Czech National Council
of 20 December 1992
on industrial property protection measures
The Czech National Council decided on this law:
OFFICE OF INDUSTRY
(1) The Industrial Property Office ("the Office") is the central body of the State Administration for the Protection of Industrial Property of the Czech Republic.
(2) Prague is the seat of the Office.
(3) The Office shall be headed by a President appointed and dismissed by the Government; its selection, appointment and appeal are governed by the Civil Service Act.
Office
(a) decide on the granting of protection for inventions, designs, utility models, topography of semiconductor products, trade marks and designations of origin of products;
(b) carry out activities according to the rules on patent agents, 1)
(c) runs the central fund of world patent literature.
TRANSITIONAL PROVISIONS
(1) The procedure for applying for discovery applications which did not end before the entry into force of this Act is terminated.
(2) Applications for inventions and industrial designs, (2) utility models, (3) topographies of semiconductor products, (4) designation of origin of products5) and trade marks, (6) which have not been decided on before the entry into force of this Act, the Office will discuss it in accordance with the existing rules.
(3) The legal acts taken in proceedings before the Federal Office of Inventions, as well as the legal acts applicable under the existing provisions which took place before the entry into force of this Act, shall continue to apply, unless otherwise provided for in that law.
Authorised certificates and patents for inventions, certificates and patents for industrial designs, registration of industrial designs, utility models, topographies of semiconductor products, designation of origin of products and trade marks in registers, if applicable on the date of application of this Act, remain in force in the Czech Republic under the current regulations.
The procedure for the revocation of a patent or a copyright certificate on the invention, the deletion of an industrial design, a utility model, a topography of a semiconductor product and a trade mark from the register, the application for withdrawal of protection by a utility model or a topography of a semiconductor product, the determination of whether the solution described in the application falls within the scope of a patent, a copyright certificate or a utility model, or whether the external treatment of the product falls within the scope of a registered industrial design, the grant of a compulsory licence for the invention, a utility model or the topography of a semiconductor product which did not end before the entry into force of this law, are further in the proceedings under the existing rules.
FINAL PROVISIONS
This Law shall take effect on 1 January 1993.
