THE LAW
of 3 April 2001
amending Act No. 199 / 1994 Coll., on the Procurement of Public Contracts, as amended
Parliament has decided on this law of the Czech Republic:
Act No. 199 / 1994 Coll., on Public Procurement, as amended by Act No. 148 / 1996 Coll., Act No. 93 / 1998 Coll., Act No. 28 / 2000 Coll., Act No. 256 / 2000 Coll. and Act No. 39 / 2001 Coll., is amended as follows:
1. In Article 2 (b) (2), the words "public telecommunications network operator or telecommunications service operator 'are deleted.
2. In Article 2 (b) (3), the words "or mining 'are deleted.
3. Paragraph 3 (2) reads as follows:
"(2) The contracting authority is obliged to declare a commercial tender if the amount of the future cash obligation of the contract, excluding value added tax, if it is for real estate, with the exception of rental, or a set of machines or equipment forming a separate functional unit exceeds CZK 30 million and in other cases CZK 7,5 million."
4. Paragraph 3 (3) reads as follows:
"(3) Contracting entities referred to in § 2 (b) (2), (3) and (4) are required to declare a commercial tender if the amount of the future liability of the contract, excluding value added tax, goes for the property, with the exception of rental, or for a set of machines or equipment constituting a separate functional unit exceeds CZK 50 million and in other cases CZK 12 million."
5. In Paragraph 49 (1), the amount "CZK 2 500 000 'is replaced by" CZK 5 000 000' and the amount "CZK 1 000 000 'is replaced by" CZK 2 500 000'.
6. In Paragraph 49a (1), the amount "500 000 CZK 'is replaced by" 2 000 000 CZK'.
7. In § 49b, the amount "500 000 CZK" is replaced by "2 000 000 CZK."
8. In Paragraph 50 (1) (c), "50% 'is replaced by" 20%';
The award of public contracts initiated before this Act is effective shall be completed in accordance with the existing rules.
Efficacy
This Act shall take effect on the day of its publication.
