DECLARATION
of 17 May 2011
amending Decree No 344 / 2008 Coll., on the use, prescription and supply of medicinal products for veterinary care
The Ministry of Agriculture provides, pursuant to § 114 (4) of Act No. 378 / 2007 Coll., on medicinal products and on amendments to certain related laws ("the Act '):
Decree No 344 / 2008 Coll., on the use, prescription and supply of medicinal products for veterinary care, is amended as follows:
1. In Article 7 (1) in the introductory part of the provision, the word "breeder 'is replaced by" breeder'.
2. In Article 7 (1), the words "or medical diagnosis' shall be added at the end of the text of point (e).
3. Paragraph 7 (2) reads as follows:
"(2) Where the medicinal product is used by the breeder in accordance with Section 9 (12) of the Act, the breeder shall ensure that the record of the use of the medicinal product referred to in paragraph 1 is made. Where a medicinal product is used by a veterinarian, the veterinary surgeon shall ensure that the use of the medicinal product referred to in paragraph 1 is recorded. ';
4. In Article 7, the following paragraph 3 is inserted after paragraph 2:
"(3) The provisions of the Decree prohibiting the administration of certain substances to animals whose products are intended for human nutrition (8) shall apply to record the use of medicinal products containing hormonal substances and beta agonists. '
Paragraphs 3 and 4 shall be renumbered paragraphs 4 and 5.
5. In Article 7 (5), the words "referred to in paragraph 1 shall be kept by the breeder, the veterinarian or the manager of the experiment on each use of the medicinal product in such a way as to" shall be replaced by the words "kept with the breeder referred to in paragraph 1";
6. In Article 8 (2), in the introductory part of the provision, the words "and the records referred to in Article 7 (1) 'are deleted.
7. In Paragraph 8 (2), the dot at the end of point (b) is replaced by a comma and the following points (c) and (d) are added:
"(c) the reason for the use of the medicinal product or the medical diagnosis,
(d) the withdrawal period provided for in Article 3 (2) of the Act. "
Efficacy
This Decree shall take effect on 1 June 2011.
