on the tasks of municipalities and district authorities in securing elections to the Czech National Council
The Ministry of Interior of the Czech Republic pursuant to § 55 paragraph 1 of Act No. 54 / 1990 Coll., on Elections to the Czech National Council, as amended by Act No. 94 / 1990 Coll. ("the Act") provides:
Creating and announcing electoral districts
(1) Electoral districts are created by the municipal council to ensure conditions for a smooth and rapid voting process.
(2) Election districts shall be created in such a way as to preserve, as far as possible, natural territorial and building units and to include, as a rule, 1000 voters. The municipal council will determine the lowest number of voters in the constituency according to local conditions. Election districts with more than 1000 voters may be created only exceptionally, taking into account the nature of the municipality's construction or parts thereof; the size of the constituency shall then be taken into account in determining the number of separate voting lists spaces and the lowest number of members of the District Electoral Commission.
(3) Each electoral district in the municipality is marked with a serial number. Numbering shall be performed in one numerical series by Arabic numerals starting with number one. In the capital of Prague and in the cities of Brno, Ostrava, Plzeň and Ústí nad Labem, the electoral districts are numbered in separate numerical lines for each district or for each part of the city.
(4) The municipal council shall publish a list of designated constituencies with their territorial definition in the usual manner within 30 days of the election.
Creating and publishing electoral lists
(1) To draw up the electoral list, the municipal council will use the election lists in 1990 as a basis. It shall update these documents on the basis of the population records, the local inquiry and the results of the opposition proceedings.
(2) The municipal office shall close the completed and specified voting lights no later than 18 hours before the vote begins. The Mayor of the municipality, or the person authorised by him, shall sign the electoral lists and indicate the total number of voters enrolled, the hour and the date of the closing of the electoral list.
(3) The municipal authority shall forward the electoral lists to the Presidents or their authorised members of the district electoral commission no later than 2 hours before the vote begins.
(4) If, on the day of the election, a voter who has not been included in the electoral list and who has demonstrated his right to vote in the district by a civil (military, personal) card, the District Electoral Commission will add him to the electoral list. The additional entry will mark the voter's (military, personal) card.
Issue of electoral passes
(1) The municipal office shall issue an election card to those voters who are listed on their oral or written request.
(2) An entry on the electoral list shall be made on the issue of the voter card and the voter shall be deleted from that list.
(3) The municipal office shall keep a register of the issued voter cards and the electoral district on whose list the voter has been entered.
(4) The serial numbers issued by the electorate shall be recorded in the register in one numerical series by Arabic numerals starting with number one.
Ensuring and equipping electoral rooms
(1) The municipal office will provide an election room and equipment for each electoral district.
(2) The flag of the Czech and Slovak Federal Republic and the flag of the Czech Republic will hang on the building where the election room is located. The sign "Election Room" shall be placed on the building and the entrance to that room shall be marked for which electoral district it shall be designated.
(3) The flag of the Czech and Slovak Federal Republic, the flag of the Czech Republic on the right, will be placed in the voting room from a leading point of view on the left. Among them there is a state emblem of the Czech and Slovak Federal Republic and a large state emblem of the Czech Republic on the right.
(4) There must be an election room
(a) separate voting lists, the number of which has been determined by the mayor of the municipality; there are tables, shelves and office supplies for editing ballots in these premises,
(b) a mailbox and a portable mailbox; a portable ballot box shall be used for voters who, for serious reasons, cannot come to the ballot box,
(c) electoral lists and necessary forms for the minutes of the District Electoral Commission on the progress and outcome of the vote;
(d) ballots and envelopes in sufficient quantities, bearing the stamp of the municipal office;
(e) tables and office supplies for the work of the District Electoral Commission;
(f) in a visible place, models of ballots delivered to voters and information on candidates on ballots and their candidacy surrendered or withdrawn from the mandate.
Storage of ballots and other electoral documents
(1) The municipal council may shred ballots after the election results have been announced by the Central Election Commission and the Czech Election Commission. However, it will leave three sets of unused ballots for later archiving for the Czech National Council.
(2) The list of voters in the municipality is kept with the municipal authority. Other electoral documents shall be handled by the Municipal Office in accordance with the Special Regulation (1).
(3) The District Office will take over the electoral documents from the Regional Electoral Commission and the Regional Office in the seat of the Election Region will also take over the electoral documents from the Regional Electoral Commission. This documentation shall be handled in accordance with the special Regulation (1).
Election forms and models
The election shall be accompanied by models of the ballot, the electoral list, the electoral licence and the Member's election certificate. The models of these forms are set out in the Annex to this Order; they are binding on the content.
Cooperation of public authorities in the control of data trueness
(1) The authorities which maintain the register of citizens' residence, the municipal authorities, the district authorities and the Ministry of Interior of the Czech Republic shall provide the Central Election Commission, the Czech Election Commission and the Regional Election Commission (hereinafter referred to as the Election Commission), at their request, with the data necessary from their registers to verify the accuracy of the data on the candidate list or the petition data requiring the political party (2) to run.
(2) The Ministry of Interior of the Czech Republic will provide the electoral committees with up-to-date summaries of all political parties) registered in the Czech Republic.
(3) The competent statistical authorities (3) ensure an alphabetical overview of individual candidates for the election committees as a basis for the Central Electoral Commission and the Czech Electoral Commission for the determination of a possible candidacy of the same person in several electoral countries.2)
This decree shall take effect on the day of its publication.
