setting up and repealing research institutes, technical development departments and research and experimental centres.
The National Assembly of the Czechoslovak Republic decided on the following Act:
Research institutes and technical development services of central offices and voluntary organisations.
§ 1.
(1) Ministers and heads of central offices may establish and abolish in their field of competence:
(a) research institutes (after experimental competitions);
(b) technical development services, which are test and control institutes, documentation institutes and experimental (development) enterprises.
These measures can only be taken with the approval of the Government, which is stated after the State Office of Planning, the Ministry of Finance, the Czechoslovak Academy of Sciences and those central offices whose competence is affected by the Institute or department.
(2) In exceptional cases, branches of research institutes and technical development departments may also be established, but only outside the headquarters of such institutes and departments; the provisions of paragraph 1 shall apply mutatis mutandis.
(3) Voluntary organisations may establish and abolish their research institutes and branches as referred to in paragraphs 1 and 2.
§ 2.
(1) The research institutes and technical development services of central offices are, with the exception of experimental (development) enterprises, budgetary organisations and form separate organisational units within the relevant department.
(2) Experimental (development) enterprises are national enterprises.
§ 3.
(1) The detailed definition of the field of activity and the organisational structure of the different research institutes and technical development services of the central offices and their components (Section 2 (1)) shall be laid down by the competent minister or head of the central office in the framework of the systemisation of those institutes and departments; the organisation rules of research institutes of voluntary organisations shall be issued by the senior body of the organisation concerned.
(2) Scientific or technical advice shall be established in research institutes and technical development services; their composition and competence, as well as the status of their members, shall be adapted to the principles laid down by the Government in the Organisational Regulations issued pursuant to paragraph 1.
§ 4.
Research and experimental (development) workplace of central offices.
(1) Ministers and managers of central offices may establish and abolish research and experimental (development) workplaces and design development offices in subordinate undertakings, where this is strictly necessary for the fulfilment of the research and development plan.
(2) The workplaces referred to in paragraph 1 are part of the undertaking in which they are established.
§ 5.
Research institutes and laboratories of scientific academies and universities.
(1) The Czechoslovak Academy of Sciences and the Slovak Academy of Sciences set up research and research institutes after consultation with the State Office of Planning and with the Ministry of Finance and with the approval of the Government, as expressed for the Slovak Academy of Sciences, on the proposal of the College of Authors.
(2) Paragraph 1 shall also apply to the laboratories of the Czechoslovak Academy of Sciences and the Slovak Academy of Sciences if they are to be established as self-planning units.
(3) In line with the needs of the development of individual scientific disciplines, relevant ministers may establish scientific and research institutes of higher education according to guidelines established by the Government. These workplaces are scientific institutes under Section 16 of Act No. 58 / 1950 Coll., on Higher Education.
(4) The research institutes of the Czechoslovak Academy of Agricultural Sciences and the research institutes subordinate directly to the Ministry of Education are subject to the provisions of § § 1 to 3.
Final provisions.
§ 6.
Ministers and managers of central offices (organisations) are required to organise research institutes, technical development departments and research and experimental (development) workplaces in order to ensure the greatest development of science and technology while maintaining economy and to ensure the rapid and effective implementation of their results.
§ 7.
This law does not apply to research institutes of national defence and interior ministries or to the Central Geological Institute.
§ 8.
(1) Act No. 261 / 1949 Coll., on the Organisation of Research and Technical Development, as amended by the Regulations amending it, is hereby repealed.
(2) Research institutes, technical development departments and research and experimental (development) workplaces established under Act No. 261 / 1949 Coll., as amended by Act No. 185 / 1950 Coll., are considered to be institutes, departments or workplaces established under that Act.
§ 9.
This Act shall take effect on the day of its publication; it shall be carried out by all members of the Government.
