on the performance of the people's administration in the locations of the regions.
The National Assembly of the Czechoslovak Republic decided on the following Act:
Basic provisions.
(1) The territory of the city which is the seat of the regional national committee and the territory of the district with the seat of the district national committee in the county town consists of one district in which the popular administration is carried out by a single national committee of 48 members based in the county town. The Single National Committee shall exercise the jurisdiction of the District National Committee and the jurisdiction of the Local National Committee in the territory of the City of its seat.
(2) Paragraph 1 does not apply to Prague, Brno and Bratislava.
(3) The manner in which the people's administration referred to in paragraph 1 is exercised shall also apply to the town of Opava and to the current provincial district of Opava.
(4) The Government may, by regulation, adjust the performance of the folk administration referred to in paragraph 1 and in other counties.
District council.
(1) For the various parts of the city managed by the Single National Committee pursuant to Article 1, they may be set up with the approval of the Ministry of Interior of the District Council as the executive component of the Single National Committee.
(2) The districts and the number of members of the district councils are determined by the Regional National Committee, on a proposal from the single national committee, which shall also specify the details of their internal organisation. The number of members of the District Council shall not exceed the number of members of the Single National Committee.
(3) The President, his Deputy Director and the other members of the District Councils elect a plenary session of the Single National Committee from the citizens of the district concerned.
(4) The District Councils shall carry out the tasks entrusted to them by the Single National Committee. The Single National Committee may, in so far as this is not prejudicial to the uniformity of administration, entrust the district councils or their individual members with the right to take decisions on behalf of the Single National Committee to the extent they determine. This mandate requires the approval of the Ministry of Interior, granted in agreement with the central office responsible for the matter and after hearing the Regional National Committee.
Special provisions for High Tatras.
(1) The National Committee of the Municipality of Vysoké Tatras is referred to as the Single National Committee and exercises the competence of the local and regional national committee within its territory. It has 24 members.
(2) Paragraph 2 shall apply mutatis mutandis.
The performance of the People's Administration in Bratislava and Brno.
(1) In the territory of Bratislava and Brno, a central national committee of 60 members is responsible for the local and regional national committee.
(2) For each part of Bratislava and Brno, district councils shall be established as the executive component of the Central National Committee. Circuits and the number of members of district councils shall be determined and the details of their internal organisation shall be determined by the Ministry of the Interior. Paragraph 2 (3) and (4) shall apply mutatis mutandis.
Common provisions for the Single National Committees and Central National Committees in Bratislava and Brno.
Organization.
(1) The Single National Committees and the Central National Committees are directly subordinate to the Regional National Committee.
(2) The Single National Committees and the Central National Committees determine at their plenary sessions the direction and policy of the National Committee. As part of their resolution, the public administration shall be exercised by their executive bodies, which shall be the Council, the President and its Deputy, the Members and the Commission. The members of the Board shall be the President, its Deputy-Ministers and the Members. The number of Vice-Presidents shall be determined by the Minister for the Interior.
(3) The Single National Committee or the Central National Committee, on the one hand, and the Regional National Committees or the Local National Committees, on the other, may be associated with the agreed resolutions of their plenary sessions, which shall be approved by the Regional National Committee, on the joint provision of certain matters of the People's Administration; they may also be brought together for the same purpose by a decision of the central office responsible for the matter, made in agreement with the Ministry of Interior.
(4) The Minister for the Interior may dissolve the Single National Committee or the Central National Committee. It may do so, in particular if the national committee fails to fulfil its tasks or if its activities threaten the proper performance of the public administration. If there is no danger of delay, the Minister of the Interior shall hear the relevant Regional National Committee before dissolution. The Minister for the Interior shall take the necessary measures for the interim management of the administration for a transitional period before the authorities newly elected.
(5) Unless otherwise provided for in this Act or in the Government Regulation, provisions shall apply to the Single National Committees and the Central National Committees on the arrangements for the establishment and internal organisation of the District National Committees, in particular on the exercise of the powers of the Plenary Session and Executive Services and on the organisation of reports, and on the subordination and supervision of the District National Committees, the principles of their deliberations and the status of District Secretary.
Territorial changes.
(1) The Government Regulation should:
(a) the connection of another municipality to the city where the popular administration is carried out by a single (central) national committee;
(b) to separate part of such a city and to form a separate municipality from that part.
In Slovakia, these measures are implemented in accordance with the Slovak National Council.
(2) Before issuing the measures referred to in paragraph 1, the single (central) national committee and the regional national committee, in the cases referred to in paragraph 1 (a), shall also be given the opportunity to the local national committee of the municipality concerned to comment on the matter.
(3) If another municipality has been attached to the town where the people's administration is carried out by a single national committee or central national committee, the local national committee of the attached municipality shall cease. If a part of it has been separated from such a city and is made up of a separate municipality, the competent district (single) national committee shall take measures for the provisional management of the administration.
Parallel organs.
(1) Local (central) national committees in the cities covered by this Act and district national committees in the counties covered by Section 1 shall cease to exist; However, the executive bodies of these national committees will continue to exercise management until the authorities newly created take up their duties.
(2) For a transitional period, until the authorities from the elections have taken effect, the Home Secretary shall appoint the National Front, acting on a proposal from the Regional Action Committee, submitted through the Regional Action Committee, the National Front, members and alternates of the National Single Committees and the Central National Committees.
Repeal of existing regulations.
All provisions of the existing provisions which are contrary to this law or which have been replaced by it shall be repealed.
Final provision.
This Act shall take effect on the day of its publication; It shall be implemented by the Minister for the Interior in agreement with participating members of the Government.
