DECLARATION
of 19 March 2004
amending Decree No. 22 / 1989 Coll., on safety and health at work and safety at operation in mining and mining activities in underground as amended
The Czech Mining Authority provides pursuant to Sections 5 (3) and 6 (6) (a) of Act No. 61 / 1988 Coll., on Mining Activities, Explosives and State Mining Administration, as amended by Act No. 542 / 1991 Coll.:
Čl. I
Decree No. 22 / 1989 Coll., on the Safety and Health at Work and the Safety of Operation in Mining and Mining Activities in Underground, as amended by Decree No. 477 / 1991 Coll., Decree No. 340 / 1992 Coll., Decree No. 3 / 1994 Coll., Decree No. 54 / 1996 Coll., Decree No. 109 / 1998 Coll., Decree No. 434 / 2000 Coll. and Decree No. 330 / 2002 Coll., are amended as follows:
1. In Article 1, the words "in accordance with the law of the European Communities' shall be inserted after the words" laid down '.
footnote (1b) is replaced by the following:
"(1b) Council Directive 92 / 104 / EEC on minimum requirements for improving the safety and health of workers in the surface and deep mining industry."
2. in Article 2 (1) (a) and (b):
'(a) the burden of excessive weight on an article weighing more than 3000 kg;
(b) the burden of excessive dimensions of an object whose transport or handling is not possible to meet the road gaps laid down in this Decree; ';
3. In the first sentence of Paragraph 69 (1), "six months' is replaced by" two years'.
4. Paragraph 240 (4) (f) is deleted.
Point (g) shall be renumbered as point (f).
5. in Paragraph 241 (1), including footnote 52a):
"(1) The organisation shall designate for each operated mine with an electrical equipment for the control of the assembly, operation and maintenance of electrical equipment a person who, in addition to the qualification requirements of the special legislature52a) for the fluent mine of higher education obtained in the master's study programme in the field of technical sciences and technology with a focus on electrical engineering.
52a) Paragraph 9 (6) of Decree No 75 / 2002 Coll., on the safety of the operation of electrical technical equipment used in mining and mining activities. '.
6. Paragraph 288 (1) is deleted.
Paragraphs 2 and 3 shall be renumbered paragraphs 1 and 2.
7. Paragraph 314, including the title, reads:
„§ 314
Transport loads of excessive weight or loads of excessive dimensions
(1) The transport and handling of excessive weight or weight loads by hand or skid may be carried out only by personnel with at least two years' transport experience according to the processed operational documentation approved by the factory mine. That mode of transport may be carried out only in the presence of technical supervision.
(2) Machinery for the transport of loads of excessive weight or loads of excessive dimensions according to the transport rules approved by the factory mine may only be carried out by workers with at least two years' experience in transport.
(3) Before handling and transporting the burden of excessive weight or burden of excessive dimensions, the designated worker shall examine the equipment intended to handle and transport the burden of excessive weight or burden of excessive dimensions, whether it corresponds to the operational documentation and not damaged. The result will be recorded.
(4) Before transporting the load of excessive weight or the load of excessive dimensions, the designated worker shall carry out a transit check. The result of the check will be recorded.
(5) The operational documentation referred to in paragraph 1 and the transport rules referred to in paragraph 2 shall contain conclusions from the assessment of the transport load of excessive weight or load of excessive dimensions and elements of the road, in particular from the point of view of the loading capacity of the ground used for transport as a means of transport, the inclination of the road, the weight and dimensions of the load, the stability of the load with regard to the location of its centre of gravity during transport, the assessment of the required loading area of the means of transport and the method of fixing the load, to such an extent as to prevent the undesirable movement of the load, tipping or overturning.
(6) Where transport and handling of excessive weight or excessive size loads are carried out, no other activity shall be carried out. ';

This Decree shall take effect on 1 July 2004.
