3); in so far as products for which retail prices are set, the State Planning Commission shall proceed in agreement with the Ministry of Finance;
(b) on a proposal from the supply central authorities, drawn up in agreement with the main customer authorities
1. wholesale prices of new products (services), the retail prices of which are determined by the government (Section 6 (1) (A) (1));
2. wholesale prices reserved for the establishment of the State Planning Commission,
3. wholesale prices in cases where:
- for political and economic reasons, an exception must be made to the principle of price comparability, or
- are products (services) which have a decisive influence on the level of the sector's price system, or
- it is a new, more important product (service) which wholly or mainly replaces the existing product range, or
- a new product (service) meets a whole new need.
Where, in such cases, the price fixing changes the contributions to or allocations from the State budget or the wholesale price of consumer goods, the supply central authority shall also discuss the proposed price level with the Ministry of Finance;
(c) in agreement with the Ministries of Internal Trade, Finance, Agriculture, Forestry, Water and Food Industry, the Central Administration of the Purchases of Agricultural Products and the Central Union of Consumer Cooperatives, the provisions on the scope of the price formation of fresh fruit, fresh vegetables, early potatoes and, where appropriate, other agricultural products not reserved for the Government;
(d) generally applicable provisions on the pricing methodology;
(e) on a proposal from the competent central authorities, submitted pursuant to Article 11 (4) (c), products or groups of products (services) for which uniform price lists issued by the competent central authorities will apply in the field of local economy, production or consumer cooperatives.
§ 3
State Commission on Investment Construction
(1) The State Investment Construction Commission submits to the Government proposals for political and economic directives for the overall adjustment of budgetary documents for construction *) and the budgeting of buildings and for the overall adjustment of the prices of project and survey works, geological works, geodetic and cartographic works, as well as reports on the implementation of these political and economic directives.
(2) The State Investment Construction Commission shall methodically manage, coordinate and control the implementation of essential measures in the field of budgetary documents for the construction and budgeting of buildings, as well as the pricing of the works referred to in paragraph 1; it shall in particular:
(a) on a proposal from the competent central authorities, drawn up in agreement with the State Planning Commission, the Ministry of Finance, the main customer central authorities and the central authorities of major suppliers
1. the budgetary documents for the construction (catalogues and price lists) and their changes made in accordance with the Government's political and economic guidelines or between the overall price adjustments;
2. budgetary indicators for construction;
(b) on a proposal from the supply central authorities, drawn up in an agreement with the State Planning Commission, the Ministry of Finance and the main customer central authorities, the cost of project and survey works and their changes made pursuant to the Government's political and economic guidelines or in the period between the overall price adjustments and the price list of such works;
(c) price changes made under government policy-economic guidelines or between overall price adjustments
1. for geological work in bearing geology on the proposal of supply central bodies, drawn up in agreement with the Ministry of Finance,
2. for geological work in engineering geology and hydrogeology (building geology) on a proposal from the Central Geology Office, drawn up in agreement with the Ministry of Finance and the main customer central bodies,
3. for geodetic and cartographic work on the proposal of the Central Management of Geodesy and Cartography, drawn up in agreement with the Ministry of Finance, the main customer central bodies and other suppliers;
(d) regulations on the methodology for the creation of budgetary documents for the construction and budgeting of buildings.
§ 4
Ministry of Finance
Ministry of Finance
1. submit to the Government draft principles for the determination of the prices of land and buildings in personal or private ownership and for the setting of remuneration for land use;
2. manage, coordinate and control the pricing and remuneration of the cases referred to in No 1 and issue more detailed implementing instructions in agreement with the State Planning Commission and other relevant central authorities;
3. ensure that the Czechoslovak and other financial authorities monitor the efficiency of the price system and its impact on the economic performance of the production units, both in normal analyses and in the assessment of annual comprehensive analyses;
4. Generates the experience of the State Bank of the Czechoslovak and other financial institutions and proposes to the competent authorities measures to ensure that the price system operates correctly;
5. to the extent resulting from this decree and in cooperation with the competent central authorities, the control of pricing and, through the State Bank of the Czechoslovak and other financial authorities, the control of compliance with the prices of goods and services, in particular where they are intended for investment construction.
