DECLARATION
Ministry of Education and Culture
of 17 June 1964
on compulsory and work copies
The Ministry of Education and Culture shall, in agreement with the Ministries of Consumer Industry and Foreign Trade, the Central Administration of Communications, the Central Administration of Geodesy and Cartography and other participating central offices, provide for the publication and dissemination of books, music and other non-periodic publications pursuant to § 2 of Act No. 184 / 1950 Coll., the publication of magazines and the Union of Czechoslovak Journalists, and under § 3 (5) of Act No. 53 / 1959 Coll., the uniform system of libraries:

ČÁST I

Basic provisions
§ 1
(1) This Decree applies to printed matter (paragraph 2) which is issued by:
(a) in the Czechoslovak Socialist Republic,
b) abroad, if publishing house (publisher) has its seat in the Czechoslovak Socialist Republic.
(2) The printed matter under this Decree is:
(a) printing machinery *) copies made for public dissemination (including commercial and special purpose publications)
(aa) literary, scientific and artistic works, in particular books, music and reproduction of works of art and photography;
(bb) cartographic works;
(cc) curriculum and two-dimensional teaching aids,
(b) newspapers, journals and other copies issued at least twice a year under the same name and in an approved programme and adaptation typical of magazines (hereinafter "newspapers and magazines");
(e) other copies intended for public dissemination, as determined by the Ministry of Education and Culture in agreement with the Ministry of Consumer Industry and the central authorities involved.
(3) Printed matter under this Order shall not be regarded as:
(a) copies taken in a load up to 100 copies, except for the bibliophile edition of literary or artistic works;
(b) official files and parts thereof, including circulars of directives and guidelines issued by organisations under their jurisdiction, in so far as they are not periodic collections of regulations,
(c) copies which serve exclusively economic and social needs, such as forms, blankets, family announcements, visits, decals, labels, stickers, etc.,
(d) copies serving exclusively the operational needs of organisations;
(e) securities and securities of all kinds,
(f) phonocards,
(g) copies of copies printed with a blind print;
(h) authors' copies of graphic sheets and music;
(i) press agencies' intelligence material;
(j) plastic and wall maps and maps for economic construction;
(k) separate fingerprints (separates) of glee club and magazine articles and stables,
(l) copies of theatrical games acquired exclusively for stage operation, unless they are intended for expansion also through book trade.
§ 2
(1) For each issue of a printed matter with the exception of newspapers and magazines, a maximum of 150 copies (so-called overprint) may be reprinted over the specified cargo, except for copyright, to fulfil the obligation under Part II (copies required) and for the purposes of Part III (copies working) of this Order.
(2) For newspapers and periodicals, the maximum number of copies which can be reprinted as mandatory, work and author's, the annual title plan.
(3) Prints from overprint are unsold and no copyright fee is provided.

