DECLARATION
Ministry of Labour and Social Affairs
of 18 June 1998
amending Decree No. 182 / 1991 Coll., No. 182 / 1991 Coll., implementing the Act on Social Security and the Act of the Czech National Council on the jurisdiction of the institutions of the Czech Republic in Social Security, as amended
The Ministry of Labour and Social Affairs provides, pursuant to § 58 (a) and (d) of Act No. 114 / 1988 Coll., on the jurisdiction of the Czech Socialist Republic bodies in social security, as amended by Act No. 144 / 1991 Coll. and Act No. 582 / 1991 Coll., and under § 177a (1) of Act No. 100 / 1988 Coll., on social security, as amended by Act No. 37 / 1993 Coll. and Act No. 307 / 1993 Coll.:
Decree of the Ministry of Labour and Social Affairs of the Czech Republic No. 182 / 1991 Coll., implementing the Act on Social Security and the Act of the Czech National Council on the Jurisdiction of the Bodies of the Czech Republic in Social Security, as amended by Act No. 482 / 1991 Coll., Act No. 582 / 1991 Coll., Decree No. 28 / 1993 Coll., Decree No. 137 / 1994 Coll., the finding of the Constitutional Court of the Czech Republic published under No. 72 / 1995 Coll., Decree No. 206 / 1995 Coll., Decree No. 264 / 1996 Coll., and Decree No. 138 / 1997 Coll., is amended as follows:
1. In Paragraph 3, the following shall be added at the end of the second sentence of paragraph 2: "and in the event of a tie, the vote of its President shall be decided by the vote '.
2. Paragraph 33 (8) reads:
"(8) A contribution to the special aid measures may be granted only if the applicant undertakes in writing in advance to return the contribution or a proportion thereof where:
(a) the special aid for which a contribution has been granted shall cease to be its property before the expiry of 5 years from the date of payment of the allowance;
(b) within six months of the date of payment, no special aid shall be granted or, where appropriate, only part of the allowance shall be used.
The contribution or proportion thereof shall not be refunded if the citizen to whom it was paid dies. ';
3. In the second sentence of Paragraph 34 (6), the words "a citizen dies' are replaced by the words" a citizen or a child whose parents have been provided with it '.
4. in Paragraph 35 (2) (c):
"(c) mentally disabled, whose mental disability justifies the granting of exceptional advantages to severely disabled third-degree citizens,"
5. In Paragraph 35, the following sentence is added at the end of paragraph 2: "A contribution may be granted to only one beneficiary. '.
6. In the second sentence of Paragraph 35 (4), the words "or the recovery of the contribution is waived 'shall be inserted after the words" the proportional part'.
7. In the second sentence of Article 35 (7), the words "or when the child died 'shall be inserted after the word" transport'.
8. In Paragraph 36, the following sentence is added at the end of paragraph 1: "The allowance or proportion thereof shall not be refunded in the event of the death of the citizen to whom it was paid or of the child to whom it was paid to the parents. '.
9. In Paragraph 36, the following paragraph 3 is inserted after paragraph 2:
"(3) The contribution referred to in paragraphs 1 and 2 may be granted by reason of the transport of the same disabled person only to one holder of a motor vehicle, to the holder designated by the person to be transported. ';
Paragraphs 3 to 6 shall be renumbered paragraphs 4 to 7.
10. In Paragraph 36 (4), the first sentence is replaced by the following sentence: "The amount of the contribution to the operation of a motor vehicle shall be as follows:" The amount of the contribution to the operation of a motor vehicle for citizens whose disability justifies the granting of exceptional benefits to severely disabled third-degree citizens and the parents of the child referred to in paragraph 1 (c) shall be CZK 1,750 for a single-stop vehicle and CZK 3,500 for other vehicles and for citizens whose disability justifies the granting of exceptional benefits to severely disabled third-degree citizens, CZK 875 for a single-stop vehicle and CZK 1,750 for other vehicles. "
11. in Paragraph 36 (6), "paragraph 4" is replaced by "paragraph 5."
12. In Article 37 (1), the words "is not the holder of a motor vehicle or a citizen referred to in Article 36 (1) (b)," is replaced by "is regularly transported individually and is not the holder of a motor vehicle or a citizen referred to in Article 36 (1) (b) or (c), which '.
13. In Paragraph 37, the following sentence is added at the end of paragraph 1: "The allowance or proportion thereof shall not be refunded in the event of the death of a citizen to whom it was paid or of the child to whom it was paid to the parents. '.
14. in Paragraph 37 (2):
"(2) The amount of the individual transport allowance is CZK 3,000. If the conditions for granting the contribution are met only during the calendar half-year, the amount of the contribution shall be a proportion of the amount referred to in the first sentence. The allowance shall be paid by the end of the calendar month following the month in which the allowance was granted. ';
15. in Paragraph 58 (2):
"(2) Citizens who fulfil the conditions for the grant provided for in § 35 (1) or (2) may be granted a loan for the purchase of a motor vehicle up to CZK 40,000."
16. Paragraph 60, including the title, reads:
Remuneration of voluntary care staff
Volunteers of the care service shall receive a reward of up to CZK 5,500 per calendar month, taking into account the quality, number and complexity of the services provided. "
17. Annex No 1 reads as follows:

Transitional provision
If the procedure for granting the special aid measure has not been final on 1 July 1998, the decision to grant the special aid measure shall be taken in accordance with the rules in force before that date only if it is more favourable for the applicant.
Efficacy
This Decree shall take effect on 1 July 1998.
