on the physical protection and classification of nuclear materials and nuclear installations
According to Article 47 (7), for the implementation of Articles 4 (8) and (9), 13 (3) (d) and 6, 18 (1) (c) and 20 (1) (d) of Act No. 18 / 1997 Coll., on the Peaceful Use of Nuclear Energy and Ionising Radiation (Atomic Act), and on the amendment and addition of certain laws, hereinafter referred to as "the Act '.
INTRODUCTORY PROVISIONS
Subject matter
(1) This Decree provides details of the manner and extent of the provision of physical protection of nuclear materials [Paragraph 2 (j) (1) of the Act] and of nuclear installations [§ 2 (h) of the Act], the transport of nuclear materials [§ 20 (1) (d) of the Act], the inclusion of nuclear materials (§ 4 (10) of the Act) and the inclusion of nuclear installations or parts thereof (§ 4 (9) of the Act), the scope and manner of carrying out the approved documentation [§ 13 (3) (d) of the Act].
(2) Physical protection to the extent provided for in Part Two and Part Three of this Order is ensured for:
(a) nuclear materials;
(b) nuclear plants with nuclear reactors [Paragraph 2 (h) (1) of the Act] from three months before the start of the nuclear fuel transfer to the nuclear reactor;
(c) other nuclear installations [§ 2 (h) (2), (3) and (4) of the Act] from two months before the supply of nuclear materials or radioactive waste.
For the purposes of this decree:
(a) a protected area of a nuclear facility whose perimeter is bounded by mechanical means;
(b) the protected space of the nuclear facility within the protected area, the perimeter of which is bounded by mechanical means;
(c) the inner space of the premises of buildings or rooms situated within the protected space, the walls of which constitute mechanical means of defence;
(d) an informed person by an employee of the authorisation holder or a person cooperating with the authorisation holder who has knowledge of the organisational and technological procedures for the operation of the nuclear installation, the handling of nuclear materials, the transport of nuclear materials and the right to enter the nuclear installation separately;
(e) the project's fundamental threat to the characteristics and capabilities of a person who is inside or outside the physical protection object, who may intentionally dispose of the object illegally, in particular by alienation or sabotage, and against whom the physical protection system is designed and evaluated; the following characteristics and capabilities shall in particular mean:
1. determination, experience and ability to operate in two or more groups of at least two members trained in military training;
2. the ability to cooperate within an installation with a well-known person who is able to provide information or to allow inputs or outputs to or from a nuclear installation, harm individual components of the security equipment, technical system of physical protection or communication system or directly participate in a violent attack;
3. equipment
(aa) hand-held automatic weapons;
(bb) portable industrial equipment and explosives to release passages (input, entry, exit or exit) or to destroy parts of nuclear equipment, means of transport and integrity of packaging for the transport, storage or storage of nuclear materials and radioactive substances or individual components of the physical protection system; or
(cc) a vehicle usable for the transport of persons and their equipment close to spaces with categorised parts of a nuclear installation or as a carrier of an explosive device;
4. the possibility of support by a well-known person in a variety of working positions which have a detailed knowledge of, or access to, nuclear installations or instruments which may permit the theft of special fissile materials;
(f) a technical system of physical protection, an integrated automated system intended to control and monitor the entry of persons and the entry of means of transport into individual spaces, to monitor the evaluation, monitoring and signalling of disturbances in such spaces and to transmit audiovisual information on the disruption to the control centre, using computer, signalling, 1) communication and audiovisual equipment;
(g) by the physical surveillance of nuclear installations and nuclear materials in a guarded, protected or internal space, provided by persons who comply with the requirements of a specific regulation, (2) (hereinafter referred to as "security personnel"),
(h) mechanical means of defence for fences, walls, barricades, bars and other devices which delay natural persons from entering or preventing unauthorised means of transport from entering the protected, protected or internal premises of a nuclear installation;
(i) emergency protection of the concentration of forces and resources of the Police of the Czech Republic (hereinafter referred to as "the police") in order to carry out a professional operation to avert an attack against a nuclear installation;
(j) nuclear power reactor nuclear reactor [§ 2 (h) (1) of the Act] having a thermal output of more than 50 MW;
(k) by a research reactor nuclear reactor [§ 2 (h) (1) of the Act] with a heat output up to and including 50 MW.