ČÁST II

Compulsory copies
§ 3
(1) After two compulsory copies of all printed matter, in the case of single-leaf copies of works of art and photography, including postcards, but only after one compulsory copy, it is submitted
a) State Library of the Czechoslovak Socialist Republic in Prague,
b) The Slovak matrix in Martina and
c) University Library in Bratislava.
(2) The Czechoslovak headquarters of the book culture in Prague
1. printed matter issued by organisations having their seat in the Czech regions,
(a) two compulsory copies of newspapers and journals and two-dimensional teaching tools;
(b) one compulsory copy of the printed matter intended exclusively for export and copies of works of art and photography, including postcards;
(c) five compulsory copies of all other printed matter;
2. printed matter issued by organisations based in Slovakia
(a) one compulsory copy of newspapers and journals, printed matter intended exclusively for export and copies of works of art and photography, including postcards;
(b) two required copies of all other printed matter.
(3) The Slovak head office of book culture in Bratislava is committed
1. printed matter issued by organisations based in Slovakia
(a) two compulsory copies of newspapers and journals,
(b) one compulsory copy of printed matter intended exclusively for export, copies of works of art and photography, including postcards and two-dimensional teaching aids;
(c) three compulsory copies of all other printed matter;
2. one compulsory copy, with the exception of printed matter intended exclusively for export, of printed matter issued by organisations located in the Czech regions.
(4) After one compulsory copy of all printed matter, except:
(a) single leaf copies of works of art and photography, including postcards;
(b) curricula, two-dimensional teaching aids and interim teaching texts (scripts) reproduced only for the needs of individual schools; and
(c) regional and district newspapers and racing journals,
is further surrendered
1. State Scientific Library in Pilsen,
2. Regional Library in České Budějovice,
3. Václav Kopecký Library in Liberec,
4. State Scientific Library in Hradec Kralove,
5. State Scientific Library in Brno,
6. State Scientific Library in Olomouc,
7. State Scientific Library in Ostrava,
8. Regional Library in Banska Bystrica,
9. State Scientific Library in Košice,
10. Basic Library of the Czechoslovak Academy of Sciences in Prague and
11. Central Library of the Slovak Academy of Sciences in Bratislava.
(5) The beneficiaries referred to in paragraph 4 (1) to (9) shall also be surrendered after a compulsory copy of the regional and district newspapers and racing journals issued in the territory of the respective region.
(6) One compulsory copy of all newspapers and magazines (including regional and district newspapers and racing journals), as well as all book publications and music, with the exception of agricultural, technical, medical and educational literature, is also submitted to the library of the National Museum in Prague.
(7) One compulsory copy of all book publications and music is handed over to Czechoslovak theatre and literary management in Prague.
(8) After one compulsory copy of the printed matter from the relevant fields is submitted
1. National Assembly Library in Prague,
2. State Technical Library in Prague,
3. Slovak Technical Library in Bratislava,
4. State Education Library in Prague,
5. Slovak pedagogical library in Bratislava
6. State Library of CSSR - Central Economic Library in Prague,
7. Central Economic Library in Bratislava,
8. State Medical Library in Prague,
9. Central Medical Library in Bratislava,
10. Central agricultural and forestry library in Prague,
11. Central Agricultural Library in Nitra and
12. Library of the Ministry of Education and Culture in Prague;
the specialization of printed material is determined by thematic groups of scientific and technical literature of Czechoslovak headquarters of book culture. It is also submitted to those libraries after one compulsory copy of the specialised newspapers and journals in their field of specialisation if they are requested (Section 5 (2)).
(9) Compulsory copies referred to in paragraphs 4 and 8, other than newspapers and periodicals, shall not be surrendered to printed matter intended exclusively for export, with the exception of the State Scientific Library in Brno (paragraph 4 (5)), which shall be sent after one copy and from such printed matter.
(10) One mandatory copy of newspapers and magazines is submitted
(a) in the case of district newspapers and racing journals, the relevant district prosecutor, *)
(b) in the case of regional newspapers of the relevant Regional Prosecutor, *)
and three copies of other newspapers and magazines of the General Prosecutor's Office in Prague.
(11) One compulsory copy of the district newspapers and racing magazines is submitted to the relevant district library.
(12) One compulsory copy of newspapers and magazines published on the territory of the capital city of Prague, including regional and district newspapers and racing magazines, shall be submitted to the Prague Capital Archive; One compulsory copy of newspapers and magazines published in the district of Bratislava-town is submitted to the Regional Library of Bratislava.
(13) One compulsory copy of all racing magazines is submitted to the All-Trade Archive of the ÚRO in Prague.
§ 4
(1) Compulsory copies shall be submitted from each number and issue of newspapers and journals and from each issue of other printed matter. When the publication of literary works in the field of beautiful literature is carried out gradually from unchanged printing forms (print), compulsory copies to the extent provided for in Section 3 shall be submitted only once; However, if the print is printed separately, only the State Library of ČSSR, the Slovak Matrix in Martina and the University Library in Bratislava will be submitted from each print after two compulsory copies.
(2) If the printed matter is published simultaneously in several language versions, it shall be submitted to the recipients referred to in § 3 (1) to (3) of the prescribed number of compulsory copies from the first version, from the next copy only after only one copy, except for the production of publishing houses under the responsibility of the Ministry of Foreign Trade, from which it is submitted after one copy from all other versions only the State Library of the Czechoslovak Socialist Republic in Prague; Only one language version is always submitted to other recipients, the most accessible language.
(3) The Czechoslovak head office of the book culture determines which other recipients are to be handed over to compulsory copies of printed matter; as regards the works of cartography, they shall do so in agreement with the Central Administration of Geodesy and Cartography. However, the other recipients of the compulsory printed matter produced by the publishing house under the responsibility of the Ministry of Foreign Trade shall be determined by the Ministry.
§ 5
(1) Compulsory copies of all printed matter, if reproduced in the Czechoslovak Socialist Republic, are sent by the State Library of ČSSR in Prague, the Slovak Matrix in Martina and the University Library in Bratislava [§ 3 (1) (a) to (c)], with the exception of foreign language printed matter, newspapers and magazines, printer, together with the sending of the first copies. In agreement with the Ministry of Education and Culture, the Ministry of Consumer Industry will determine which other recipients will be required to send copies to the printer.
(2) Compulsory copies of newspapers and periodicals are sent to authorised beneficiaries at the start of the expansion of the Postal News Service, responsible for the place of issue, provided that the Postal News Service expands such newspapers and magazines; to the recipients referred to in Article 3 (8), the postal newspaper service shall send the compulsory copies of newspapers and journals only if it applies its request in due time.
(3) Other mandatory copies of all printed matter, including the production of publishing material under the responsibility of the Ministry of Foreign Trade, printed printed abroad, and newspapers and magazines which will not be sent by the Postal Newspaper Service pursuant to paragraph 2, shall be sent to the publishers at the latest at the same time as the publication is started.
(4) Compulsory printed matter must be impeccable. If the load contains partially bound copies, the copies must be sent together.
(5) Compulsory copies shall be sent to the beneficiaries free of charge and free of charge for cargo and from the publishing paper balance sheet quota (publisher).
(6) Where a compulsory copy is not sent to the authorised consignee no later than 10 days after the date on which it was initiated for the public dissemination of the printed matter, the consignee may affix it to the cargo of the organization which is obliged to supply the copy; However, undelivered copies of newspapers and magazines must be made available as soon as the following number is received.
(7) Libraries conferring the right to a compulsory copy under this Decree are required to use it for conservation, study or bibliographic purposes in accordance with their mission.

