DECLARATION
Czech Science Commission
of 22 October 1979
on the defence of the candidate and doctoral dissertation of Czechoslovak nationals in the Member States of the Council of mutual economic assistance
The Czech Science Commission, in agreement with the Czechoslovak Academy of Sciences, the Federal Ministry of Technical and Investment Development and the Ministry of Education of the Czech Socialist Republic, provides pursuant to § 12 (3) of Act No. 53 / 1964 Coll., on the award of scientific degrees and on the State Commission for Scientific Aspects, as amended by the Act of the Czech National Council No. 2 / 1969 Coll., on the establishment of ministries and other central bodies of the state administration of the Czech Socialist Republic:
(1) A Czechoslovak citizen preparing to defend his / her candidate or doctoral dissertation in one of the Member States of the Council of mutual economic assistance is obliged to seek the opinion of the Czech Commission for Scientific Aspects.
(2) The Czech Science Commission shall be responsible for giving the opinion referred to in paragraph 1 where an organisation to which a Czechoslovak national is in a working or other similar relationship or an organisation which has sent him abroad is established in the territory of the Czech Socialist Republic.
(1) The Czech Commission for Scientific Aspects will deliver an opinion pursuant to § 1 following a request made by a Czechoslovak national to the Czech Commission for Scientific Aspects through the organisation referred to in § 1 (2).
(2) The application referred to in paragraph 1 shall contain:
(a) the name, surname, date and place of birth of the applicant, his place of residence, place of work and function and indication of completed university education;
(b) the subject of the candidate or doctoral dissertation submitted by the applicant for defence;
(c) the name of the foreign authority before which the defence is to be held, the designation of the group of sciences in which the scientific rank is to be awarded and the scientific field in which the defence is to be held;
(d) the reasons for defending a candidate or doctoral dissertation abroad, in particular whether the applicant has sent for a scientific education or study stay and for defending a candidate or doctoral dissertation abroad, or whether the applicant is abroad on a long-term service, scientific or other residence exceeding a period of one year, or whether the applicant is defending a candidate or doctoral dissertation in a scientific field which is not on the list of scientific disciplines in which defence can be held in the Czechoslovak Socialist Republic.
(3) The application referred to in paragraph 2 shall be accompanied by a document certifying the completion of his higher education. The organisation through which the application was submitted (paragraph 1) shall attach its observations.
(4) If the candidate or doctoral dissertation contains facts which are intended exclusively for the purposes of professional use, or those which need to be classified, or where appropriate, works on which an authorship certificate or patent is to be issued and which have not yet completed the procedure, special provisions shall also apply (1)
The opinion referred to in Article 1 shall be notified in writing to the applicant by the Czech Commission for Scientific Aspects by means of an organisation to which the applicant is in a working or similar relationship or by means of an organisation which has sent him abroad.
This Decree shall take effect on 1 January 1980.
