DECLARATION

of 26 May 2023

amending Decree No 289 / 2007 Coll., on animal health and veterinary requirements for animal products not covered by the directly applicable provisions of the European Communities, as amended

The Ministry of Agriculture provides pursuant to Article 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the Amendment of Certain Related Laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll., Act No. 316 / 2004 Coll., Act No. 48 / 2006 Coll., Act No. 124 / 2008 Coll., Act No. 182 / 2008 Coll., Act No. 227 / 2009 Coll., Act No. 308 / 2011 Coll., Act No. 264 / 2014 Coll., Act No. 302 / 2017 Coll., Act No. 368 / 2019 Coll., Act No. 246 / 2016 Coll., Act No. 246 / 2016 Coll., for the implementation of § 18 (a), § 25 (b) and § 27a (b).

Čl. I

Decree No. 289 / 2007 Coll., on animal health and veterinary requirements for animal products not covered by the directly applicable rules of the European Communities, as amended by Decree No. 61 / 2009 Coll., Decree No. 11 / 2015 Coll., Decree No. 65 / 2019 Coll. and Decree No. 181 / 2020 Coll., are amended as follows:

1. in Paragraph 1, point (b) is deleted;

Points (c) to (p) shall be renumbered (b) to (o).

2. In Article 2, the words "after treatment 'are replaced by the words" after specific treatment or further processing (hereinafter referred to as "edible after treatment') '.

(3) Paragraph 3, including footnotes 2 and 3, shall be deleted.

4. In Article 6 (1), the words "animals of dangerous species 5) 'are replaced by the words" dogs, cats and animals of species requiring special care 5)';

5. in Article 14 (1) (a), the words "or via a vending machine" shall be inserted after the words "on the market."

6. In Paragraph 14 (3), the words "sold via a vending machine or 'shall be inserted after the words" eggs,'.

7. In Paragraph 14 (4), the words "or through a vending machine 'shall be inserted after the words" at the market'.

8. In Article 15 (1), the word "purchased 'is deleted.

„§ 25

Edible are

(a) the liver and kidney of equidae for slaughter older than 24 months;

(b) the kidneys of bovine animals over 60 months of age. ';

10. in Article 26 (1) (a) (1), the text "Article 3" shall be replaced by "Article 18 (3) of the Law" and the words "covered by two straight lines which cross at a right angle, their intersection being in the middle of an oval mark and the indications on the mark being well legible" shall be replaced by the words "with an additional diagonal cross consisting of two straight lines intersecting at the centre of the stamp ensuring that all the information given on the label remains legible."

11. In Article 28 (1) (a) (1), the words "Section 3" are replaced by the words "Section 18 (3) of the Law" and the words "with two straight lines intersecting at a right angle, their intersection being in the middle of an oval mark and the indications on the mark being well legible" are replaced by the words "with an additional diagonal cross consisting of two straight lines intersecting at the centre of the stamp ensuring that all the indications given on the sign remain legible."

12. Annexes 1 and 2 are deleted.

Čl. II

Technical Regulation

This Decree was notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical and information society services.

Čl. III

Efficacy

This Decree shall take effect on 1 July 2023.