ČÁST III

Working copies
§ 6
(1) Prints of printed matter which, out of the total overprint provided for in Section 2, will not be used as copies mandatory are authorised to use the publishing house (publisher) as working copies, namely:
(a) review, literary criticism, members of the Editorial Councils and evaluation,
(b) for promotion and for domestic and foreign exhibitions,
(c) exchange with other Czechoslovak and foreign organisations,
(d) to provide export needs and for foreign agents;
(e) for the management of the publishing house (publisher) and for workers who are directly involved in the creation of printed matter or printed matter necessarily need to perform their duties;
(f) for the superior body of the publishing house (publisher), if it is not the Czechoslovak (Slovak) headquarters of the book culture,
(g) archival and documentary purposes.
(2) The award of working copies for the purposes referred to in paragraph 1 shall be decided by the head of the publishing house (publisher).

ČÁST IV

Common and final provisions
§ 7
(1) Printers are required to send by the fifth day of each month statements of printed matter printed in the previous month, with the exception of newspapers and magazines, the State Library of ČSSR in Prague, the Slovak Matrix in Martina, the University Library in Bratislava and the Czechoslovak Headquarters of the Book Culture. The publishing houses shall be required to send lists of printed matter to the same recipients and within the same time limit, except for newspapers and journals which they have published in the previous month.
(2) The publishing house (publisher) is required to keep an operational record of the compulsory and working copies, which must show to whom and when the copies have been submitted and to ensure that the duties under this Decree are properly carried out.
(3) The Director of the Czechoslovak head office of the book culture is entitled to reduce the scope of overprints in accordance with § 2 or, in individual cases, to allow its increase.
§ 8
(1) The right to send compulsory copies to recipients, to whom it was not sent under Decree No. 45 / 1963 Coll., on compulsory and work copies, and under directives issued for its implementation, may be applied to newspapers and magazines only from the first issue of the new year following the entry into force of this Order.
(2) Paragraph 16 of the Decree of the Central Administration of Geodesy and Cartography No 156 / 1957 Ú. l, on the reporting of geodetic and cartographic works, the submission of elaborates of such works, the publication and reproduction of cartographic works, remains unaffected.
(3) In agreement with the competent central authorities and authorities, the Ministry of Education and Culture, which may also issue guidelines for its implementation, shall, where justified, authorise derogations from the provisions of this Decree.
(4) Decree No 45 / 1963 Coll., on compulsory and working copies, and the Directive for its implementation, are hereby repealed.
(5) This Decree shall take effect on 1 July 1964.
