DECLARATION
Federal Ministry of National Defence
of 24 November 1989
amending and supplementing Decree No. 118 / 1964 Coll., laying down the basic conditions for the supply of products and works intended to safeguard State defence
The Federal Ministry of National Defence, in agreement with the participating central authorities and the State Arbitration of the Czechoslovak Socialist Republic, provides in accordance with Section 392 of Economic Code No. 109 / 1964 Coll., in the full version published under No. 80 / 1989 Coll.:
Čl. I
Decree of the Ministry of Defence No. 118 / 1964 Coll., which issues the basic conditions for the supply of products and development works intended to ensure State defence, is amended as follows:
1. The title of the Order reads:
"Decree of the Federal Ministry of National Defence on the basic conditions of supply to ensure state defence."
2. Paragraph 1 (1) (1) reads as follows:
"1. products, works and performance intended to ensure State defence or security,
(a) articles of an arms nature;
(b) special products which cannot be replaced by products of a civil nature (products manufactured under special technical conditions);
(c) other products inspected by the customer with the supplier;
if collected by the Federal Ministry of National Defence, the Federal Ministry of Interior, the Federal Ministry of Transport and Communications, the Ministry of Interior and Environment of the Czech Socialist Republic and the Slovak Socialist Republic, the Administration of the Department of Correctional Education of the Ministry of Justice of the Czech Socialist Republic and the Ministry of Justice of the Slovak Socialist Republic, '.
3. In Section 1 (1) No 2, the words "Ministry of National Defence, Ministry of Interior or Ministry of Transport-Transport-Rail Command," shall be replaced by the words "Federal Ministry of National Defence, Federal Ministry of Interior, Federal Ministry of Transport and Communications, Ministry of Interior and Environment of the Czech Socialist Republic and Slovak Socialist Republic, Administration of the Department of Correctional Education of the Ministry of Justice of the Czech Socialist Republic and Ministry of Justice of the Slovak Socialist Republic."
4. Paragraph 1 (1) (3) shall be deleted.
5. In Article 3 (1), the words "Delivery under the ZPD MNO 'are replaced by the words" Delivery under the basic conditions of delivery by the Federal Ministry of National Defence'.
6. Article 10 (1) reads as follows:
"(1) If the guarantee period is not longer or the supplier's unilateral action is not extended by the guarantee period, the guarantee period shall be at least 12 months after delivery. ';
7. In Paragraph 10 (2), the words "the guarantee period shall be extended by the storage period but not more than 2 years, unless otherwise assessed by the organisation 'shall be replaced by the words" the guarantee period shall be at least 36 months after the delivery has been completed'.
8. § 11, 12, 13 are released.
9. Paragraph 14 (1) reads as follows:
"(1) The solver who is late in fulfilling the obligation to resolve the task and surrender the result of the solution shall be obliged to pay a penalty payment of 1% of the price of the work not delivered for each month of delay started."
Article 14 (2) and (4) shall be deleted. Paragraph 3 shall become paragraph 2.
11. § 15, 16, 17 are released.
12. In Paragraph 18, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) The penalty referred to in Article 206 (1) (c) of the Act shall not apply where an extended guarantee period of at least 24 months is granted on the product and the supplier removes the defect or exchanges the defective product for impeccable within 15 days of receipt of the claim or within another agreed period. ';
Čl. II
This Decree shall take effect on 1 January 1990.
