Decree of the Ministry of Agriculture and Nutrition of the Czech Socialist Republic on feed management and the registration of certain types of feed and the registration of their producers

on feed management and the registration and registration of certain types of feed by producers
The Ministry of Agriculture and Nutrition of the Czech Socialist Republic, in agreement with the participating central authorities of the state administration, provides pursuant to § 39 of Act No. 61 / 1964 Coll., on the development of plant production:
§ 1
Preliminary provisions
(1) Ensuring the planned management and use of resources and feed production requires a consistent management of feed. To ensure this objective and to increase the quality control of feed, compound feed and feed supplements, their registration and the registration of their producers shall be established.
(2) Feed, compound feed and feed supplements are all organic and inorganic substances intended for animal feeding under this Decree.

Central feed and feed management fund of this fund
§ 2
(1) The central feed fund includes feed, compound feed and feed supplements designated by the Federal Ministry of Agriculture and Nutrition within the balance sheets of the central feed fund. 1)
(2) The Central Feed Fund is managed by the Ministry of Agriculture and Nutrition of the Czech Socialist Republic (hereinafter referred to as "the Ministry") according to the principles established by the Federal Ministry of Agriculture and Nutrition.
(3) Organisations purchasing and storing feed from domestic production or from imports for the central feed fund as well as organisations producing compound feed and feed supplements for the central feed fund, as well as organisations in which feed is present as by-products or waste shall treat it in accordance with a specific regulation.
§ 3
Ingredients of compound feedingstuffs and compound feedingstuffs
(1) For the production of compound feed and compound feed, the Ministry shall designate the organisations producing the limit recipes, which shall establish the basic indicators of the content and representation of the main components (nutrient carriers) for each species and category of animal and the raw materials which may be used for the production of compound feed and feed supplements.
(2) Proposals for compound feed and feed supplements and proposals for amendments to those recipes are submitted by their producers to the Ministry. submit, at the same time as those proposals, a proposal for physical and chemical characteristics of the quality and conditions determining their health. Proposals for compound feed and feed supplements (changes thereof) shall be approved by the Ministry.

