Government Regulation
of 28 May 1946
amending and supplementing the Government Order of 5 March 1927, No 15 Coll., on the adaptation of the pay and certain service conditions of Czechoslovak national rail employees, as amended by the Regulation, is complementary and amending.
The Government of the Czechoslovak Republic hereby orders pursuant to Section 210 of the Act of 24 June 1926, No. 103 Coll., on the modification of the pay and certain service conditions of civil servants (Law of 24 June 1926):
Officials.
1. The official categories referred to in Paragraph 2 (1) of Decree-Law No 15 / 1927 Coll. as amended by the Regulation are complementary and amendments (hereinafter referred to as the Government Regulations) are supplemented by the following categories and the following prior education is prescribed for the provisions therein:

(2) Paragraph 2 (2) of the Government Regulation is added as follows:
(d) a post of official category III in which, for the purposes of the provisions, it is principally prescribed as a preliminary education for the completion of four lower secondary school classes or a one-year course associated with a civil school (in the official category of auxiliary technical services in both cases, the successful performance of a special vocational examination) or the completion of a civil school and at least two years of vocational school;
(e) to the service class IV of the post of official categories in which provision is essentially prescribed as a preliminary education other than that of a general school.
Article 3 (2) (3) of the Government Regulation is amended as follows:
(3) According to this, the categories of officials of legal, technical and health classes Ib, the categories of officials of measuring classes Ic, the categories of officials of the higher auxiliary technical service and of officials of the operational and administrative service, the categories of officials of the auxiliary technical service and the categories of officials of the auxiliary operational and administrative services of the service class III and the categories of officials of the lower auxiliary technical service and the categories of officials of the lower operational and administrative services of the service class IV respectively.
The following text is inserted after Section 2 of the Government Regulation:
(1) The category of auxiliary technical service officials shall include staff engaged in the following services of existing railway hauliers outside the service classes and sub-officials:
(a) building masters, craftsmen, bridge masters, signaling masters, train masters and track masters;
(b) drivers, vehicle repairers, garage masters, bus drivers and freight trains for road motor transport.
(2) The category of officials of auxiliary operational and administrative services includes staff performing services of the current service category of operating officials and services of car and train inspectors.
(3) The category of officials of the lower auxiliary technical services includes staff serving workshop services, works electricians, work bridge services, work telegraph services, work printing services, work line services, crane masters in river shipping sites, roadmasters, senior signaling officers and senior motor dressing drivers.
(4) The category of officials of the lower auxiliary operational and administrative services includes staff engaged in the service of operating masters, storerooms, heating masters, station masters, train masters and upper railway guards.
(5) Train inspectors are added from the train masters, from the wagon inspectors from the train masters. In doing so, they shall be provided for in accordance with the principles applicable to determining the service of promotion.
(6) Gardeners and drivers of road transport buses and freight trains are added from sub-officials of the Ia scale who have actually spent at least six years of service in the characteristics of a sub-official. In doing so, they shall be provided for in accordance with the principles applicable to determining the service of promotion.
(7) The official service posts of the 4th working class of the workshop, of the works electricians, of the works of the bridge services, of the works telegraph services, of the works printing services, of the works line service, of the crane masters in the river crossings, of the roadmasters, of the senior signaling officers, of the chief drivers of motor dressing, of the operating masters, of the storerooms, of the heating masters, of the station, of the train masters and of the upper railway officers shall be lent to subofficials of the pay scale Ia permanent performance of the service on the ground organised for the IV service class, who have actually spent at least six years of service in the subofficer's characteristics. In doing so, they shall be provided for in accordance with the rules applicable to determining the service of promotion.
Paragraph 3 (1) of the Government Regulation is added and reads as follows:
(1) The official posts shall be systemised according to their importance and taking into account the manner of service within the set normal needs of the forces in six scales,
post Ib of the service class in the 2nd to 6th scale,
place of IC service class in the 3rd to 6th scale,
post II of the service class in the 3rd to 7th scale,
third-class posts in the 4th to 7th scale,
the fourth-to-seventh-grader grade IV.
