THE LAW
of 26 April 1996
amending and supplementing the Act of the Czech National Council No. 40 / 1993 Coll., on the acquisition and withdrawal of citizenship of the Czech Republic, as amended by Act No. 272 / 1993 Coll. and Act No. 140 / 1995 Coll.
Parliament has decided on this law of the Czech Republic:
The Act of the Czech National Council No. 40 / 1993 Coll., on the Acquisition and Loss of Citizenship of the Czech Republic, as amended by Act No. 272 / 1993 Coll. and Act No. 140 / 1995 Coll., is amended as follows:
1. In Paragraph 11, the following paragraph 3 is inserted after paragraph 2:
"(3) The Ministry of the Interior may also waive the condition laid down in Paragraph 7 (1) (c), if it is a national citizen of the Slovak Republic or a former national citizen of the Slovak Republic, who has a continuous permanent residence in the Czech Republic not later than 31 December 1992."
Paragraph 3 shall become paragraph 4.
2. in Paragraph 13, point (a) shall be deleted and points (b) and (c) shall be renumbered as points (a) and (b) respectively.
Article 3 (14), including the title and Article 15, shall be deleted.
4. Article 16 (1) to (3) reads as follows:
"(1) A citizen of the Czech Republic who is abroad and at the same time a citizen of a foreign state can declare that he is renouncing citizenship of the Czech Republic.
(2) The declaration referred to in paragraph 1 shall be made before the representative office of the Czech Republic. The applicant shall specify:
(a) when he acquired foreign citizenship,
(b) the place of last residence in the Czech Republic or that he has never had such residence.
The declaration shall be accompanied by a proof of citizenship of the Czech Republic and proof that it has acquired citizenship of a foreign State.
(3) Parents or, where appropriate, one of them may include a child under 15 years of age who is a national citizen of the Czech Republic and at the same time a national citizen of a foreign state. The declaration shall be accompanied by:
(a) the birth certificate of the child;
(b) the consent of the second parent to the loss of citizenship of the Czech Republic of the child if he has not been deprived of parental rights or legal capacity;
(c) proof that the child has acquired citizenship of a foreign State. "
5. In Paragraph 26, the words "in paragraphs 15 (2) (a) and (c) and 3 (a), 'are deleted.
6. In § 27a, the following words are inserted after the word "submitted": "according to the Act of the Czech National Council No. 39 / 1969 Coll., on the acquisition and renunciation of citizenship of the Czech Socialist Republic, as amended,"
This Act shall take effect on the day of its publication.