EQUIPMENT OF NUCLEAR MATERIALS AND NUCLEAR EQUIPMENT OR PARTS THEREOF TO CATEGORIES, METHOD AND SCOPE OF THE INSURANCE OF FYSICAL PROTECTION OF NUCLEAR MATERIALS AND NUCLEAR EQUIPMENT OR PARTS THEREOF
Classification of nuclear materials
Nuclear materials shall be classified in category I., II. or III.
Classification of nuclear installations or parts thereof into categories
(1) Nuclear installations or parts of nuclear installations with:
(a) nuclear power reactors are classified in:
Category I, if damage can result in a breach of nuclear safety. These are, in particular, nuclear equipment systems that affect nuclear safety [Paragraph 2 (d) of the Act], as well as parts of nuclear installations that contain radioactive substances and systems that are necessary to prevent their illegal release into the environment,
Category II, where damage to radioactive substances cannot lead to unauthorised release into the environment, but may lead to a breach of nuclear safety in the current failure or damage to two or more of these parts of the nuclear installation,
3. Category III, if the damage to radioactive substances cannot lead to an illegal release into the environment but may increase the risk of a threat to nuclear safety in the event of a failure or damage to another part of a nuclear installation in Category II,
(b) research reactors containing the nuclear reactor and the technological systems necessary to ensure nuclear safety are classified in Category II.
(2) Parts of nuclear installations [Paragraph 2 (h) (2) of the Act] which contain nuclear materials are classified in categories according to the classification of nuclear materials.
(3) Parts of nuclear installations [§ 2 (h) (3) and (4) of the Act] containing radioactive waste are classified in Category III.
General requirements for classifying nuclear materials and parts of nuclear installations into categories
(1) The physical protection measures of nuclear installations shall be implemented according to the highest category of nuclear materials handled on nuclear installations and the highest category of part of such nuclear installations.
(2) The category with the highest requirements for the level of physical protection is Category I.
(3) Nuclear materials in quantities lower than the weight limit for Category III as set out in the Annex to this Decree and non-classified nuclear materials (natural uranium, depleted uranium and thorium) are secured against misuse and unauthorised activities by placing them in a metal housing with a safety seal or in locked spaces with controlled access.
(4) If parts of a nuclear installation classified in different categories cannot be physically separated from each other, those parts as a whole shall be placed in the space referred to in Article 6 (1) of this Decree according to the highest category applicable to any of these parts.
Details to define the guarded, protected and internal space
(1) Nuclear materials and parts of nuclear installations classified in:
(a) Category I shall be located within the internal space;
(b) Category II shall be located within the protected space;
(c) Category III shall be located within the protected area.
(2) For nuclear materials and parts of nuclear installations classified in Category I, spaces are defined by:
(a) the outer boundary of the protected area is an isolation zone of a minimum width of 6 m, bounded by two fences of a minimum height of 2,5 m and by other mechanical means on the crown of the fence or the isolation zone; there are mechanical barriers at the external border to prevent unauthorised passage of the vehicle; the external boundary is equipped with at least two detection systems operating on different physical principles, at least one of which has the character of volume detection; the isolation zone is equipped with television technology and lighting enabling the use of television technology; the free terrain is at least 6 m wide from both sides of this isolation zone; where a building is part of this boundary, the external side shall be provided with signalling and television technology at the barrier level;
(b) the inner boundary of the protected area, which is the outer boundary of the protected area, is a further fence of a minimum of 2,5 m equipped with a system that detects disturbances up to 3 m and television technology;
(c) the internal boundary of the protected space, which is the boundary of the internal space, shall be the walls of buildings or rooms situated within the protected space for which the detection of the intrusion by means of safety equipment shall be ensured; the number of internal entrances and entrances is minimised.