Article 5 (5) of the Government Regulation is added and reads as follows:
(5) A waiting period of three years, service class III four years shall be fixed for waiters for official service posts of Classes Ib, Ic and II.

Officials at service post Ic shall be responsible for the initial step of the sixth scale of service in the scale specified for the sixth scale of service.
Article 22 of the Government Regulation is added as follows:
for officials at service posts of the second salary scale... six weeks.
Paragraph 71 (1) and (2) of the Government Decree is added and read as follows:
(1) Where the current provisions relating to staff members of national rail services contain provisions on certain service classes and unless otherwise provided for in this Regulation, official posts shall be responsible for:
on the 2nd scale of service class IV,
on the 3rd scale of the V service class,
in the 4th scale VI of the service class,
in the 5th scale of the VII. service class,
on the 6th scale of the VIII service class,
on the 7th scale IX. and X. service class.
(2) Within the meaning of Section 152 of the Salary Act, the posts provided for in the 2nd and 3rd scales of the President of the Republic shall be provided by the Government for the hire of posts organised in the 4th and 5th scales.
Petty officers and bailiffs.
Paragraph 41 of the Government Decree is amended and reads as follows:
Subofficial and set-up categories.
The following sub-official and establishment categories shall be established for national rail sections:

Paragraph 42 (1) of the Government Decree is amended as follows:

Paragraph 43 (4) and (5) of the Government Decree is amended as follows:
(4) A waiting period of four years shall be fixed for candidates for sub-official and establishment posts on the Ia, Ib and II. scale, in the III.
(5) In the category of workshops, bridge locksmiths, helpers, shippers, operating guards, train guides, storekeepers, line officers, telegraph officers, heating workers, track craftsmen, track drivers, diggers, wagon recorders, supply workers and railway officers, service posts are provided systemically in higher scales by promotion (§ 50) from the lowest relevant scale. The subordinate's posts shall be awarded by promotion (Paragraph 50) to the helpers of the workshop. The service posts of the station concierge and official assistants shall be filled exclusively by staff of other categories established at service posts systemised at least in the 2nd scale which have become unfit for service in their category.

Article 1 (54) (1) of the Government Regulation is amended as follows:
(1) The official title "sub-official" is associated with the service points systemised in the Ia, Ib and II scales, in the III scale the official title "founder." The designation of service posts in the various scales in § 42 applies to service titles.
2. Paragraph 56 of the Decree of the Government is amended in such a way that the provisions of (b), (c) and (d) apply to the bodies of the III scale scale, to the sub-officials of the II scale and to the sub-officials of the Ia and Ib scale.
The following Section 50a is inserted after Section 50:
Transfer to official category.
Paragraph 16 (1) shall also apply to transfers of sub-officials or administrators to the category of civil servants.
Auxiliary staff.
1. Paragraph 113 of the Government Regulation is amended and reads as follows:
(1) The service salary shall consist of a daily salary and an education allowance.
(2) Staff shall be entitled, save as otherwise provided for in this Regulation, only in respect of the days (hours) of actual service, as well as for the fixed days of work, which shall be within the period of service.
(3) The entitlement and the amount of the service salary of auxiliary staff called upon to exercise in arms shall be governed by the same rules as those applicable to the permanent sub-officials and founders.
(4) For the duration of the training in arms, the auxiliary staff shall remain in service if the service is restarted immediately after completion of the training in arms.
(5) If, for auxiliary staff, a professional obstacle justified by illness, accident or police health rules and duly demonstrated, the salary shall be paid for the duration of the service, but not more than one year. A period of one year shall be calculated according to the principles of sickness insurance for employees of the national rail sector; If the auxiliary staff member to whom the service is provided pursuant to the first sentence of this paragraph is ill no later than eight weeks after the service has been restarted, the disease shall be considered to be a continuation of the former disease if it is associated with incapacity to work.
