DECLARATION

amending Article 159 of Decree No. 128 / 1975 Coll., implementing the Social Security Act
The Federal Ministry of Labour and Social Affairs shall provide for social security, as amended by Act No. 150 / 1979 Coll., in agreement with the participating central authorities and the Central Council of Trade Unions pursuant to § 172 (1) (f) of Act No. 121 / 1975 Coll.:
Section 159 of Decree No. 128 / 1975 Coll., implementing the Social Security Act, reads as follows:
Employment report for working pensioners
(1) The organisation has an obligation to report if the beneficiary of any pension pension (insurance) enters its employment.
(2) However, if there is an old-age pensioner and a widower who is also paid an old-age pension or who has reached the age of 57, 83) the organisation is obliged to declare:
(a) entry into an indefinite employment contract, not involving a citizen providing services on the basis of an authorisation of a national committee;
(b) entry into employment agreed for a period of more than one year, if it is a job in which the old-age and widower's pension is provided at an unaltered rate, in addition to the earnings not exceeding 22 000 CZK per year;
(c) entry into employment in which the old-age and widower's pension is granted unchanged, in addition to the earnings not exceeding 22 000 CZK per year, of a working pensioner who has already earned 22 000 Kns in such employment in the calendar year;
(d) the month in which the earnings of the working pensioner in the employment, in which the old-age and widower's pension is paid unchanged in addition to the earnings not exceeding CZK 22,000 in the calendar year, exceed CZK 22,000 if the working pensioner continues to work; In doing so, the organisation shall include, in the earnings of the working pensioner, the earnings achieved in the calendar year for other organisations in previous or, where appropriate, simultaneous employment,
(e) entry into employment of a working pensioner under 70 years of age, whose pension has been adjusted as a single source of income.
(3) The report referred to in paragraph 1 must include the surname, name, birth number, personal data and residence of the worker, the date on which the entry into employment took place or, where appropriate, the other fact establishing the reporting obligation and the amount of gross earnings expected. If there is a worker whose child is being recruited by another citizen for retirement, the report shall also include the surname, name, birth number, personal data and residence of the citizen who receives the education. In the case of a widower and a pensioner for years, the organisation shall report in 12 calendar months the amount of gross income achieved and the amount of sickness paid separately.
(4) The report referred to in paragraph 2 shall contain, in addition to the facts referred to in this paragraph, the surname, name, birth number and personal data of the working pensioner.
(5) If the beneficiary of the pension is an occupational pension, members of the National Security Corps or members of the Correctional Education Corps, the report shall include, in addition to the information referred to in the preceding paragraphs, the number of the decision granting the pension.
(6) The organisation shall be required to send a report within 8 days of the date on which the fact establishing the reporting obligation, the pension authority of the Republic or the competent national committee, whichever of these authorities is competent to decide on the levy. If it is a pensioner subject to unfavourable health conditions, the organisation shall send the report to the competent national committee according to the place of residence of the pensioner. The report on the pension beneficiaries of occupational pensions, members of the National Security Corps or members of the Correctional Education Corps shall be sent to the authorities of the Federal Ministries of National Defence and Interior and the ministries of Interior and Justice of the Republic within that period, whichever institution has granted the pension.
(7) The submission of the register pursuant to § 155 does not satisfy the obligation imposed on the organisation in the preceding paragraphs.
(8) The obligations of the organisations referred to in the preceding paragraphs are also fulfilled by a citizen who employs another citizen. "
This Decree shall take effect on 1 January 1984.