§ 5
Central Commission for Human Control and Statistics and other People's Control Authorities
People's control bodies within the scope of the defined scope *)
1. check consistently the production and compliance with prices as well as compliance with price formation rules;
2. coordinate, manage and regulate price control by other bodies and organisations;
3. statistically monitor price developments.
§ 6
Ministry of Internal Trade
(1) Ministry of Internal Trade in its field of competence
A. submit proposals to the Government in agreement with the State Planning Commission, the Ministry of Finance and the supply central body
1. retail prices of new products (services) where:
(a) for political and economic reasons, an exception must be made to the principle of price comparability, with the exception of fashion and technical innovations and products of exceptional quality; or
(b) it is a new, more significant mass consumption product which wholly or mainly replaces existing products, except for those groups of goods whose assortment is regularly seasonally altered for fashion reasons, or if:
(c) a new product (service) satisfies a whole new need;
2. framework principles for determining reduced prices for products for resale;
3. changes in retail prices established pursuant to points A (1) and B (1) and (2);
4. seasonal changes in retail prices reserved for the government;
5. Half-yearly reports on changes in retail prices and retail prices, established at levels other than those resulting from the price system;
B. provides:
1. on a proposal from the central authorities to determine wholesale prices (Sections 11 (1) to (7) and (9)) and in agreement with and with those authorities and with the Ministry of Finance (Concerning products sold by consumer cooperatives, including in agreement with the Central Association of Consumer Cooperatives), retail prices of new products, with the exception of retail prices to be determined by the Government (Section A (1), other central government authorities (Section 11 (8), the Regional National Committees (Section 13 (1)) or the central authorities of voluntary organisations (Section 15);
2. in agreement with the Ministry of Finance and other central authorities involved, the retail price of services provided mainly by internal trade organisations;
3. A No 2) in agreement with the Ministry of Finance and the Central Association of Consumer Cooperatives of the Directive for the Reduction of Retail Prices of Products for Sale, including the definition of the scope of commercial undertakings and consumer cooperatives in the formation of these reduced prices;
4. In agreement with the supply central authority and the Central Association of Consumer Cooperatives, individual minor changes in retail prices, provided that the scope of the individual change does not exceed 3 million CZK per year and that the total balance of such price changes is settled with the amount intended for the sale of the goods; individual minor changes in retail prices of products (services) to an annual scale above that limit in agreement with the Ministry of Finance, the Central Association of Consumer Cooperatives, the supply central authority and with the approval of the State Planning Commission;
5. in agreement with the Ministry of Finance, the Central Association of Consumer Cooperatives and the competent central authority whose financial plan may affect the determination or modification of the business margin (surpluses or haircuts) and with the approval of the State Planning Commission, the level of the business margin in State and cooperative business;
6. in agreement with the State Planning Commission, the Ministry of Finance, the Central Commission of People's Control and Statistics and other participating central authorities, more detailed guidance on the creation and control of retail prices in their field of competence;
7. in agreement with the central authorities and under the conditions referred to in point B (4), seasonal changes in retail prices, except for seasonal changes in retail prices, as determined by the government (point A (4));
C. issues price lists for retail prices established by the Ministry of Internal Trade or on the Government's proposal;
D. checks in cooperation with the workers' assets and their social organisations
1. respect for retail prices and the quality and quality of individual products, irrespective of who has established retail prices (except for the prices of the products referred to in Article 11 (8));
2. the creation of retail prices for products established by the national committees pursuant to Article 13;
3. whether the requested products of all price groups for which retail prices have been fixed are sold;
E. coordinates and methodically manages the creation of retail product prices by national committees.
(2) Where products are purchased to a greater extent at retail prices by an organisation providing services to the population and where the prices of such products affect the costs and prices of the services provided, the Ministry of Internal Trade shall exercise the competence referred to in paragraph 1 (a). A No 3 and 4 and letters B No 4 also in agreement with the central authorities in charge of these organisations.
(3) The scope of the Ministry of Internal Trade referred to in paragraph 1 does not apply to cases referred to in paragraphs 8 and 12, 13 and 15 of Section 11.
