on the harmonisation of certain regulations on the pay and service conditions of state and other public staff.
The Constitutional National Assembly of the Czechoslovak Republic decided on this law:
(1) The Government hereby authorises itself to amend, for the purposes of unification, the salary and associated employment conditions of civil servants in Slovakia according to the equivalent of the regulations applicable in the Czech and Moravian-Silesian countries, in particular according to the equivalent
(a) Amendments to Act No. 15 / 1944 Coll., Amendments to Act No. 16 / 1944 Coll., Amendments to Regulation No. 19 / 1944 Coll. and Government Regulations of 12 January 1944, No. 17 Coll., amending and supplementing the Act of 24 June 1926, No. 105 Coll., on the salary ratios of state, municipal (municipal) and district doctors,
(b) Government Decree of 30 March 1944, No 78 Coll., supplementing the Government Decree of 12 January 1944, No 15 Coll.,
(c) Government Decree of 15 September 1941, No 388 Coll., on the reorganisation of educational protectorate and certain other public employees,
(d) Government Decree of 8 February 1940, No. 103 Coll., on Educational Assistant Teachers at General and Urban Schools,
and the changes resulting from this law.
(2) The pay and service conditions of Czechoslovak State Railways employees in Slovakia will be adjusted as if the regulations in force for these employees were in force before the entry into force of this Act, after being applicable to Czechoslovak State Railways employees in the Czech and Moravian-Silesian countries.
Slovakia shall be extended to:
(a) a decree of the President of the Republic of 20 August 1945, No 58 Coll., concerning the payment of the allowance to public and public servants,
(b) Decree of the President of the Republic of 6 September 1945, No 73 Coll., amending and supplementing the Law of 24 June 1926, No 103 Coll., as regards professors of universities and university assistants,
(c) the Act of 12 April 1946, No 103 Coll., on the special service allowances of professional Judges and other judicial staff.
(1) In accordance with the Act of 193enc. 193enc., in accordance with the Act of 193enc., in accordance with the Act of 193enc., in accordance with the Act of 13 December 1945, in accordance with the Act of 13 December 1945, in respect of the special contribution of civil servants and certain other public servants, and in accordance with the Act of 193enc., in respect of the Act of 193enc., in accordance with the Act of 13 December 1945, in respect of the Act of Law of 13 December 1945, in respect of the Act of the Act of 2341enc. The difference, if any, is due as a compensatory personal allowance which is not subject to pension tax.
(2) The compensatory personal allowance referred to in the preceding paragraph shall be reduced by the amount of such increase, but not more than the amount by which the salaries fixed in accordance with paragraph 1, following the increase in the service (equivalent), exceed the current salary.
(3) If the family status (number of members of the family) taken into account for the purposes of determining the compensatory allowance is changed in the case of the effectiveness of this Act, that allowance shall be fixed for the period from the first day of the next month as if the circumstances of the change brought about were the day before the entry into force of this Act.
(4) The compensatory personal allowance shall be rounded up if it is not expressed in crowns without pennies or if it is not divisible by 12, to the nearest higher amount in crowns, divisible by 12.
(5) Any discrepancies which would result in a salary adjustment in Slovakia, carried out under this law, in the case of judicial staff, in particular married persons, will be offset by personal allowances under Section 148 (4) of the Salary Act.
(1) Paragraph 1 also applies mutatis mutandis to the adjustment of the status of beneficiaries of state resting (provision) salaries in Slovakia, to which the Law of 19 February 1946, No 39 Coll., extends the validity of the Act of 19 February 1946, on the expensive addition of beneficiaries of state resting (provision) salaries and on some of their legal conditions.
(2) The amount of 1.500 CZK laid down in Article I, paragraph 2 of Act No. 39 / 1946 Coll. is increased to 2.400 CZK.
(1) The applicability of the provisions of Article IV, § 2, paragraph 2 of the Amendment to the Law No 15 / 1944 Coll. is amended by not taking into account the words "who were in active service on 1 January 1944."
(2) Article V, § 1, paragraph 2 of the Law of 16 May 1946, No 139 Coll., adjusting the salary and certain service conditions of military and gentile gentiles, is amended and worded as follows:
"(2) However, they may not be lower than what they would have been entitled, in order to exclude the applicability of the amendment to the Law No. 15 / 1944 Coll. if that law had not been applicable to those appointed; for this purpose, the widow's pension shall be added to the education allowance. Any difference shall be due as an addition to the rest (provision) salaries. ';
The Act of 24 June 1926, No 103 Coll., on the adjustment of the salary and certain service conditions of civil servants (the Law of 24 June 1926), as amended by the Regulations amending it and supplementing it, is amended as follows:

