GOVERNMENT REGULATION
of 18 May 2022
on the adjustment of compensation for loss of earnings following the cessation of incapacity for work or invalidity resulting from an occupational accident or occupational disease of soldiers in the exercise of military essential or substitute service and military exercises, the adjustment of compensation for loss of salary after the cessation of incapacity for service or invalidity resulting from an occupational accident or illness and the adjustment of the reimbursement of maintenance costs of survivors (regulation on compensation to soldiers and survivors)
The Government orders pursuant to § 127 (3) of Act No. 221 / 1999 Coll., on Professional Soldiers, as amended by Act No. 272 / 2009 Coll. and Act No. 332 / 2014 Coll.:
The compensation for loss of earnings after the cessation of incapacity for work or the recognition of invalidity due to an accident or occupational disease, the compensation for loss of salary after the cessation of incapacity for service or the recognition of invalidity resulting from an accident or occupational disease and the reimbursement of the cost of maintenance of survivors (hereinafter referred to as "compensation '), belonging to the soldier or survivors under another legislation, shall be adjusted so as to provide that the average earnings applicable to the calculation of compensation, possibly increased by 8,2% in accordance with the implementing legislation on compensation granted to soldiers and survivors issued for the implementation of Act No. 221 / 1999 Coll., and Act No. 220 / 1999 Coll., on the course of basic or replacement service and military exercises, and on certain legal amendments to soldiers in advance, shall be increased by 8,2%.
The adjustment of the compensation provided for in Article 1 shall be for soldiers or survivors from 1 June 2022, provided that the entitlement of the soldier or survivors is acquired before 1 June 2022.
An adjustment to the compensation provided for in Paragraph 1 shall be made even if the entitlement of the soldier or the survivors arose between 1 June 2022 and 31 December 2022.
The compensation shall be adjusted without the request of a soldier or survivors; it shall be made on request in cases where the reimbursement was not solely due to an increase in the invalidity pension under social security legislation or pension insurance.
Efficacy
This Regulation shall enter into force on 1 June 2022.