§ 7
Ministry of Agriculture, Forestry and Water and Central Administration of the Purchase of Agricultural Products
(1) Ministry of Agriculture, Forestry and Water Management
1. submit to the Government, in agreement with the Central Administration of the Purchase of Agricultural Products, the proposals for the purchase prices of agricultural products and the selling prices of feed listed in the Annex to this Decree, as well as proposals for changes to those prices;
2. submit to the State Planning Commission proposals for price changes referred to in No 4;
3. in agreement with the Ministry of Finance and other participating central bodies and with the approval of the State Planning Commission
(a) the buying-in prices for agricultural products not listed in the Annex hereto;
(b) buying-in prices for seed and seed;
(c) the purchase prices of medicinal and aromatic plants;
(d) the maximum buying-in price for small agricultural products;
(e) changes in the prices referred to in points (a) to (d);
4. Establishes in an agreement with the Ministry of Finance and the central authorities involved
(a) the selling prices of products intended solely for the use of agricultural establishments, excluding the selling prices of the feedingstuffs listed in the Annex to this Decree and the selling prices which, pursuant to Article 13, are to be determined by the Regional National Committees;
(b) the prices of products (services) repeatedly produced by machinery and tractor stations;
5. Issue, in an agreement with the State Planning Commission, the Ministry of Finance and the Central Commission of People's Control and Statistics, more detailed guidelines for the production and control of agricultural products prices, goods and services of state goods and the associated production of uniform agricultural cooperatives, which, pursuant to Article 13, are responsible for establishing regional national committees; as regards the products and services associated with the production of uniform agricultural cooperatives and public goods, these guidelines shall also be published in an agreement with the Central Authority for the Development of the Local Economy.
(2) The central management of the purchase of agricultural products shall determine the wholesale prices of products purchased and sold and shall cooperate with the Ministry of Agriculture, Forestry and Water in creating the purchase and sale prices referred to in paragraph 1.
§ 8
Ministry of Construction and Heavy Engineering
(1) Ministry of Construction in the field of construction works
(a) in an agreement with the State Commission on Investment Construction, the Ministry of Finance, the Central Commission on People's Control and Statistics and other participating central authorities, it shall issue more detailed guidelines for the creation and control of budgetary prices and rates and for their use in the budgeting of buildings and shall process budgetary documents;
(b) manage and coordinate the production of budgetary rates and prices by methodology;
(c) issue committees of standards and budgetary documents;
(d) carry out control and organise its implementation in the area of the creation and use of budgetary documents and the budgeting of buildings;
(e) establish budgetary documents supplementing the budgetary system for the construction of new budget rates and the prices of works.
(2) The Ministry of Heavy Engineering shall, mutatis mutandis, carry out the functions referred to in paragraph 1 in the field of assembly work.
§ 9
Ministry of Transport and Central Communications Administration
(1) Ministry of Transport
(a) submit to the Government draft principles for the setting of rates of transport in urban public transport of persons and proposals for changes to those rates;
(b) establish, in agreement with the ministries of finance and foreign trade, the international tariffs and the prices of transport services and the changes to such tariffs and prices on the basis of relevant international arrangements.
(2) The central management of connections shall, mutatis mutandis, exercise the competence referred to in paragraph 1 (b) in the field of communications.
§ 10
Central Geology Office, Ministry of Fuel and Central Research and Mining of Radioactive Materials
(1) Central Geological Authority
(a) it shall:
1. in agreement with the Ministry of Finance, the price of new geological works in bearing geology (with exceptions referred to in paragraph 2) and of new works closely linked thereto,
2. in agreement with the main customer central authorities, the prices of new geological works in engineering geology and hydrogeology (building geology) and of new works closely linked thereto;
(b) submit to the State Investment Construction Commission, in agreement with the Ministry of Finance and the main customer central authorities, proposals for changes in the prices of geological works, drawn up in accordance with the government's policy and economic guidelines or between overall price adjustments and proposals for their price lists;
(c) manage and coordinate the pricing of geological work and work closely related to it in its field of competence, verify the effectiveness of these prices and issue their price lists.
(2) The scope referred to in paragraph 1 (a) 1, (b) and (c) shall be exercised mutatis mutandis:
(a) the Ministry of Fuel with regard to fuel exploration;
(b) Central management of the research and exploitation of radioactive raw materials as regards the exploration of radioactive raw materials.
§ 11
Other central government bodies
(1) Central authorities where products are exclusively or mainly supplied to them by subordinate organisations exclusively to non-market consumers
(a) establish the selling prices of new products in agreement with the Ministry of Finance; where the new product is also partly supplied by an organisation subordinate to another central authority, the supplier central authority shall also determine its selling price in agreement with that other central authority;
(b) submit proposals for changes in sales prices to the State Planning Commission in agreement with the central authorities referred to in point (a).