"(3) The posts of the chairmen of the Supreme Court and the chairmen of the Supreme Administrative Court shall be organised outside the groups. ';
Article 38 (2) reads as follows:
"(2) Adjutum shall be determined according to the groups of places A, B, C, D (§ 12) and shall be:
(a) up to and including 18 months of deductible preparatory services for the judicial group A 28.560 CZK, B 27.420 CZK, C 26.280 CZK and D 25.140 CZK per year,
(b) after the period referred to in point (a) in the category A 30.720, in the group B 29.496, in the group C 28.272 and in the group D 27.036, in the group D 27.036 per year. "
3. Paragraph 40 reads:
"(1) The chairmen of the Supreme Court and the chairmen of the Supreme Administrative Court are 139.560 CZK per year.
(2) The ordinary other Judges shall constitute the basic service and, where applicable, the functional service.
(3) The basic service shall be fixed in annual amounts as follows:

(4) It is for the judges, in the places of employment of the first group (§ 36), other than the basic service, who are still in service, to determine the annual amounts as follows:

(5) It is for the judges appointed by the Supreme Court and the Supreme Administrative Court in the III scale of functional servants to be responsible for the increase in functional duties of 3.360 Kns per year and for the additional increase in functional duties of 3.360 Kcs per year to be lost in such an increased functional service.
(6) The prerogatives of the District Courts with more than 8 judicial departments and judges at the Court of Choirs of the I. stools in V. a scale of functional servants who have been entrusted with the administration of the District Court at the seat of the Court of Choirs of the I. stools shall, if this district court has more than 8 judicial departments, be responsible, for the duration of this function of duty allowance 4.500 CZK per year. If this addition has been continuously for at least 3 years, it shall become part of the pension base; otherwise the approval of the Ministry of Finance is needed to set it up in the pension base. This increase in the pension base will cease to exist by reaching a post systemised in a higher scale of functional service.
(7) The service posts of the forces in the Secretariat of the Supreme Court and the Supreme Administrative Court are organised in the IV to VI scale of the functional servant; the posts of the head of the auxiliary forces established at the second storehouse assembly court shall be systemized in V and VI by the scale of the functional servant; they shall have the appropriate functional service as referred to in paragraph 4. ';

"(1) The operating fees shall be determined according to the groups of places A, B, C, D (§ 12) and determined in annual amounts as follows:

"(1) The basic service is increased by the process to higher degrees. The increase in the basic service shall take place as soon as the judge has completed three years of deductible service hours with the service of the immediately preceding degree.
(2) The functional service shall be increased in accordance with the procedure to the higher levels of the service. The increase in the duty rate shall take place as soon as the judge has completed three years of deductible service hours with the service level immediately preceding that.
(3) The Judge who completed three years of deductible service hours with a functional service scale VII shall proceed to the VI. scale of functional duty level (a); a Judge who completed three years of commensurate service hours with a functional service of the last step of the VV scale of the functional service shall proceed to the VV scale of the functional duty level (a). The provisions of paragraph 2 shall apply in respect of further progress in the new scales of the functional service to which the Judge has referred in accordance with the provisions of the preceding sentence.
(4) An increase in the basic service and functional service is carried out ex officio.
(5) In accordance with paragraph 3, the charge shall not be changed and there shall be no change in the order of service. ';

"(1) The promotion of a judge in a place of service systemised in the second group shall be the hire of a post of the first group, the promotion of a judge in a place of service systemised in the first group by the hire of a post systemised on a higher scale of a functional servant; in so doing, the judge shall receive the initial service scale of the functional service if, pursuant to Paragraph 44 (3), it is no longer entitled to a functional higher degree or higher.
(2) Paragraph 17 (2) and (3) shall apply mutatis mutandis. '
7. Article 53 (2) and, as regards Slovakia, Article 53 (3), as amended by Article VII of the Law of 16 June 1942, Article 113 of the Act establishing the Law on the organisation of courts, public action offices and judicial administration, read:
"The official posts of the conceptual pragmatic officials of the public prosecutor's offices shall be organised as follows:

