determining the amount of interest on late payments and the late payment fee under the Civil Code and determining the minimum amount of costs associated with the application of the claim
The Government orders the implementation of § 517 paragraph 2 of Act No. 40 / 1964 Coll., Civil Code, as amended by Act No. 509 / 1991 Coll., and pursuant to § 369 paragraph 1 of Act No. 513 / 1991 Coll., Commercial Code, as amended by Act No. 370 / 2000 Coll. and Act No. 179 / 2013 Coll.:
The amount of interest on late payment corresponds annually to the rate of repo fixed by the Czech National Bank for the last day of the calendar half-year preceding the calendar half-year in which the delay occurred plus eight percentage points.
The amount of the late fee for each day of delay shall be 2,5 pro milo amounts owed, but not less than CZK 25 for each month of delay.
If it is a binding relationship between the entrepreneur or if it is the content of a mutual obligation between the entrepreneur and the contracting authority to deliver the goods or to provide the service for consideration to the contracting authority, the minimum cost associated with the application of each claim shall be CZK 1,200.
Where there has been a delay in the performance of the cash debt before the entry into force of this Regulation, the amount of interest on late payments and the late payment fee shall be governed by this Regulation as from the date of application of this Regulation.
Sections 1 (1) and 10 of Decree of the Ministry of Justice No. 45 / 1964 Coll., implementing certain provisions of the Civil Code, are repealed.
This Regulation shall enter into force on the day of its publication.
