DECLARATION
of 24 March 2021
on the energy assessment and data maintained in the Energy Monitoring System
The Ministry of Industry and Trade provides pursuant to Article 14 (4) of Act No. 406 / 2000 Coll., on Energy Management, as amended by Act No. 165 / 2012 Coll., Act No. 318 / 2012 Coll., Act No. 310 / 2013 Coll. and Act No. 103 / 2015 Coll., ("the Act ') for the implementation of Sections 9a (5) and 9b (3) of the Act:
Subject matter
This decree implements the relevant European UnionRegulation (1) and provides for
(a) the content of the energy report, the manner in which it is processed and its scope;
(b) data maintained in the Energy Consumption Monitoring System.
Energy assessment content
The energy assessment shall include:
(a) title sheet,
(b) a summary of the energy report referred to in Annex 1 to this Decree; and
(c) details of the energy report referred to in Section 4.
Title sheet with identification details of the owner of the energy assessment subject, identification data of the energy assessment subject and identification data of the energy expert
(1) The title list contains:
(a) the purpose of processing the energy assessment pursuant to § 9a (1) or (2) of the Energy Management Act;
(b) identification of the owner of the energy assessment subject;
(c) identification of the subject matter of the energy review;
(d) the date of drawing up the energy report;
(e) identification of the energy specialist; and
(f) the registration number of the energy report from the Ministry's records of the activities carried out by energy specialists.
(2) The identification details of the owner of the energy assessment subject are:
(a) the legal person's name or business name and registered office, address for service, if different from the address of the registered office, the identification number of the person, if any, and the details of its statutory authority which is entitled to act for it;
(b) the natural person's name, names and surnames, identification number, if any, and address of residence.
(3) The identification details of the energy assessment subject are the name, address or location of the energy assessment subject and a brief description of the energy assessment subject.
(4) The identification data of the energy specialist are:
(a) legal persons are a commercial firm or name, an identification number, if assigned, the authorisation number of an energy specialist, the date of issue of the authorisation, the name and, where applicable, the name of the person responsible for the conduct and the name and, where applicable, the name of the person designated and his authorisation number of the energy specialist;
(b) natural persons shall bear the name, names and surnames, identification number, if any, if assigned, the authorisation number of the energy specialist and the date of issue of the authorisation.
Details of the energy assessment
The energy assessment in relation to the subject matter and purpose of the assessment shall include the following details:
(a) an assessment of the costs and benefits of ensuring high-efficiency cogeneration or the use of waste heat for an energy assessment pursuant to Article 9a (1) (a), (b) or (c) of the Act, which is carried out in accordance with Annex 2 to this Decree;
(b) an assessment of the economic feasibility to be carried out in accordance with the economic assessment set out in Annex 8 to this Decree for the energy assessment under Sections 9a (1) (a) to (d) and (f) and 9a (2) (b) and (c) of the Act;
(c) an evaluation of the environmental feasibility to be carried out according to the ecological assessment set out in Annex 9 to this Energy Assessment Order under Sections 9a (1) (d) and 9a (2) (b) to (d) of the Act;
(d) the evaluation of the proposed project according to the award of the subsidy provider, which is carried out in accordance with Annex 3 to this Decree for the Energy Assessment under Sections 9a (1) (d) and 9a (2) (c) of the Act;
(e) an assessment of the performance of the parameters for the energy assessment pursuant to § 9a (1) (e) and § 9a (2) (d) of the Act, which is carried out in accordance with Annex 4 to this Decree;
(f) an assessment of the economic acceptability of the use of heat energy from the thermal energy supply system or non-stationary energy source for the energy assessment referred to in Article 9a (2) (a) of the Act, which is carried out in accordance with Annex 6 to this Decree;
(g) an evaluation of the recommended or implemented energy assessment measures pursuant to Section 9a (2) (b) of the Act, to be carried out in accordance with Annex 7 to this Decree; and
(h) the determination of the internal rate of return for the energy assessment pursuant to Section 9a (1) (f) of the Act, which is carried out in accordance with Annex 5 to this Decree.
Data maintained in the Energy Monitoring System
The data held in the Energy Consumption Monitoring System are set out in Annex 10 to this Decree.
Transitional provisions
(1) The energy assessment drawn up pursuant to Decree No. 480 / 2012 Coll., as effective before the date of entry into force of this Decree, is considered to be an energy assessment drawn up under this Decree, unless it is an assessment under § 9a (2) (a) of the Act.
(2) The energy report provided for in Section 9a (2) (a) of the Act, drawn up in accordance with Decree No. 480 / 2012 Coll., as effective before the date of entry into force of the Decree, may be submitted to the application for the consent of the environmental authority for a maximum period of 1 month from the date of entry into force of the Decree.
Efficacy
This Decree shall take effect on 1 April 2021.