(2) Central authorities in cases where subordinate organisations repeatedly produce (provide) products (services) which are collected by organisations subordinate to another central authority
(a) it shall:
1. in agreement with the main customer central authorities and with the Gestors of the wholesale price of new, repeatedly produced products, as well as the prices of new, repeated services and geodetic and cartographic works, with the exception of wholesale prices set by the State Planning Commission and with the exception of wholesale prices pursuant to Article 16 (1) (a). In the case of wholesale prices for consumer goods, agreements with the Ministry of Finance are also needed to determine them,
2. in agreement with the customer central authorities, the wholesale price of non-standard products (services), industrial works and work in wages, as well as products (services) produced (provided) in small quantities in one single quantity or per test for a pre-known single customer, where they have reserved the fixing of such prices,
3. in agreement with the main customer central authorities, the gestors and the Ministry of Finance, the reductions and surpluses (ranges) for subordinate sales, supply and other organisations,
4. the purchase prices of those raw materials and materials derived from the collection which they exclusively or principally purchase in their field of activity;
(b) manage and coordinate price formation methodically.
(3) In cases where subordinate organisations repeatedly produce (provide) products (services) which are exclusively taken from other subordinate organisations, the central authorities shall determine the wholesale prices of such products (services) and their changes. agreements with the Ministry of Finance are needed to determine the wholesale price of consumer goods and to change the wholesale price of products (services).
(4) Central bodies in their field of competence
(a) in an agreement with the Ministry of Finance, the main customer central authorities and other suppliers, they shall submit to the State Planning Commission (State Commission for Investment Construction, in relation to the prices of construction and assembly works, geodetic and cartographic works) proposals for changes in wholesale prices, drawn up in accordance with the Government's policy and economic guidelines, as well as proposals for changes in wholesale prices between the overall price adjustments;
(b) issue:
1. in agreement with the State Planning Commission (the State Commission for Investment Construction), the Ministry of Finance, the Central Commission for People's Control and Statistics and with the main customers, more detailed guidance on price creation and control and discussion of price proposals;
2. price lists for wholesale and sales prices of products (services) and geodetic and cartographic works;
(c) submit, after consultation with the relevant regional national committees or, where appropriate, with the relevant central authorities, to the National Planning Commission, proposals for the designation of products or production groups in the field of local economy, production or consumer cooperatives for which uniform price lists will be paid, issued by the competent central authorities.
(5) Central authorities in their field of competence
(a) control:
1. compliance with pricing directives and price proposals, their supporting documents and budgetary documents for construction and use;
2. prices established by subordinate organisations;
3. compliance with prices in their subordinate organisations;
4. the price proposals of its suppliers;
(b) carry out analyses of the effects of the system of prices on the production, consumption and technical development in the national economy and propose measures to ensure the active functioning of the system of prices supporting the universal development of the national economy, as expressed in the national development plan for the national economy;
(c) maintain and continuously complement the documentation necessary for planning and pricing and use it to improve this activity;
(d) participate in the work on the draft principles for the determination of the prices of land and buildings in personal or private ownership and the principles for determining the remuneration for the use of land submitted by the Ministry of Finance to the Government pursuant to Article 4 (1);
(e) in cases where the organisations subordinate to them mainly supply some type of construction and assembly work;
1. submit draft budgetary documents for construction to the ministries of construction and heavy engineering;
2. Drawing up draft collection of standards, catalogues and price lists of budgetary documents for the construction, use and budgeting of buildings;
3. cooperate in drawing up methodological guidelines for the creation, use and budgeting of budgetary documents for construction.
(6) The central authorities responsible for the economic sector managed by the national committees shall, mutatis mutandis, exercise the scope referred to in paragraphs 1 to 5 also in respect of the prices of products (services) produced by organisations managed by the national committees (except for products and services of the local economy).
(7) In cases where the organisations subordinate to them supply (provide) products (services) to organisations managed by national committees, the supply central authorities agree on proposals for wholesale prices with the central authority responsible for the sector for which the product (service) is intended. Where necessary, the central authority shall discuss the proposal with the relevant regional national committees or shall determine which regional national committees the supply central authority is to discuss the proposal with.