(6) Paragraph 64 applies mutatis mutandis.
2. Paragraph 114 (1) and (2) of the Government Regulation is amended and read as follows:
(1) The daily salary of auxiliary staff shall be determined according to the service groups (§ 110) and the posts groups A, B, C, D (§ 10 (2)) in monthly amounts as follows:

(2) The increase in the daily salary shall be made ex officio every three years, including the deductible working hours spent on the daily salary. It is a condition of increase that the auxiliary staff member should be in service.
Paragraph 116 (1) of the Government Regulation is amended as follows:
(1) The periods for which the daily salary is not payable shall not be counted for the increase in the daily salary.
Paragraph 133 (2) of the Government Regulation is amended as follows:
(2) It is only possible to grant a post systemised in the sub-officials' scale Ia, Ib and II. if the auxiliary staff member has at least six years and to grant a post systemised in the III scale of the establishment, if the auxiliary staff member has at least seven years of uninterrupted counting of the auxiliary staff member's hours. The condition is that the staff member perform for at least four years the service of the category in which he is to be appointed.
Transitional provisions.
(1) Railway guards outside the service classes of building masters, class I professors, bridge masters, signaling masters, train masters, track masters and upper operating offices shall be transferred to the 3rd service class according to the service period counted in the gavel service ratio, rounded up in accordance with Article 96 of the Government Regulation, to the 7th scale, having less than 11 but at least four years, and to the 6th service scale, having at least 11 years of the service period counted in the service ratio of a non-service gavel; when transferred to the 6th scale, the service on the 7th scale shall be determined on the basis of the deductible (counted) service period of 11 years and shall be determined on the basis of the principles applicable to the determination of the service on the promotion of the service in the 6th scale, and the allowance (counted) shall be taken into account if it exceeds 11 years. If, for some of these employees, it is preferable for them to be designated in the course of the transfer in accordance with the principles applicable to the establishment of a service on promotion than those applicable to the accounting period of service in the service relationship of a railway grower outside the service classes, they shall be designated in accordance with those principles. Waivers shall receive an adjutum for service posts of the initial provisions of railway staffs outside the service classes referred to in the first sentence. In order to determine its amount, the hours of service shall be eligible in the gentile service ratio.
(2) The railway guards, outside the service classes of class II civil servants, garasmasters, operating officials, drivers, train inspectors and vehicle transporters, shall be transferred to the 3rd service class according to the service period (counted) in the gateship service ratio, rounded up in accordance with Article 96 of the Government Regulation, to the 7th scale, having less than 13 but at least four years, and to the 6th service scale, having at least 13 years of the service period (counted) in the gateship service ratio. When transferred to the 6th scale, the service on the 7th scale shall be determined according to the deductible (counted) service period of 13 years, and the service shall be determined according to the principles applicable to the provision of the service on the promotion of the service in the 6th scale, while counting the allowance (counted) service period if it exceeds 13 years. If, for some of them, it is more advantageous that they are to be designated in accordance with the principles applicable to the establishment of a promotion service than those applicable to the accounting period of service, they shall be designated in accordance with those principles. Waivers who have not completed at least four years of their waiting period shall receive an adjutum for the post of the initial provisions of railway gasists outside the service classes referred to in the first sentence. In order to determine its amount, the hours of service shall be eligible. Waivers who have completed at least four years of waiting period shall be transferred to the 7th scale and shall be provided for in it by service according to the deductible service period exceeding the waiting period, rounded up in accordance with Paragraph 96 of the Government Regulation. The drivers of rolling stock and drivers of road transport buses and freight trains shall be transferred to the 7th scale and shall receive service in accordance with the principles applicable to the establishment of the promotion service.
