GOVERNMENT REGULATION

amending Government Regulation No 245 / 2004 Coll., laying down closer conditions for the implementation of measures of the common organisation of the market in wine, as amended
The Government mandates pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., Act No. 441 / 2005 Coll. and Act No. 291 / 2009 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll. and Act No. 291 / 2009 Coll.:
Government Regulation No. 245 / 2004 Coll., on determining the closer conditions for the implementation of measures of the common organisation of the market in wine, as amended by Government Regulation No. 83 / 2006 Coll., Government Regulation No. 33 / 2007 Coll., Government Regulation No. 320 / 2008 Coll., Government Regulation No. 82 / 2009 Coll., Government Regulation No. 83 / 2009 Coll., Government Regulation No. 480 / 2009 Coll., Government Regulation No. 214 / 2010 Coll., Government Regulation No. 369 / 2010 Coll., Government Regulation No. 258 / 2012 Coll., Government Regulation No. 448 / 2012 Coll., Government Regulation No. 400 / 2013 Coll., is amended as follows:
1. In Article 5, the following paragraph 13 is added:
"(13) The application referred to in paragraph 1 and the notification referred to in paragraph 5 may not be lodged with the Fund as from 1 August 2014. ';
2. In Article 8c, the following paragraph 9 is added:
"(9) The application referred to in paragraph 2 may not be submitted to the Fund from 1 August 2014. ';
Transitional provisions
1. The procedure for applications for restructuring and conversion aid submitted pursuant to Article 5 of Decree-Law No 245 / 2004 Coll. initiated before the date of application of this Regulation, for which the applicant has notified the implementation of the measure pursuant to Article 5 (5) of Decree-Law No 245 / 2004 Coll. until 30 April 2014, shall be completed in accordance with Decree-Law No 245 / 2004 Coll., as effective before the date of application of this Regulation.
2. The procedure for applications for restructuring and conversion aid submitted pursuant to Article 5 of Government Regulation No 245 / 2004 Coll., for which the applicant has not submitted a notification of the implementation of the measure pursuant to Article 5 (5) of Government Regulation No 245 / 2004 Coll., shall be completed in accordance with Government Regulation No 142 / 2014 Coll., laying down the closer conditions for the implementation of the measures of the common organisation of the markets in agricultural products in the areas of wine-growing and wine-growing.
3. The procedure for aid applications for investment pursuant to Article 8c of Decree No. 245 / 2004 Coll. initiated before the date of entry into force of this Regulation shall be completed in accordance with Government Regulation No. 245 / 2004 Coll., as effective before the date of entry into force of this Regulation.
Efficacy
This Regulation shall enter into force on 1 August 2014.