(1) Where a judge (a conceptual official of the Public Prosecutor's Office) is appointed on the date on which this Act takes effect, in a place of service which, under this law, is included in a higher scale of functional service, he shall acquire the rights arising from this higher classification only by leasing a post in the relevant higher scale of functional service.
(2) Where a judge (a conceptual official of the Public Prosecutor's Office) is appointed at a post with which the service allowance is linked pursuant to the provisions of Section 148 of the Law on Payment and has actually been granted that allowance, he shall receive, on a higher scale, a functional service service equal to the sum of the current functional service and the corresponding allowance, and if he is not such a functional service, the highest service. Where there is also a service of service resulting from the hire of a post on a higher scale of a post of service, the sum of the current service of service and the corresponding service allowance, or if higher, the service allowance shall cease; otherwise, the current allowance shall remain within the limits of the provisions in force, at the rate of the difference.
Judgments (conceptual pragmatic officials of public authorities) subject to the provisions of Article 44 (3) of the Law on Payment, as amended by Article II (1) of this Law, shall be appointed as new functional service from the date of the entry into force of this Law under the principles of Article 44 (2) and (3) of the Law on Payment, as amended by Article II (1) of that Law, under the overall prior deductible hours of service with a functional service, provided that the promotion does not result in a more favourable classification.
In order to carry out a procedure in a higher scale of functional service, the Government may lay down more detailed provisions, in particular as regards the question of whether and which allowances under Section 148 of the Salary Act are to cease.
As long as they are governed by a special law by uniform official titles of the judges and conceptual officials of the public prosecutor's offices, official titles still connected to such posts shall remain in force for those posts which have been included in the higher scale of the functional service or outside the group. Deputy Presidents of the Chambers of the Supreme Court, after the case of the Supreme Administrative Court, set up in the official offices of that office, the official title of the "Deputy Senate President (President) of the Supreme Court," shall be as follows:
Free workers shall be entitled to operating, adjutum, remunery and daily salary at the same rate as the employees of the married.
The salary allowance provided for in Decree No. 58 / 1945 Coll., the salary allowance of military gayists pursuant to Article III, Section 2 of Act No. 139 / 46 Coll., as well as the special allowance provided for in Act No. 159 / 1945 Coll., as amended by Act No. 69 / 1947 Coll., shall be paid even for the period of temporary removal of the Office (suspension, discharge from service), at half-size.
(1) The age limit of 16 years in § 1 of Decree-Law No 388 / 1941 Coll. and § 105 of the Salary Act, as amended by Act No. 139 / 1946 Coll., is increased to 18 years. The amount of CZK 4.800 in § 1, par. 1 of that regulation and § 105, par. 2 of that law, as well as the amount of CZK 4.800 and CZK 6.000 in § 2 of the Decree of 23 October 1941, No 11 of 1942, which regulates the legal situation in the field of public pension provision in the provision of certain beneficiaries of the provision fee, is increased to CZK 7.200 per year.
(2) The amount of CZK 7.200 per year, as provided for in paragraph 1, is valid only for children over 18 years of age; up to the age of 18, children shall be deemed not to be provided, irrespective of their income, with regard to education, education allowance and orphan's pension.
(1) The applicability of the provisions of § 3, § 2, § 7, § 1, § III, and § 8, § 1 of the Law of Teaching No. 104 / 1926 Coll., as amended by the Act of Teaching No. 16 / 1944 Coll., in so far as they provide for specific rates for guardians, is hereby repealed. For caregivers there are set rates for handjobs teachers (home schooling).
(2) It is for the administrators of the parent schools to have a compensationable director allowance, which is:
(a) in the management of a single parent school of 1.000 CZK per year; This allowance shall be increased by 240 CZK per year, up to a maximum of 1.960 CZK per year, by the second and each additional department of the parent school or school subordinate to the same administrator;
(b) for the administration of a parent school (department) associated with the administration of a general school or a municipal school of 240 Cds per year for each department, but not more than 1.200 Cds per year.
(3) The director's allowance referred to in paragraph 2 may not exceed the maximum amount laid down by this provision, in accordance with the provisions of Section 15 of the Act of Teacher No 104 / 1926 Coll., as amended by the Act of Teacher No 16 / 1944 Coll.
Paragraph 15, paragraph 3, the last sentence of the salary law and Paragraph 13, paragraph 3, the last sentence of the Government Decree of 5 March 1927, No 15 Coll., on the regulation of pay and certain service conditions of employees of Czechoslovak State Railways, is deleted.
This law applies
(a) for staff of the State and of State or State-run institutes, undertakings, funds and establishments whose pay ratios are governed by the laws or regulations issued pursuant to them;
(b) for teachers covered by Law 104 / 1926 Coll.,
c) for professors of theological dioceses (§ 211 of the Law No. 103 / 1926 Coll.),
(d) for beneficiaries of the resting (provision) salaries paid out of State resources or from the funds of the institutions, undertakings and funds administered by the State or the State;
(e) appropriate to the staff of the units of the local authority whose service and pay conditions are adapted in accordance with the terms of the salary law or regulations issued pursuant to it, and - in so far as they do not extend the validity of the provisions of Article 7 (1) (a) and (b) of Regulation (EU) No 1306 / 2013, I Act No. 39 / 1946 Coll. (Article I, § 4, paragraph 1) - for the beneficiaries of the resting (provision) salaries paid from the funds of forced territorial ties, institutes, undertakings and funds of these volumes or managed by them.
Any overpayments resulting from the implementation of this Act on service or rest income (provision) until the date of publication of this Act shall be forgiven.
This Law shall take effect on 1 January 1947, with the exception of Article I, Article 4, which shall take effect on 1 August 1945, Article I, Article 5, which shall take effect on 1 January 1944 and Article III, Article 3, paragraph 1, which shall take effect on 1 December 1945; The law will be implemented by all members of the government.
