DECLARATION
of 23 May 2023
amending Decree No 277 / 2015 Coll., on the procedure for determining the amount of compensation for pain and for making it difficult for the social application of members of the Security Corps, as amended by Decree No 225 / 2016 Coll.
In agreement with the Ministry of Finance, the Ministry of Justice, the intelligence services and the General Inspection of the Security Corps, the Ministry of Interior provides pursuant to Section 104 (2) of Act No. 361 / 2003 Coll., on the service relationship of members of the Security Corps, as amended by Act No. 247 / 2017 Coll.:
Decree No. 277 / 2015 Coll., on the procedure for determining the amount of compensation for pain and for making it difficult for members of the Security Corps, as amended by Decree No. 225 / 2016 Coll., is hereby amended as follows:
1. In Article 4 (4), the words "due to bone or bone fracture operations' are replaced by the words" arising from bone or bone fracture operations'.
2. Paragraph 7 (2) reads as follows:
"(2) The value of the point shall be 1% of the average gross monthly nominal wage for the converted number of employees in the national economy obtained according to the published data of the Czech Statistical Office for the first to third quarters of the calendar year preceding the calendar year in which the obligation to carry out the assessment of pain and difficulties in social application arose. '
footnote 1 is deleted.
3. In Annex 2, the following entries 2.11, 2.11.1 and 2.11.2 are added to the table after entry 2.10.6:

| b) | v radiologickém vyšetření při hodnocení morfologických změn v segmentech L3/4, L4/5 a L5/S1, kdy v každém z těchto 3 segmentů se hodnotí 5 parametrů, kterými jsou snížení meziobratlové ploténky, protruze meziobratlové ploténky, Modicovy změny stupně II nebo III obratlových těl, posun obratlového těla a artróza meziobratlových kloubů, a na základě tohoto vyšetření byla zjištěna abnormalita u osoby ve věku do 50 let alespoň v 5 parametrech, ve věku od 50 do 60 let alespoň v 6 parametrech a nad 60 let věku alespoň v 7 parametrech z celkově 15 hodnocených parametrů | ||

Transitional provision
If the pain or difficulty in social application was caused by an accident or occupational disease before the date of entry into force of this Order and the decision was not made before the date of entry into force of this Order to provide for compensation for the pain or compensation for the inconvenience of social application, the compensation for the pain or compensation for the inconvenience of social application under Order No 277 / 2015 Coll., as effective from the date of entry into force of the Decree, shall be fixed.
Efficacy
This Decree shall take effect on 1 July 2023.