(3) In the case of nuclear materials and parts of nuclear installations classified in Category II, spaces are defined so that the outer boundary of the secured space is a minimum fence of 2,5 m with a mechanical barrier on the crown of the fence. The inner boundary of the protected area is the boundary of the protected area and is composed of another fence at least 2,5 m high with other mechanical means of defence and is equipped with signalling and television technology. If the walls of a building with nuclear material or a part of a nuclear installation classified in Category II are sufficiently solid and the results of the assessment provided for in Section 18 (1) (h) of this Decree demonstrate adequate physical protection, the wall may be the limit of the protected space and, in this case, the detection of its disruption by signalling and television technology.
(4) In the case of nuclear materials and parts of nuclear installations classified in Category III, the space is defined so that the perimeter border is a fence of at least 2,5 m with other mechanical means of defence on the fence crown. A nuclear material or part of a nuclear installation classified in Category III shall be used to detect intrusion of the building or to protect the rooms in which the materials and equipment are located by means of security technology.
(5) In exceptional and justified cases, individual premises may be combined or modified with the border requirements referred to in paragraphs 2, 3 and 4, but the effectiveness of mechanical means of defence and safety techniques must be adequately enhanced and the results of the efficiency assessment referred to in Article 18 (1) (h) of this Decree demonstrate physical protection.
(6) Emergency exits and underground ducts located below the border of the guarded and protected area are secured against unauthorised intrusion from the outside and are equipped with safety equipment.
Entry of persons and entry of means of transport
(1) They may enter the guarded, protected or internal space separately
(a) staff and other persons for whom the integrity and fulfilment of the requirements of the Special Act has been verified if required [Paragraph 18 (1) (l) and (m) of the Law];
(b) inspectors of the Office;
(c) members of the police which ensure the emergency protection of the nuclear installation.
(2) The entry into the protected and internal space of private motor vehicles is prohibited. The entrance of private motor vehicles is permitted only in strictly necessary cases.
(3) Authorisation holder (Section 9 (1) of the Act)
(a) authorise the entry of authorised control authorities under special regulations, (3) by which the exercise of State control results from the Law on their jurisdiction, provided that they are accompanied throughout their stay by a permit holder designated by the employee or security officer;
(b) may allow other persons to enter the guarded, protected and, in exceptional cases, inside the premises, provided that they are accompanied throughout their stay by a permit holder designated by the staff member or security officer.
(4) In the event of an emergency in accordance with a special regulation where intervention by external interveners and constituents is required in accordance with the internal emergency plan, the authorisation holder shall allow such persons and components to enter the guarded, protected or internal space. In such cases, a list shall be drawn up no later than three days after the end of the intervention with personal data of the intervener and a list of the means of transport used in the intervention.
Administrative and technical measures for Category I
(1) Nuclear materials and nuclear equipment or parts thereof classified in Category I are provided by a physical protection technical system, the control system of which contains the main and backup control centre from which the physical protection system can be controlled. The whole system has a backup power supply and the main and backup control centre is provided by the security technology.
(2) Anyone entitled to enter a guarded, protected and internal space shall be provided with an identification card enabling automatic inspection and registration of the entry. Biometric identification (e.g. hand geometry, fingerprint) shall be used to control the entry of persons at least when entering the secure area of the nuclear-energy reactor installation. The number of persons entering these premises shall be limited to the number of persons required. The current input database is available for one month and it is archived for one year.
(3) The technical physical protection system shall allow archiving of facts relevant to the provision of physical protection, such as the issue of identification cards for entry and entry, data on the passage of persons and the passage of vehicles from their automatic control devices and data on the alarm signalling of safety equipment. Voice communication of the shift of the control centre of the physical protection technical system after communication links shall be recorded; the record must be available for 7 days.
(4) The ratio of the number of visitors to the number of accompanying staff may be up to 3: 1 and the ratio of the number of visitors to the guarded and protected area to the number of accompanying staff may be up to 8: 1.
(5) All persons, baggage and means of transport on entry into the restricted area are subject to control to prevent the introduction of items threatening nuclear safety, in particular weapons, explosives, alcoholic beverages, drugs and at exit to prevent the release of nuclear materials.
(6) In the case of entry into internal areas relevant to nuclear safety, the presence of at least two persons, staff of the authorisation holder, shall be ensured at the same time.