Assessment of costs and benefits in the processing of energy assessments pursuant to § 9a (1) (a), (b) or (c) of the Act
(1) The assessment shall be carried out by comparing the planned construction of the new installation or the planned substantial reconstruction of the existing installation (variant 1) with the comparator with the waste heat recovery system and the supply of heat from high-efficiency cogeneration or the heating supply system or from industrial plants (variant 2).
(2) Where the construction of a new plant for separate generation of electricity or a plant without waste heat recovery is planned, a comparison shall be made between the planned new plant or the planned reconstruction of the existing plant and the comparator plant which produces the same amount of electricity or heat but has a waste heat recovery system and provides heat through high-efficiency cogeneration or heat supply systems. In doing so, any appropriate existing or potential location of heat demand shall be considered with regard to technical feasibility and distance from the installation concerned.
1. Geographical and systemic delimitation of the area
The bordering of the area to be addressed shall include the planned installation and the geographical area containing the location or places of demand for heat and cold supplies, the existing and planned heat supply infrastructure and future heat and cold demand.
The border of the area shall be marked on an appropriate scale and form of a cadastral map of the area concerned.
Existing source, distribution and consumer facilities are indicated in the area.
2. Determination of the default level
Data on the planned installation and the comparison device shall be summarised according to the models of the starting level tables for each of the two variants:

3. Procedure for establishing cost-benefit options
3.1. The cost-benefit analysis shall be based on a description of the planned installation and of the comparator or comparator installations and a comparison of the total cost of providing heat and electricity for these two variants. In the area addressed, it also includes costs that would arise if a group of buildings or a part of a municipality were equipped with a new district heating network or connected to a new district heating network, i.e. infrastructure costs for both planned and comparative facilities are included in the comparison.
3.2 A description shall be made for each variant containing the essential characteristics of the operation, in particular the installed thermal and electrical power, the type of primary energy source, the intended use, the planned annual number of operating hours, the location and demand for electricity and heat. If there is more than one planned installation within the system, the description shall be made for each installation. The model tables referred to in point 2 shall be used mutatis mutandis for the specification of the data.
3.3 For the comparison of variants, specifications shall be made for capital costs for equipment and equipment, capital costs for related energy networks, variable and fixed costs, energy costs, environmental and health charges, determination of heat energy demand, determination of environmental effects and determination of production effects.
3.4 The economic assessment shall be carried out in accordance with Annex 8 to this Decree. Where the same manufacturing effect of the comparable variants is ensured, it may be performed as cost. The same production effect is considered to be the same heat and electricity demand in all solutions.
3.5 The overall results of the evaluation shall be carried out in the following tables:

4. Recommendation of the energy specialist entitled to process the energy assessment
4.1 Based on the cost-benefit analysis of variants, a variant whose sum of discounted benefits is higher than the sum of discounted costs of other variants is recommended.
In the case of a cost assessment, a variant with the lowest discounted sum of costs is recommended.
4.2 The recommendation of an energy expert authorised to process the energy assessment includes the recommended option, including the specification of the marginal conditions for its implementation.

5. Material for energy assessment
5.1 The energy assessor shall provide the energy specialist with the basic data on the planned equipment and the data on the existing system needed to determine the starting level.
5.2. In the absence of certain data on the existing system, a commented expert estimate shall be used. The data thus used shall be referred to as "expert estimate '.
5.3 The territorial plan of the municipality or municipalities concerned is the basis for determining the planned development in the area covered by the scheme.

Procedure for the processing of an energy report pursuant to § 9a (1) (d) and § 9a (2) (c) of the Act
The energy report shall contain the following details, including the annexes referred to in point 8.
(1) The energy assessment plan, defining the criteria of the support programme to the following extent:
(a) the name of the support programme;
(b) the specification of the priority axis and the substantive orientation of the call;
(c) the definition of the criteria of the support programme in relation to the subject matter of the energy assessment.
2. History of energy consumption
The history of energy consumption shall contain measured and accounting evidence showing the history of energy consumption of the existing energy economy or its integrated part, directly linked to the implementation of the project under consideration, which shall be affected or not otherwise required by the support programme. Information on the history of consumption shall include:
(a) data on energy consumption and related operating costs, determined on the basis of verifiable accounting documents in accordance with Table 1 and processed for at least two previous calendar years or 24 consecutive months;
(b) all inputs of energisers (3) determined on the basis of measured and verifiable accounting documents of the energy economy or its integrated part, which include the energy consumption of the whole energy assessment subject and are as close as possible to or equal to the limits of the energy assessment subject;
(c) the scheme of the included measuring points broken down by energes3) and their relationship to the boundaries of the energy assessment subject.

