DECLARATION
Slovak Labour Safety Authority
of 16 November 1979
on the selection of prototypes of machinery and equipment for assessment with regard to safety requirements for work and technical equipment
The Slovak Labour Safety Authority provides, pursuant to § 5 (1) (d) of Act No. 174 / 1968 Coll., on State Professional Safety Supervision, in agreement with the competent central authorities:
(1) The Decree applies to organisations which produce prototypes of machinery and equipment (hereinafter referred to as "the manufacturer").
(2) For the purposes of this Decree, the first items are considered to be prototypes of machinery and equipment
(a) pressure equipment reserved (1) including watermarks and boiler safety valves;
(b) reserved lifting equipment, 2)
(c) working machinery which process various substances, raw materials or semi-finished products by machining, editing, reforming, connecting, mixing, sorting, drying or subjecting them to other processes;
which have not yet been produced or have already been produced but are intended to have structural changes affecting labour safety ("prototypes').
(3) The decree does not apply to prototypes which:
(a) are subject to the supervision of the authorities referred to in § 3 (2) of Act No. 174 / 1968 Coll.,
(b) are subject to approval by the national testing authorities, 3)
(c) are made individually according to the customer's requirements;
(d) are intended for experimental purposes.
(1) The manufacturer is obliged to notify in writing to the Labour Safety Inspectorate responsible for the place of production (hereinafter referred to as "the Inspectorate") that he intends to start the production of the prototype, indicating its concise technical characteristics and the date of commencement of production.
(2) At the request of the inspector, the manufacturer shall:
(a) submit the prototype documentation to the extent specified by the inspector;
(b) demonstrate the prototype in service within the time limit specified by the inspector.
The inspector shall notify the manufacturer of the outcome of his assessment no later than 30 days after the fulfilment of the obligations referred to in Article 2; if he is unable to comply with this period, he shall inform the manufacturer and set a deadline.
This Decree shall take effect on 1 January 1980.
