of 23 October 1968
on work allowances and economic security for learners at work
According to § 126 (3) of the Labour Code No. 65 / 1965 Coll., the Ministry of Education provides:
§ 1
Scope
(1) This decree provides for work relief and economic security for workers, members of single agricultural cooperatives and members of production cooperatives, studying at work at Czechoslovak educational establishments or courses in order to obtain a certain degree of education or to extend or deepen the degree of education or professional qualifications achieved.

Work relief
§ 2
Working allowances for students in secondary education, secondary schools for workers, vocational schools, secondary vocational schools, corporate technical schools and conservatories
The organisation shall provide the students at secondary education schools, secondary schools for workers, vocational schools, secondary vocational schools, corporate technical schools and conservatories with leave to the following extent:
(a) 3 hours per week, with compensation for salary, except for nurseries and kindergarten teachers, who are entitled to 2 hours per week from direct education work (from the normal level of teaching duty) and other teachers who are entitled to 1 hour per week from the normal level of teaching;
(b) 3 days with compensation in the school year for preparing and carrying out tests;
(c) 3 days without compensation in the school year to participate in study centres (laboratory exercises, practices, practices) if they are part of the curriculum;
(d) preparation and performance of the graduation examination (final artistic examinations)
1. 20 days (10 days for graduates with full secondary education) without compensation of salary, provided that vocational graduation is part of the final examination;
2. 10 days without compensation of salary, unless part of the graduation exam is professional graduation.
§ 3
Work relief for students at corporate institutions and in higher years of conservatory *)
The organisation shall provide study staff at business institutes and senior year conservatories with leave of absence to the following extent:
(a) 3 hours per week with compensation for salary, except for educators who are entitled to 2 hours per week from direct education and teachers who are entitled to 1 hour per week from the normal level of teaching;
(b) 5 days with compensation for salary in each school year for preparing and carrying out tests;
(c) 5 days without compensation in the school year to participate in laboratory exercises (practices) if they are part of the curriculum;
(d) 20 days (teachers 10 days) with compensation for the salary for preparing and performing the final examination and defending professional work.
§ 4
Work relief for students in universities
The organisation shall provide university students with leave of absence with compensation to the following extent:
(a) 12 days in each school year for evening and external studies, with the exception of teachers to whom 1 hour per week is due from the normal level of teaching;
(b) 14 days per school year for long-distance studies with the exception of teachers to whom 1 hour per week is due for a normal degree of teaching;
(c) 2 days to prepare and carry out each test;
(d) 5 days in the school year to participate in the study centres if they are part of the curriculum;
(e) 80 days for the preparation and performance of the national final examination, except for teachers who have 60 days; teachers - participants other than two subjects, 20 days.
§ 5
Working allowances for course participants
The organisation shall provide course participants with a period of work with compensation to the following extent:
(a) courses which have at least 400 teaching hours per year or 160 consulting hours in a remote studio;
1.2 hours per week except for teachers,
2 days for the preparation and completion of final examinations;
(b) in courses for managers of at least 6 months;
1. 7 days per 6 months for study, consultation, laboratory exercises and concentration,
2.5 days for preparation and completion of the final examination;
(c) in courses of supplementary pedagogical studies
1. teachers of professional subjects
2 days to prepare and carry out each test,
5 days to concentrate if it is part of the curriculum;
2. masters of training
2 hours a week,
2 days to prepare and carry out each test,
5 days to concentrate if it's part of the curriculum.
§ 6
Work relief for participants in the graduation course
In the post-graduate course, which has at least 400 teaching hours per year or 160 consulting hours during the long-distance study, the organisation shall provide a period of leave of three hours per week for the study to replace the salary and to prepare and perform the examinations for each school year for three days.
§ 7
Working allowances for post-graduate students
(1) The organisations shall provide post-graduate students, with the exception of teachers, with paid leave to the following extent:
a) in the daily form of postgraduate studies
1. for the duration of teaching, but not more than 75 days,
2.2 days for the preparation and execution of each test,
3.10 days for preparation and completion of the final examination;
(b) in other forms of postgraduate studies
1. 24 days in the school year for study, consultation and laboratory exercises,
2.2 days for the preparation and execution of each test,
3.5 days in the school year to participate in the study centres,
4.10 days to prepare and perform the final examination.
(2) In all forms of post-graduate studies, the organisations shall provide the teachers with leave of absence with compensation to the following extent:
(a) 1 hour per week from the normal level of teaching;
(b) 2 days to prepare and carry out each test;
(c) 10 days for the preparation and completion of the final examination.
§ 8
Other work relief
(1) Women who care for at least one child under 15 years of age who are entitled to leave under § 2, 3, 4, 6 or 7, except for the daily form of post-graduate studies, are entitled to additional leave with a salary of 5 days in the school year.
(2) In order to carry out an external graduation examination, the organisation shall provide leave without compensation for wages to the extent set out in Section 2 (d); it shall also provide leave without compensation for wages to the extent necessary to carry out the entrance examinations (interviews).
§ 9
Drawing of work relief
(1) Working leave
(a) the number of hours that a student may draw per week may, in agreement with the organisation, be added up and used for a maximum period of 4 weeks and at secondary agricultural and forestry technical schools in the same school year;
(b) a number of days may not be drawn after hours without the approval of the organisation;
(c) provided in long-distance and external studies can be drawn throughout the school year, including the period of main holidays, in evening and exchange studies outside the main school holidays and in courses only during the course.
(2) Unspent leave may not be transferred to another school year, except for the leave provided for the preparation and performance of the graduation examination, the state final examinations and the leave granted in the post-graduate course.
§ 10
Recruitment of work allowances during incapacity and leave
(1) Working leave
(a) is interrupted by the recognition of incapacity for work or, where appropriate, by the quarantine regulations at the time when the student receives the allowance; If the student receives a contribution (§ 12), his payment shall be suspended;
(b) it is for the student to have a fixed number of hours for a week in which he has not worked during a specified working week for an obstacle to work, in which he is entitled to compensation for wages or physical security under sickness insurance rules; if the obstacle to work persists continuously for more than 4 weeks, it shall be entitled to leave for a maximum of 4 weeks.
(2) It is not for the student to take a full leave of time, but it is for the student to take a full leave in a week in which he has chosen up to two working days.