Notes:
1) In the absence of measured and identifiable accounting documents, Table 1 is not processed.
2) The history of energy consumption is processed at monthly intervals or for the corresponding billing period. In the absence of such more detailed data, only annual totals rows shall be reported. The table shows the sum of the energy from all sampling sites by energesonteles3) and the list of identifiers of each sampling point.
3. Analysis of energy use of energy of the energy assessment subject
(1) As part of the analysis of the energy use of the energy assessment object, the existing state of energy consumption of the energy assessment object is created, which is based on the actual use of the energy assessment object in the reference period under the preceding paragraphs, Table 1. The current state is then converted by the standardisation method to the default state, which serves as a basis for comparing energy performance before and after the implementation of the project. Priority shall be given to the year -1. A different period can only be chosen if this period is more in line with the typical use of the energy assessment subject and is more suitable for quantifying the benefits of the project. If there is no documented history of energy consumption as defined in point 2, the existing status section of Table 2 shall not be completed.
The default state of energy consumption is used to compare energy performance before and after implementation of the project under the same conditions of relevant variables. It shall be determined on the basis of:
(a) the current state of energy consumption of the energy assessment object, which may be adjusted under the different items of the use analysis by normalising relevant variables (e.g. climate data, requirements for a uniform level of internal environment quality, number of products, typical usage profile, etc.) in accordance with the support programme guidelines; or
(b) the reference status of the defined support programme.
(2) The self-analysis of the energy use of the energy assessment article shall then be carried out in the range specified in Table 2. It also contains a description of how the current state of energy consumption of the energy assessment article is to be allocated in relation to the history of measured energy consumption, which can be demonstrated by accounting documents, to the extent:
(a) the definition of relevant variables that affect the energy consumption of an energy assessment subject and serve to normalise the values of the consumption history that generate the baseline energy assessment status; or
(b) a description of the method of quantification of the starting state where it is different from the current state which is based on normalisation of relevant variables and adjustment of current state consumption; or
(c) a description of the method of quantifying the initial state of the energy assessment subject according to the terms of the support programme.

Note:
1) The breakdown and detail of the analysis according to how energy / appliances are used shall comply with the requirements of the support programme. If the details of the support programme are not defined, the energy specialist shall define it in such a way as to take into account the specificities of the energy assessment subject and be reasonably detailed, consistent and transparent in relation to the form of energy use and subsequent energy management evaluation.
4. Description and evaluation of the proposed status
The description and evaluation of the proposed situation shall be given in detail and scope corresponding to the requirements of the support programme and shall include:
(a) the technical specification of the proposed sub-measures and the description of the project as a whole; This means a description of the proposed state of the energy assessment subject, including a technical specification of the parameters determining compliance with the criteria of the support programme,
(b) the balance sheet of the project's benefits as set out in Table 3;
(c) a proposal for an appropriate addition of measuring points and a way of assessing the benefits of the project implementation;
(d) a description of the way in which these measuring points and processes are included in the energy management system according to the previous paragraph of the energy assessment subject, according to the harmonised technical standard governing the energy management system ČSN EN ISO 50001, if it is implemented and certified by the accredited person;
(e) in the case of a requirement of the support programme, an analysis of the energy efficiency of selected appliances of the energy assessment article for the proposed condition in accordance with Table 4;
(f) an assessment of compliance with the requirements of Section 7 of the Act, if the energy assessment is the building to which those requirements apply.

Note:
1) The details of the breakdown of the energy use analysis shall comply with the requirements of the support programme. If the detailed breakdown of the support programme is not established, the energy specialist shall define it in such a way as to take into account the specificities of the energy assessment subject and to be reasonably detailed, consistent and transparent in relation to the form of energy use and subsequent energy management evaluation. The breakdown and detail of the data in the table shall be given in accordance with Table 2.

5. Criteria for the support programme
The programme criteria shall be set out in detail and scope corresponding to the requirements of the support programme and shall include:
(a) an overview of the fulfilment of the criteria set out in Table 5, including an indication of the input values in the calculation and the method for determining them;
(b) an overview of the fulfilment of other specific conditions laid down in the support programme, where required by the aid programme.