(3) The non-service-class railway hauliers whose service posts are to be classified in the IV service class shall be transferred to that class in such a way that, if they have less than 15 years to be counted (counted) in the service relationship, they shall be transferred to the 7th scale and, if they have at least 15 years of such period, to the 6th scale and shall be provided for by the service in accordance with the principles applicable to the promotion service; when transferred to the 6th scale, the service shall be determined first on the 7th scale and according to that service on the 6th scale. Where this is more favourable to the staff member, it shall be provided as an aid for the transfer of the appropriate level of service on the scale of the Ia sub-officials, which the staff member would have received under Article 21 by means of a transfer from the II scale of sub-officials, if it had not been established by a railway haulier outside the service classes; he shall be designated by the service in accordance with the principles applicable to determining the service on the promotion scale of the IV service class concerned. The station, cranes-handling drivers and heating guards shall be transferred to the 7th scale and shall receive service in accordance with the principles applicable to the promotion service.
(4) The non-service-grade railway hauliers who have been appointed by them from the officials of State III and who, pursuant to the preceding paragraphs, are transferred to the same scale as those in which they were on the day before the establishment of the gayist, belong to the service order which they had before their transfer to the service category of non-service-class railway hauliers. The principles for determining the seniority of other staff transferred under this paragraph shall be laid down by the Minister for Transport.
The former officials of the State of IIIa shall become officials of the 3rd service class, the former officials of the State of IIIb officials of the Fourth service class, without changing the scale, grade and seniority.
(1) From their current salary scales, after the categories provided for in Sections 41 and 42 of the Government Regulation, the following shall be reassigned:
(a) on the Ia scale, after category:
all staff from the previous scale I, unless, pursuant to Article 19, they are transferred to the III or IV service class (for staff transferred to the III or IV service class, the servants on the Ia scale shall be designated only as an aid for the transfer referred to in Article 19 (2) and (3)), as well as supervisors with the title "head of the shift ', railway guards with the title" railway guard', signaling locksmiths at the same time to the service category of signaling officers, drivers of motor dressing, drivers of road motor vehicles, prints at the same time to the category of typointers,
(b) to the Ib scale:
all employees of the current salary scale IIa, unless, under the provisions of point (a), they are transferred to the Ia salary scale, as well as to the guards of switches, forwarders, shippers in the service of machine guides with the title "shift supervisor," operating guards, storekeepers, machinery heaters, telegraph guards, line attendants and senior officers,
(c) scale II, after category:
The amount of assigned revenue in accordance with Article 21 (3) of the Financial Regulation is estimated at EUR 5000000.
(d) in salary scale III, with the title "helpers" of workshop, station, printer, heating, line and supply.
(2) The sub-officials and administrators shall be transferred to the new scales according to the chartered period of service in the current scale in accordance with the principles of Paragraph 96 of the Government Regulation, in which their current order of service is applicable for the determination of the ranking between them and the new scale.
(3) To the scale Ia shall be transferred to sub-officials of the craft categories, having on the date of the entry into force of this Regulation at least 7 years of counting (counted) of service periods on the scale IIa, operating guards and storers at least 9 years of counting (counted) of service periods on the scale IIb, machinery heaters at least 13 years of counting (counted) of service periods on the scale IIb and wagon chargers for at least 14 years of counting (counted) of service periods in the scale III. The assistants shall be transferred to the 2nd scale, if they have at least 10 years of counting (counted) in the IV scale at the beginning of the application of this Regulation. Staff transferring pursuant to this paragraph shall receive in the new salary scale a service in accordance with the principles applicable to the establishment of a service for promotion.
Final provisions.
The Minister of Transport is hereby authorised to amend and publish in the Collection of Laws and Regulations the full text of Government Decree No. 15 / 1927 Coll., as is apparent from later regulations is changing and complementary.
This Regulation shall enter into force on the first day of the calendar month following its publication and shall apply in the Czech and Moravian-Silesian countries; they shall be carried out by the Minister for Transport.
