THE LAW
of 17 December 1975
supplementing the Economic Code
The Federal Assembly of the Czechoslovak Socialist Republic decided on this law:
Čl. I
Economic Code No 109 / 1964 Coll., as amended (complete version No 37 / 1971 Coll.), is added as follows:
1. § 259 reads:
"(1) Save as otherwise provided in specific provisions, agricultural organisations may deliver selected agricultural products only to designated purchasing organisations, other products also to other customers.
(2) Where a particular type (group) of agricultural products is purchased by more than one designated purchasing organisation, it shall be determined which of them or, as the main purchasing organisation, which of them will be entitled to coordinate such activity. Other participating purchasing organisations shall provide the main purchasing organisation with the necessary synergies.
(3) Purchasing organisations are obliged to withdraw the offered agricultural products of particular economic importance for which they are intended to be purchased, even if the quantity offered is higher than the quantity agreed upon or even if the contract was not concluded at all. These supplies are subject to the provisions on obligations under economic contracts.
(4) Agricultural products, buying-in organisations, main purchasing organisations, other customers (paragraphs 1 to 3), as well as the scope and content of the coordination (paragraph 2), shall determine the implementing act. '
2. The following Section 389a is inserted after Section 389:
"(1) Economic organisations with international participation established in connection with the development of socialist economic integration (international economic organisations) based in the Czechoslovak Socialist Republic, as well as branches of international economic organisations established in the Czechoslovak Socialist Republic, are also participants in economic relations if they can acquire rights and obligations on their behalf (legal entities).
(2) The Government of the Czechoslovak Socialist Republic may provide for the establishment, legal form and method of management, planning, financing, control and other legal conditions of the organisations referred to in the preceding paragraph. "
3. Paragraph 391 becomes paragraph 1 and the following paragraph 2 is added:
"(2) The Federal Ministry of Agriculture and Nutrition, in agreement with the Federal Ministry of Finance, shall issue, as necessary, an implementing regulation for the sale of agricultural products to workers of state organisations with agricultural production."
Čl. II
Paragraph 11 (1) of Act No. 101 / 1971 Coll., on the State Plan for the Development of the National Economy of the Czechoslovak Socialist Republic for the years 1971 to 1975 (Act on the Fifth Five-Year Plan) is hereby repealed.
Čl. III
This Act shall take effect on 1 January 1976.
