transferring the authority of construction offices to the authorities of the Ministry of National Defence for certain buildings
The Minister of Construction, in agreement with the Minister of National Defence, provides, pursuant to § 24 paragraph 1 of Act No. 87 / 1958 Coll., on the Construction Regulations, as amended by § 3 of Government Decree No. 52 / 1960 Coll., for the repeal of the State Building Committee:
The powers of the construction offices, with the exception of the powers in matters of expropriation and compensation for expropriation (§ § 18 to 22 of Act No. 87 / 1958 Coll.), are transferred to the authorities of the Ministry of National Defence for the construction of the Ministry of National Defence, the Ministry of Transport - the headquarters of the railway army and the Union for the cooperation with the military carried out for the purpose of defence of the state, the housing buildings in a closed area reserved for the Czechoslovak People's Army and the housing structures within the closed buildings and facilities of the Czechoslovak People's Army. *)
(1) The following shall be regarded as buildings carried out for the purpose of defending the State under this Order:
(a) construction (works) included in the investment plan of the Ministry of National Defence or the Ministry of Transport - the headquarters of the railway army, in so far as it is not residential buildings and in the case of special purpose buildings (construction works) for the Association for Cooperation with the Army or for organisations subordinate to the Ministry of National Defence, built outside the closed territory reserved for the Czechoslovak People's Army and its closed buildings and facilities;
(b) structures (objects) in the administration of the Ministry of National Defence or the Ministry of Transport - the Railway Force Headquarters, used by military authorities, organisations subordinate to the Ministry of Defence or the Union for the Cooperation with the Army;
(c) buildings (objects) rented by the Ministry of National Defence or the Ministry of Transport - the headquarters of the railway army and used by military authorities and organisations, subordinate to the Ministry of National Defence;
(d) buildings (objects) in the administration or use of the Union for cooperation with the army or organization subordinate to the Ministry of National Defence, built in a closed area reserved for the Czechoslovak People's Army and within its premises and facilities.
(2) A restricted area for the Czechoslovak People's Army is considered to be the territory of the military escape.
(3) The buildings and facilities of the Czechoslovak People's Army are considered closed buildings and facilities, including land in areas reserved for the Czechoslovak People's Army (e.g. barracks, shooting range, training ground, dedicated communications).
(1) The powers of the construction offices are exercised, to the extent set out in Section 1, by the military construction offices of the Regional Military Accommodation and Construction Administrations ("KVUSS"). However, the Ministry of National Defence may reserve for designated buildings that it will exercise that power itself or by the authorities designated by it.
(2) The powers of the building office shall be exercised by:
a) Military Construction Office of KVUSS Prague in the Central Bohemian Region,
KVUSS Plzeň Military Construction Office in the Zapodočeský Region,
Military Construction Office KVUSS Hradec Králové, based in Pardubice in the region of East Bohemia,
KVUSS Brno Military Building Office in the South Moravian Region,
KVUSS Bratislava Military Construction Office in the Zapodoslovenský Region,
b) Military Building Office of the City of Prague,
Military construction office of KVUSS České Budějovice in the region of South Bohemia,
KVUSS Military Building Office Ústí nad Labem with its seat in Litoměřice in the region of North Bohemia,
KVUSS Military Building Office Ostrava located in Olomouc in the region of North Moravian,
KVUSS Banská Bystrica Military Building Office in the region of the MidSlovakian Region,
Military construction office of KVUSS Košice in the region of Východoslovenský.
(3) The military construction offices referred to in point (a) of paragraph 2 shall, in addition to having competence in the territory of the relevant region, exercise the competence of the construction office for construction (works) of an investment nature carried out in a supplier's way, pending the decision to permit permanent operation (use) in the following regions:
KVUSS Prague Military Construction Office in the City of Prague and the North Bohemian Region,
KVUSS Plzeň Military Construction Office in the region of South Bohemia,
KVUSS Brno Military Construction Office in the North Moravian Region,
Military construction office of KVUSS Bratislava in the area of the regions of the Middle Slovak and Východoslovenský.
(4) The authorisation to put buildings into permanent operation (use) carried out for the Association for Cooperation with the Army shall be issued by the authorities referred to in paragraphs 2 and 3 to the extent of their competence; for other structures such authorisation shall be granted by the authorities designated by the Ministry of Defence.
This Decree shall take effect from 1 October 1960.