§ 4
Registration, manufacture and putting into circulation of feed, compound feed and feed supplements
(1) The records of feed, compound feed and feed supplements, with the exception of those referred to in paragraph 2, and the records of manufacturers of registered feed, compound feed and feed supplements (hereinafter referred to as "the register") are kept by the Ministry. The entries made in the register shall be published in the Ministry Bulletin.
(2) Feed, compound feed and feed supplements must be entered in the register, except:
(a) oil, leguminous vegetables, fodder plant dryers and raw materials from imports;
(b) compound feed and compound feed produced for the purpose of biological testing of research tasks under approved methodologies;
(c) compound feed produced by an organisation in its own establishment for its own use or by a joint agricultural holding for its own use or for that of a member organisation;
(d) manure and bulk feedingstuffs (e.g. grains, hay, straw, silage, Senate) and potatoes;
(e) wet industrial feedingstuffs (beet pulp, molasses, potato crushers, etc.).
(3) Feed, compound feed and feed supplements, subject to registration, can only be produced and put into circulation by organisations registered as their producers.
(4) Compound feed and compound feed corresponding to the limit receptors (§ 3 (1)) and raw materials intended for the production of compound feed and feed supplements and subject to registration (hereinafter referred to as "raw materials") are entered in the register after the reporting procedure has been carried out (§ 5). Feed as well as other compound feed and feed supplements which do not comply with that condition shall be entered in the register after the approval procedure has been carried out (Section 6).
§ 5
Notification procedure
(1) An application for the entry of a compound feed, feed supplement or raw material in the register following the reporting procedure is submitted by the organisation on the basis of the prescribed forms in triplicate to the Ministry, through the Central Control and Examination Institute of Agricultural in Prague (the Control Institute); an application for entry of the raw material in the register may also be submitted by an organisation (authority) superior to the organisation which produces the raw material. The application shall be accompanied by a sample of the compound feed, feed supplement or raw material.
(2) The application for registration of the compound feed and feed supplement in the register shall include:
(a) the name of the compound feed and the compound feed and, where appropriate, the abbreviation in accordance with the provisions of technical standards;
(b) the trade name, if used, and, where appropriate, the word and image of the trade mark;
(c) the content of the main nutrients (for feed supplements, biological efficiency),
(d) the representation of each component in the mass minima and maximum,
(e) physical and chemical characteristics of quality within the scope specified by CSN 46 7006,
(f) information on the content and biological efficacy of the added biofactors and, where appropriate, other added substances;
(g) feeding instructions (for feed supplements, instructions for its use),
(h) a technical description of the packaging (if only standardised packaging is used, a communication of the technical standard is sufficient; for a compound feed and feed supplement supplied in bulk, the method of transport must be indicated),
(i) a model label (label, tag) or any other means of identification in accordance with the provisions of the technical standard;
(j) the list of production sites proposed for the production of compound feed and feed supplements.
(3) The application must be accompanied by a complete analysis of the nutritional value (Weenden analysis) (2) and an analytically verified value of the quality indicators according to the technical quality standard.
(4) Where the compound feed or feed supplement contains a new ingredient, the manufacturer shall at the same time submit a proposal for a methodology for analytical verification of its content and, where appropriate, biological efficacy.
(5) The Ministry may, where justified, waive the requirement of certain elements referred to in paragraphs 2 to 4.
(6) The application shall be examined by the inspection institute and the State Veterinary Administration of the Ministry; where necessary, they may request further information, samples of raw materials or finished products from the manufacturer and the manufacturer shall comply with the requirement.
§ 6
Approval procedure
(1) An application for the entry of feed, compound feed and compound feed in the register on the basis of the authorisation procedure shall be submitted in accordance with the procedure laid down in Article 5 (1) and shall contain the particulars referred to in Article 5 (2) to (4); the Ministry may, where justified, refrain from requesting any of the said particulars.
(2) The application for registration will be examined
(a) a control institute based on its own analysis and biological testing;
b) State Veterinary Administration of the Ministry from the point of view of veterinary care, in accordance with the expression of the chief hygienist of the Czech Socialist Republic.
(3) In order to carry out the biological testing, the manufacturer is required to deliver the required amount of feed, compound feed and feed supplement to the inspection institute and the Ministry of Health, as appropriate.
(4) If the manufacturer submits sufficient documentation for carrying out the biological tests according to the methodology laid down, the inspection institute and the State Veterinary Administration of the Ministry may refrain from further biological testing and recommend registration to the Ministry.
(5) The Control Institute and the State Veterinary Administration of the Ministry may request special expertise if the nature of the validated feed, compound feed and feed supplement so require.
§ 7
Registration
(1) The inspection institute and the State Veterinary Administration of the Ministry shall communicate the outcome of the examination in the context of the notification or approval procedure (Sections 5 and 6) with their opinion to the Ministry. The costs of carrying out the notification or approval procedure shall be borne by the applicant; in justified cases, the Ministry may decide not to pay these costs.
(2) The Ministry shall decide on the entry of feed, compound feed and feed supplement in the register and inform the manufacturer accordingly.
(3) The registration number shall show:
(a) the trade description of the feed, compound feed and compound feed (exact name, abbreviation and single product classification number);
(b) feeding instructions (for feed supplements, instructions for its use),
(c) the name and address of the manufacturer (by manufacturer),
(d) the raw material composition of the feed and compound feed in weight percentages, for feed supplements in weight units and international units of effectiveness;
(e) quality indicators - technical quality standard;
(f) the date on which the application was lodged,
(g) the number and date of the decision;
(h) the date of entry in the register.
(4) The entry in the register may be cancelled by the Ministry if it is found that the manufacturer does not comply with the conditions laid down for the production of feed, compound feed or compound feed, or if the production of certain feedingstuffs is not desirable; inform the manufacturer of its decision without delay.
§ 8
Quality control of registered feed, compound feed and feed supplements
(1) The control institute shall carry out a continuous quality check of the feed, compound feed and feed supplements registered.
(2) Where the inspection centre finds that the feed produced, the compound feed and the feed supplement do not correspond to the mandatory quality indicators, it shall designate them as feed of reduced quality. (3) shall at the same time determine when such feed will be re-subject to continuous control. The designation for a reduced-quality feed shall be valid until further systematic checks reveal that the feed complies with the specified parameters; the costs of this additional check shall be borne by the manufacturer.
(3) If the manufacturer requests the inspection institute to carry out a new systematic check before the time limit laid down by the institute pursuant to paragraph 2, the control institute shall take samples of feed, compound feed or feed supplement and communicate the result of the check to the manufacturer; the costs of this new check shall be borne by the manufacturer.
(4) The health check for feed, compound feed and feed supplement is carried out by the Ministry's State Veterinary Administration according to the relevant regulations. 4)

Provisions common and final
§ 9
The Ministry shall set up expert committees to examine the proposals for compound feed and feed supplements and to assess the opinions of the authorities referred to in Article 7 (1).
§ 10
(1) Organisations authorised to produce and put into circulation feed, compound feed and feed supplements by 31 December 1975 may only do so until that date.
(2) Organisations authorised to produce and put into circulation feed, compound feed and feed supplements without a time limit may produce and put them into circulation after 31 December 1975, provided that they submit an application for registration by 31 March 1976 at the latest (Section 4 (1)).
(3) An organisation producing and putting into circulation feed which has not been registered before 30.6.1983 and which is subject to registration after that date may produce and put into circulation until 31.8.1983; they may only produce them after that date if they submit an application for registration by 31 August 1983 at the latest.
(4) The authorisation of the organisations referred to in paragraphs 2 and 3 shall cease to be received by the notification of the processing of the application.
§ 11
The Decree of the Ministry of Agriculture No 199 / 1959 Ú. l, on feed management, is hereby repealed.
§ 12
This Decree shall take effect on 1 January 1976.