(7) Administrative measures shall be adopted to ensure the permanent archiving of the records referred to in Article 18 (1) (l) and (m) of the law applicable to the unaccompanied entry permit and to record the release of keys from selected rooms in the protected and internal space and to archive such records for a period of one year.
(8) Persons authorised separately to enter a guarded, protected or internal space in accordance with Paragraph 7 (1) shall, prior to the first authorisation of a separate entry into a categorised object and at least once a year, be shown to have been trained in compliance with the rules on physical protection.
(9) The movement of nuclear materials within the guarded and protected space, between these spaces and the inner space, ensures their physical surveillance.
(10) For Category I nuclear material warehouses, nuclear materials are required to be located in a room with reinforced concrete walls and a single entrance equipped with a door against unauthorised intrusion from the outside, which are secured by a safety technology. This room is located in an object with the detection of intrusion and is located in the inner space with the provision of signalling and television equipment, special locks and access only to designated employees. The entry of other persons may be authorised only with the exception of the holder of the authorisation of designated staff and security personnel.
(11) Physical security is ensured continuously.
(12) In the guarded and protected area, the patrol activities are carried out by security personnel.
(13) Telephone and radio communication is provided between the security posts, the control centre, the backup control centre and between the control centre and the police emergency base.
(14) Documentation must be prepared to deal with situations associated with physical protection breaches.
Administrative and technical measures for Category II
(1) Nuclear equipment or parts thereof and nuclear materials classified in Category II are provided by a safety technology. The alarm signal shall be placed on a counter of centralised protection or a permanent police oversight service and the archiving of alarm alarm data shall be ensured.
(2) Physical surveillance is ensured continuously.
(3) All persons entering the protected area shall be provided with an identification card enabling the automatic control of the entry into that area and an automatic access control device to ensure the archiving of records of the issue of identification cards and the passage of automatic control devices.
(4) Persons authorised to enter the protected or protected area separately in accordance with Paragraph 7 (1) shall, before the first authorisation of a separate entry into the categorised object and at least once a year, be shown to have been trained to comply with the physical protection rules.
(5) The ratio of the number of visitors to the number of accompanying staff may be up to 8: 1, for persons preparing to pursue the profession not exceeding 10: 1.
(6) Random checks of persons and baggage are carried out at the entrance to the secured area. All baggage carried and persons entering the protected area shall be subject to control to prevent the introduction of items threatening nuclear safety, in particular weapons, explosives, alcoholic beverages and drugs.
(7) Means of transport and all consignments bound for the restricted area are checked to prevent entry of persons without authorisation and import of nuclear-safety-sensitive items.
(8) Administrative measures shall be adopted in order to ensure the permanent archiving of all entries of entry permits, to ensure the keeping of the key output records in nuclear material spaces and to archive its data for a period of one year.
(9) Documentation must be prepared to deal with situations associated with physical protection breaches.
Administrative and technical requirements for Category III
(1) Nuclear materials and nuclear equipment or parts thereof classified in Category III shall be located in a protected area to which entry and entry control is ensured.
(2) Objects with nuclear material classified in Category III or radioactive waste [§ 2 (h) (3) and (4) of the Act] are provided with safety technology, the signage is brought to the counter of centralised protection or a permanent police surveillance service and archiving of alarm alarm data is ensured.
(3) Documentation must be prepared to deal with situations related to the distortion of physical protection.
(4) Persons authorised to enter the restricted area separately pursuant to Paragraph 7 (1) shall, prior to the first authorisation of a separate entry into the categorised object and at least once a year, be shown to have been trained to comply with the physical protection rules.
Security personnel
Security personnel providing physical surveillance at Category I nuclear safety posts shall be armed with a short ball weapon of up to and including 9 mm and comply with the requirements of the Special Regulation.4), 5)
Protection of the technical system of physical protection and its data
(1) The technical physical protection system must not be linked by communication lines to other computer systems which are not exclusively intended to ensure physical protection and activities directly related to it, and no part shall be located outside the external border of the secured area except for selected detection, communication and camera systems and identification cards.
(2) The technical physical protection system may be linked to a computerised system for managing its administration and maintenance.
