Law on elections to national committees

on elections to national committees.
The National Assembly of the Czechoslovak Republic decided on the following Act:

Část I.

Election system.
§ 1.
Basic provisions.
(1) The working people send their best representatives to the national committees who are worthy to become their representatives and who guarantee that they will carry out their tasks properly.
(2) Elections to national committees are held on the basis of general, equal and direct voting rights by secret ballot.
General suffrage.
§ 2.
(1) All citizens of the Czechoslovak Republic who have reached the age of 18 on the day of the election, regardless of nationality, sex, religion, employment, residence, social origin, property conditions and former activities, have the right to vote in national committees.
(2) However, the right to vote shall not be exercised by persons who have been legally sentenced to the loss of civil rights for the period during which the loss of those rights takes place and persons who have been legally deprived of all or part of their capacity for mental illness.
§ 3.
Any citizen of the Czechoslovak Republic who has the right to vote may be elected to the National Committee and reached the age of 21 on the day of the election.
§ 4.
Members of the Armed Corps shall have the same right to vote and to be elected as all citizens.

Část II.

Election lists.
§ 5.
A list of voters.
(1) All citizens of the Czechoslovak Republic who have the right to vote are included in the electoral list according to their place of residence.
(2) Citizens who, after drawing up a list of voters, acquire or lose their voting rights shall be added to or withdraw from the list of voters.
(3) Each voter can only be entered in one voter list.
§ 6.
Creating voter lists.
(1) The electoral lists shall be drawn up by the local national committee's Board according to the constituencies.
(2) The list of voters from members of the armed corps who are housed in the group shall be drawn up by their master.
(3) Election lists are common for election to national committees of all grades.
§ 7.
Unloading voter lists.
(1) No later than 30 days before the election date, the Council of the local national committee shall draw up electoral lists so that citizens can consult them in official rooms. The Council of the local national committee shall inform citizens of the landing of the electoral lists in the usual manner.
(2) In municipalities with more than 5,000 persons on the electoral lists, the Council of the local national committee will arrange for a list of voters living in the house to be included in each house. In larger municipalities which do not reach 5,000 registered persons and which are determined by the Council of the District National Committee, the Council of the Local National Committee shall arrange for a list of voters who live in the House to be included in each house.
§ 8.
Objection procedure.
(1) Any citizen may, orally or in writing, draw the advice of the local national committee on errors and irregularities in the electoral list and propose a correction. The Council shall decide on the alert within 3 days and either make the appropriate correction in the electoral list or inform the complainant in writing of the reasons why the correction cannot be made.
(2) If the application is rejected, the citizen may submit it to the People's Court responsible under the constituency. The Court of First Instance shall act in due time after oral hearing by order. This decision is final. Otherwise, the general provisions of the Civil Code apply mutatis mutandis. According to the court's decision, the council of the local national committee will make a correction to the electoral list. Proceedings before a court shall not be subject to a judicial fee.
§ 9.
Voter ID.
Voters who, from the time when the electoral lists are unloaded to the election date, will move, as well as voters who, for serious reasons, will not be able to vote in the constituency in whose electoral list they are entered, will issue an election card at their request and remove it from the electoral list. The Voting Card authorises the entry on the list of voters in another constituency. The minutes shall be carried out by the Board of the local national committee of new residence (place of residence), on the day of the elections by the District Election Commission. On entry, the voter card is withdrawn and added to the voter list.

Election circuits and election committees.

Oddíl 1.

General provisions.
§ 10.
Election circuits.
(1) Elections to national committees are held according to the constituencies.
(2) One member of the national committee shall be elected in the constituency. A village with a population of up to 400 inhabitants consists of one constituency in which all members of the local national committee are elected.
(3) Replacements are not elected.
§ 11.
Election committee.
(1) Options
to the central national committees, the municipal election committees,
to the Regional National Committees of the Regional Election Commission,
to the Regional National Committees of the Regional Election Commission,
to the municipal national committees of the City Election Commission,
to the local election committee's district national committees,
to local national committees of the local election committee.
(2) Elections in the various constituencies are governed by the Circular Election Commission.
(3) The votes in the various constituencies are managed by the District Electoral Commission.

Oddíl 2.