(8) As regards retail prices, the other central authorities shall adequately exercise the scope referred to in Article 6 (1) where:
(a) goods or services sold (provided) exclusively or mainly on their trading network (including electricity, heat, gas, transport and communications services, etc.), with the exception of those referred to in § 13 (1) (a) (1) and § 15;
(b) the cases provided for by the State Planning Commission.
If the retail prices of products (services) sold also on the trading network of another central authority, the measures implemented under this provision must also be agreed with that other central authority.
(9) The scope referred to in paragraphs 1 to 8 shall also be adequately exercised by the ministries of heavy engineering, construction, internal trade, agriculture, forestry and water management, fuels, transport and finance, central administration of geodesy and cartography, central administration of agricultural products, central management of links, central administration of research and exploitation of radioactive raw materials and central Commission of People's Control and Statistics. The Ministry of Foreign Trade shall be considered as a supplier or, where applicable, customer central authority in the field of prices.
§ 12
Central administration for local economy development
(1) Central administration for local economy development
(a) in agreement with the competent central authorities, manage and coordinate the activities carried out by the national committees pursuant to Article 13 (1) (a), with the exception of product retail pricing;
(b) manage, coordinate and control the determination of remuneration (including secondary salaries) for the use of flats and non-residential rooms.
(2) The Central Administration for the Development of the Local Economy
(a) submit to the Government:
1. Proposals for changes to retail prices of services repeatedly provided solely or mainly by local economic organisations;
2. draft principles for determining remuneration (including secondary salaries) for the use of flats and non-residential rooms;
(b) submit to the State Planning Commission in agreement with the Ministry of Finance and after consulting other participating central bodies
1. proposals for the establishment of products or product groups of the local economy for which uniform price lists issued by the competent central authorities will apply,
2. Proposals for changes in wholesale (sales) prices drawn up in accordance with the Government's political and economic guidelines, as well as proposals for changes in those prices between the overall adjustments;
(c)
1. in agreement with the Ministry of Finance and with the other central authorities involved, the price of services repeatedly provided solely or mainly by local economic organisations and exceeding their importance the framework of one region;
2. in agreement with the Ministry of Finance and other participating central authorities and with the approval of the State Planning Commission, minor changes in retail prices of local economy services. It shall report on this activity annually to the State Planning Commission, the Ministry of Finance and the Central Commission of People's Control and Statistics,
3. in agreement with the Ministry of Finance and with the other central authorities involved, changes in wholesale prices for products and services provided solely or principally by local economic organisations where such changes are necessary to unify prices in the regions;
4. in agreement with the Ministry of Finance and with the other central authorities involved, wholesale (sales) prices of local economy products covering the circuits of all or several regional national committees,
5. in agreement with the Ministry of Finance and with the approval of the State Planning Commission, principles for the creation of wholesale prices for products produced by local economic organisations and wholesale and retail prices for services provided by such organisations,
6. in agreement with the Ministry of Finance, the prices of new products (services) supplied directly by subordinate organisations;
7. in agreement with the Central Union of Production Cooperatives and, where appropriate, with the Ministry of Internal Trade, seasonal changes or seasonal increases and reductions to retail service prices, or limits and other conditions under which seasonal changes, increases and reductions may be provided for by other local economic and production cooperative organisations;
8. In agreement with the central authorities concerned, the purchase price of raw materials and materials from the collection purchased by regional undertakings of the Collective raw materials;
(d) carry out analyses of the effects of the system of prices on production, consumption and technological development in the local economy and propose measures to ensure the active functioning of the system of prices, in particular on the development of works and services paid by the population;
(e) monitor compliance with the pricing directives by the Regional National Committees and verify the effectiveness of price arrangements;
(f) issue:
1. price lists of the goods and services referred to in point (c);
2. in agreement with the State Planning Commission, the Ministry of Finance and the Central Commission of People's Control and Statistics, more detailed guidelines for determining and controlling payments for the use of flats and non-residential rooms;
(g) in an agreement with the participating authorities, in particular the Central Association of Production Cooperatives, the State Planning Commission, the Ministry of Finance and the Central Commission of People's Control and Statistics, it issues more detailed guidance on the pricing and control of local economy products and services, production cooperatives and private producers, which, pursuant to Article 13, are responsible for setting up regional national committees.