(3) The conditions for the technical physical protection system shall be fully applicable to the operation of the management and maintenance computer system.
(4) The data from the system are exclusively for the purpose of ensuring physical protection and are available only to selected persons designated by the authorisation holder and to the inspectors of the Office.
Administrative and technical measures to ensure physical protection in the construction of nuclear installations
(1) The site of the nuclear installation is fenced and is secured by surveillance, control of entry and entry of means of transport.
(2) Objects in which parts of nuclear installations classified in Category I and Category II will be located have been protected at the level of requirements for Category III since the start of installation of technological equipment.
(3) The scope of physical protection corresponds to the construction process, separating the parts of the nuclear installation operated from those under construction.
METHOD AND SCOPE OF INSURANCE OF PHYSICAL PROTECTION OF NUCLEAR MATERIALS IN TRANSPORT
General provisions
(1) Physical protection of shipments of nuclear materials shall be ensured at a level appropriate to the classification of nuclear materials in the categories referred to in Article 3 of this Regulation, with nuclear materials classified in Category I and Category II when transported outside the secure area requiring special protection of police officers ("police escort") .6) Transport of Category III nuclear materials requires at least dispatcher traffic monitoring, which is ensured by two-way radio connection or telephone connection between the means of transport and the consignor, the consignee, the Office and the police, and a written agreement between the consignor and the consignee that the shipment will be taken over by protocol upon delivery. In the case of shipments of nuclear material in the form of fresh nuclear fuel for nuclear reactors classified in Category III or natural uranium weighing more than 1000 kg, dispatcher monitoring and police escort or other police measures shall be ensured.
(2) In the case of transport, compliance with other requirements under the special Regulation shall be ensured. 7)
(3) Where the holder of a permit to transport finds that a nuclear material shipment has been lost or tampered with or threatened to carry out such activities, he shall immediately implement measures to ensure nuclear safety and radiation protection. The authorisation holder shall immediately inform the Office [Paragraph 17 (1) (j) of the Act] and the local police authorities thereof.
(4) During transport is
(a) the need to ensure the transport of nuclear materials within the shortest possible time while ensuring nuclear safety;
(b) the need to ensure the translation of nuclear materials, i.e. the translation between means of transport, the transfer to temporary warehouses and the temporary storage prior to the arrival of the vehicle at the shortest possible time while ensuring nuclear safety;
(c) ensure physical protection during temporary storage in a manner appropriate to the category of nuclear material transported;
(d) in the case of persons, prior verification of integrity and compliance with the requirements of the special regulation, 8)
(e) ensure that access to transport information is restricted to an essential number of persons.
(5) The protection of transport-related data, including detailed information on the transport route, the timetable and the arrangements for the coding of messages transmitted by means of means of communication, shall be carried out in accordance with a specific regulation. 8)
Method and scope of ensuring physical protection of shipments of nuclear materials classified in Category I and Category II
(1) The consignor submits to the consignee a pre-notification of the planned shipment specifying the type of transport (road, rail, sea, air, river and combined), the expected time of receipt of the consignment and the exact place of delivery in the Czech Republic.
(2) The consignee shall confirm his readiness to accept the consignment at the proposed location and time.
(3) The selection of the type of transport and the transport route shall be carried out in such a way as to minimise the number of transhipments of the consignment and the duration of the shipment during the transhipment and the security situation along the transport route is stable.
(4) Consignments containing nuclear materials are transported in closed and locked means of transport or in transport packages. If the consignment exceeds 2000 kg, it may be transported on an open means of transport with a tarp on the arches or covered with a tarp. When using sails, the consignment is secured with a refraction sealed seal.
(5) A pyrotechnic inspection shall be carried out before the vehicle is loaded.
(6) Transporter (7) shall transmit to the carrier written instructions specifying the way in which physical protection is ensured, the prescribed route of transport, the places of stops and transhipments, the details of the persons authorised to take over the consignment, the instructions for reporting the progress of the shipment, the specification of interaction with the police escort, including the links and the emergency rules, in accordance with the provisions of the specific Regulation.
(7) Upon receipt of the consignment, the consignee shall check the integrity of the consignment, locks, seals and immediately take over the consignment by protocol. It shall immediately inform the consignor of its takeover.