Election Circuits and Election Commission for National Committees in Prague.
(a) Electoral Circuits and Electoral Commission for Elections to the Central National Committee of the Capital City of Prague.
§ 12.
Election circuits.
(1) Election circuits for elections to the Central National Committee shall be determined by the Board of the Central National Committee.
(2) For elections to the Central National Committee, so many constituencies will be created, that every 4,000 people will receive one constituency.
(3) The lists of constituencies shall be published by the Board of the Central National Committee no later than 55 days before the date of election.
§ 13.
City Election Commission.
(1) In the capital city of Prague, the Council of the Central National Committee, with the approval of the Government no later than 55 days before the election date, shall set up a municipal election committee.
(2) The Commission shall consist of the President, his Deputy Secretary, the Secretary and 8 to 10 other members.
(3) The Commission will be made up of representatives of the workers' organisations proposed by the National Front.
§ 14.
Tasks of the City Election Commission.
City Electoral Commission
(a) oversees the precise observance of the rules on elections to the Central National Committee;
(b) decide on complaints concerning the maladministration of the election committees in elections to the Central National Committee;
(c) examine whether candidates for the Central National Committee run for that National Committee in one constituency;
(d) ensure that voting lists are drawn up for elections to the Central National Committee;
(e) register the elected members of the Central National Committee;
(f) submit the electoral files to the mandates of the Central National Committee.
§ 15.
The District Election Commission.
(1) For each electoral circuit for elections to the Central National Committee, the Board of the Central National Committee shall set up an election committee no later than 50 days before the election date.
(2) The Commission is composed of the President, its Deputy Secretary, the Secretary and between 4 and 6 other members.
(3) The Commission will be made up of representatives of the workers' organisations proposed by the National Front.
§ 16.
Tasks of the District Election Commission.
Circuit Election Commission for elections to the Central National Committee
(a) register candidates to the Central National Committee in accordance with the provisions of this Law;
(b) provide the district election committees with voting tickets for elections to the Central National Committee;
(c) oversees the electoral process;
(d) establish the results of the electoral elections;
(e) submit a report to the municipal election committee on the outcome of the election in the constituency;
(f) issue a certificate of election to the candidate elected;
(g) forward the file on the elections for safekeeping to the Board of the Central National Committee.
b) Election Circuits and Election Commission for elections to the District National Committees in Prague.
§ 17.
Election circuits.
(1) Election circuits for election to the Circular National Committees shall be determined by the Board of the Circular National Committee.
(2) There are so many constituencies to be created for the election of individual national district committees, that for every 500 people, one constituency will fall; However, there shall be a minimum of 35 and a maximum of 150 constituencies.
(3) The lists of constituencies shall be published by the Board of the District National Committee no later than 55 days before the date of the election.
§ 18.
Local Election Commission.
(1) In each city district, the Board of the District National Committee shall, with the approval of the Board of the Central National Committee, establish a local election committee no later than 55 days before the election date.
(2) The Commission is composed of the President, its Deputy Secretary, the Secretary and between 6 and 10 other members.
(3) The Commission will be made up of representatives of the workers' organisations proposed by the National Front.
§ 19.
Tasks of the local election committee.
Local Election Commission
(a) oversees the precise observance of the rules on elections to the District National Committee;
(b) decide on complaints about the maladministration of the election committees in elections to the Circular National Committee;
(c) oversees the timely drawing up of electoral lists and making them known;
(d) oversees the timely establishment of electoral districts by the national committees;
(e) examine whether candidates for the Regional National Committee run for that National Committee in one constituency;
(f) ensure that voting lists are drawn up for election to the Circular National Committee;
(g) register the elected members of the Circular National Committee;
h) forward the electoral files to the Mandate Committee of the National Council.
§ 20.
The District Election Commission.
(1) For each electoral circuit for elections to the Circular National Committee, the Board of the Circular National Committee shall set up at least 50 days before the election date of the Circular Election Commission.
(2) The Commission shall be composed of the President, its Deputy Secretary, the Secretary and between 2 and 4 other members.
(3) The Commission will be made up of representatives of the workers' organisations proposed by the National Front.
§ 21.
Tasks of the District Election Commission.
Circuit Election Commission for elections to the Circular National Committee
(a) register candidates for the national district committee in accordance with the provisions of this law;
(b) provide the District Election Committees with voting lists for elections to the District National Committee;
(c) oversees the electoral process;
(d) establish the results of the electoral elections;
(e) submit a report to the local election committee on the outcome of the election in the constituency;
(f) issue a certificate of election to the candidate elected;
(g) forward the files on the elections for safekeeping to the Council of the District National Committee.

Election Circuits and Election Commission for National Committees in Bratislava.
(a) Electoral Circuits and Electoral Commission for Elections to the Central National Committee of Bratislava.
§ 22.
Election circuits.
(1) Election circuits for elections to the Central National Committee shall be determined by the Board of the Central National Committee.
(2) For elections to the Central National Committee, so many constituencies will be created, that every 1,500 people will receive one constituency.
(3) The lists of constituencies shall be published by the Board of the Central National Committee no later than 55 days before the date of election.
§ 23.
City Election Commission.
(1) In Bratislava, the Board of the Central National Committee shall, with the approval of the Board of Authors, establish a municipal election committee no later than 55 days before the election date.
(2) The Commission shall consist of the President, his Deputy Secretary, the Secretary and 8 to 10 other members.
(3) The Commission will be made up of representatives of the workers' organisations proposed by the National Front.
§ 24.
Tasks of the City Election Commission.

§ 25.

(b) Electoral Circuits and Electoral Commission for Elections to the District National Committees in Bratislava.
§ 27.
Election circuits.
(1) Election circuits for election to the Circular National Committees are established by the Council of the Circular (Central) National Committee.
(2) There are so many constituencies to be created for the election of individual national district committees, that for every 500 people, one constituency will fall; However, there shall be at least 50 constituencies.
(3) The lists of constituencies shall be published by the Council of the National Circular (Central) not later than 55 days before the date of election.

Local Election Commission.
(1) In each district, the Board of the Circular (Central) National Committee shall, with the approval of the Board of the Central (Regional) National Committee, establish a local election committee no later than 55 days before the election date.