Economic security
§ 11
Compensation of wages
(1) The remuneration for the period of leave is paid at the rate of the average earnings (Section 275 of the Labour Code).
(2) The costs of compensation for the salary provided during the period of leave shall be borne by the organisation.
§ 12
Study contribution
(1) During the period of leave without compensation of the salary provided for in this decree, including the period provided for in Paragraph 8 (2), the organisations which study at work shall grant a study allowance.
(2) The study allowance shall be at least:
u ženatých (vdaných), ovdovělých, rozvedených a svobodných, kteří mají vyživovací povinnost alespoň k jednomu dítěti 68 Kčs,
u ženatých (vdaných) bezdětných 55 Kčs,
u svobodných, ovdovělých, rozvedených, kteří nemají vyživovací povinnost k dítěti 34 Kčs.
(3) The amount of the study allowance may not exceed the amount of the average earnings. The costs of the study allowance shall be borne by the organisation.
§ 13
Meals
At the time of study camp and during the final examinations, students are entitled to meals in school canteens and menses under the same conditions as students in daily studies. *)

Common provisions
§ 15
Adjustment of working time
The organisation will enable students to adjust their working conditions appropriately, in particular by scheduling working time, to fulfil all the obligations associated with the study and will not, as far as possible, order them to work overtime.
§ 16
Work relief at shorter working hours
Students with less than a specified weekly working time (Section 86 of the Labour Code) are not entitled to work leave fixed by the number of hours per week and, when studying in universities, to work leave provided for in Section 4 (a), (b).
§ 18
Extension of work allowances and economic security
Organisations may, in cases justified by their cadre needs or the needs of a student who is worthy of special consideration, grant higher or additional work allowances and economic security than those laid down in this Decree. However, the remuneration cannot exceed the average earnings of the student (Section 275 of the Labour Code), the reimbursement of travel and other expenses linked to the study corresponding to the applicable rules. Before its decision, the organisation shall seek the opinion of the race committee of the basic organization of the Revolutionary Trade Union Movement and the relevant educational establishment.
Transitional and final provisions
§ 19
This decree shall not apply:
(a) to healthcare professionals who, when working, are trained in health education establishments;
(b) to participants in the study while working at medical faculties for the period of daily study, * *)
(c) professional soldiers and members of the armed corps of the Ministry of Interior;
d) to a student in a scientific or artistic aspiration, * * *)
(e) to participants in vocational training organised in the form of short-term boarding camp. †)
§ 20
They shall be deleted:
(a) Decree of the Ministry of Education and Culture No 94 / 1966 Coll., on work allowances and economic security for students at work,
b) Decree of the Ministry of Education and Culture of 14 February 1961 No 7354 / 61-III / 5 on the physical security of faculty listeners - Institute of National Economic Planning at the University of Economics in Prague,
(c) Decree of the Ministry of Education and Culture of 20 July 1961 No 35 120 / 61- III / 5 extending the Decree of the Ministry of Education and Culture of 14 February 1961 No 7354 / 61- III / 5 to the Faculty - Institute of National Economic Planning at the University of Economics, Bratislava.
§ 21
(1) The work allowances and economic security of students at work are governed by this decree in each organisation, starting from the date on which the weekly working time has been reduced to the length referred to in point 1 of Decree No. 63 / 1968 Coll., on the principles for reducing weekly working time and for implementing operational and working arrangements with a five-day working week; up to that time, the adjustment still in force shall be followed.
(2) This Decree takes effect on 1 November 1968.