(8) A two-way radio connection or a frequent telephone connection between the means of transport and the consignor, the consignee or the consignor, the consignee, the police and the Office shall be provided for domestic transport.
(9) In the case of international transport, the transfer of responsibility for ensuring physical protection from the consignor to the consignee shall be determined.
(10) In the case of the transport of nuclear materials to the Czech Republic or in the case of their transit, a pyrotechnic inspection is required for vehicles before taking responsibility of the Czech Republic.
Requirements for the physical protection of shipments of nuclear materials classified in Category I and Category II by type of transport
(1) For road transport
(a) only the vehicle may be used
1. specially designed to withstand attack and prevent the disposal of nuclear materials;
2. equipped with a system to block its movement,
3. used exclusively for the transport of nuclear materials;
4. accompanied by a police escort,
(b)
1. continuous supervision of the police escort of the consignment and inspection of locks and seals at each stop;
2. that if the transport cannot take place in one day, the vehicle will be immobilized or parked in a locked and guarded building during the night break,
3. two-way radio communication and the agreed signals between the vehicle and the vehicle of the police escort,
4. the recovery and securing of transport and replacement routes during transport.
(2) In the case of rail transport:
(a) transport by separate train or as part of a freight train;
(b) a carriage wagon under the supervision of a police escort, whereby the holder of the authorisation ensures that the necessary number of separate passenger wagons for a police escort is allocated.
(3) During air transport, the transport takes place on a special flight. Physical protection shall be ensured until take-off and after landing.
Method and scope of ensuring physical protection of nuclear materials classified in Category III in transport
(1) For the transport of Category III nuclear materials, a prior notification shall be provided to the consignee of the planned shipment with a specification of the type of transport, time and place of arrival.
(2) The consignee shall confirm to the consignor the readiness to accept the consignment.
(3) If possible, lock and seal shall be used for the means of transport or transport packaging.
(4) It shall immediately notify the consignor of the consignee of the receipt of the consignment after taking over the protocol.
SCOPE AND METHOD OF IMPLEMENTATION OF THE AUTHORITIES APPROVED DOCUMENTATION
(1) The proposal for a method of ensuring physical protection (Annex B. II to the Act) contains in particular:
(a) an analysis of the potential for unauthorised activities in nuclear material and nuclear equipment and an assessment of their consequences, taking into account the project's basic threat to nuclear materials and nuclear installations;
(b) an analysis which results in a proposal for the inclusion of a nuclear installation or part thereof in Category I, II or III in accordance with Section 4 of this Order;
(c) a proposal for the inclusion of nuclear materials in each category pursuant to Article 3 of this Decree;
(d) a detailed functional analysis of the proposed technical system of physical protection or safety equipment;
(e) an assessment of the detection elements and control points of the electrical signalling equipment authorised by the test laboratory;
(f) authorisation for the design, installation and installation of safety devices pursuant to a special regulation, 2)
(g) the method of quality assurance in ensuring physical protection during the period of operation of the nuclear installation in accordance with a specific regulation;
(h) assessing the effectiveness of the design of physical protection by using mathematical models;
(i) a proposal for interim administrative measures pursuant to Article 18 (2) (d) of this Order for Physical Protection;
(j) analysis of the physical protection function in connection with the construction, launch and operation of nuclear installations and any emergency situations;
(k) a description of the physical protection measures during the construction of the nuclear installation.
(2) The documentation on how to ensure physical protection [Annex C. (a) (5) to the Act] contains in particular:
(a) taking into account the project's basic threat to nuclear materials and nuclear installations;
(b) the classification of nuclear materials and nuclear installations in each category;
(c) a description of the actual implementation of the technical system of physical protection or of the safety equipment and of the evidence that changes to the original design solution under Paragraph 18 (1) (d) of this Decree will not reduce the level of physical protection,
(d) evaluation of test results of the 144hour complex testing of the functionality of the technical system of physical protection or of the safety techniques, the results of the tests of television technology, the effectiveness of physical protection and testing of the elements of the technical system or of the safety techniques used for physical protection;
