on the Agreement between the Government of the Czechoslovak Socialist Republic and the Government of the German Democratic Republic on the activities of cultural and information centres in Prague and Berlin
An Agreement was signed in Berlin on 2 October 1974 between the Government of the Czechoslovak Socialist Republic and the Government of the German Democratic Republic on the activities of cultural and information centres in Prague and Berlin, which, according to Article IX thereof, entered into force on the date of signature, i.e. on 2 October 1974.
The Czech text of the Agreement shall be published simultaneously.

AGREEMENT
between the Government of the Czechoslovak Socialist Republic and the Government of the German Democratic Republic on the activities of cultural and information centres in Prague and Berlin
Government of the Czechoslovak Socialist Republic and
the Government of the German Democratic Republic,
on the basis of the Treaty on Friendship, Cooperation and Mutual Assistance between the Czechoslovak Socialist Republic and the German Democratic Republic signed in Prague on 17 March 1967 and the conclusion of negotiations between the Party and Government delegations of the Czechoslovak Socialist Republic and the German Democratic Republic on 12 November 1971 and on 23 September 1972,
led by the desire to promote mutual awareness of the achievements of socialist construction, political, economic and cultural development of both countries, to cooperate even more closely in promoting socialist ideology and in the fight against hostile views, thus deepening friendly relations based on the principles of socialist internationalism, thereby contributing to better knowledge and further convergence of the people of both states,
have decided to conclude the following agreement:
1. Both Parties will support in general the activities of cultural and information centres in the Czechoslovak Socialist Republic and the German Democratic Republic.
2. The cultural and information centre of the Czechoslovak Socialist Republic in Berlin is entitled "Cultural and information centre of the Czechoslovak Socialist Republic."
The cultural and information centre of the German Democratic Republic in Prague is entitled "Cultural and information centre of the German Democratic Republic."
3. In addition, each Contracting Party may establish a branch of a cultural and information centre within the territory of the other Contracting Party, after prior agreement of that other Contracting Party. In the event that the branch of the Centre is not established on a reciprocal basis, the costs of setting up and operating shall be borne by the Contracting Party which set it up.
4. The cultural and information centre of the Czechoslovak Socialist Republic in the German Democratic Republic and the Cultural and Information Centre of the German Democratic Republic in the Czechoslovak Socialist Republic are legal persons.
The Head of the Cultural and Information Centre shall be the Director, appointed by the Party which establishes the Centre. The Director shall be responsible for the activities of the cultural and information centre.
The activities of cultural and information centres shall be carried out in accordance with the legislation of the beneficiary State.
2. Cultural and Information Centres shall cooperate in the implementation of the plans to be concluded with the Cultural Cooperation Agreement between the Czechoslovak Socialist Republic and the German Democratic Republic.
3. The cultural and information centre shall be active throughout the territory of the beneficiary State under this Agreement. Where branches are established by the Contracting Parties, the heading of their activities in the territory of the beneficiary State shall be defined by mutual agreement of the two Contracting Parties.
The activities of cultural and information centres shall include in particular:
(a) information on the political, economic, cultural and scientific life of their countries and on the universal cooperation of the Socialist Community countries;
(b) the dissemination and publication of publications;
(c) organisation of lectures, literary performances, film performances and concerts, holding meetings and meetings with well-deserved industry, agriculture, science and technology personnel;
(d) the maintenance and management of reading rooms and libraries belonging to cultural and information centres;
(e) lending of books, magazines, films, tape tapes, slides;
(f) organising exhibitions on different areas of activity and on the friendship and cooperation of the people of both countries;
(g) organisation of language courses;
(h) the sale of books and other printing products, as well as gramophone boards, folk art and artistic industry, art objects, art glass and jewellery in cultural and information centres and at sales exhibitions and mail order;
(i) the organisation of social enterprises in cooperation with host country organisations and with cultural and information centres of other socialist countries;
(j) organisation of days of friendship and culture.
2. The sales activity of cultural and information centres is of a retail nature.
1. The Parties shall provide cultural and information centres with the necessary facilities for the free use of the room to carry out activities under this Agreement.
2. If cultural and information centres need to be moved, the host country shall provide the other side of the room with the same value.
3. The host country shall, through the Services Administration, provide the diplomatic corps with appropriate apartments to the Director, his representatives and other staff of the cultural and information centre, seconded by the other Party.
The supply of goods, equipment and articles required for the activities of cultural and information centres under this Agreement shall not be subject to the payment of taxes, levies and import charges.
The representatives of the organisations of the Contracting Parties which have established the centres shall, as a general rule, meet once a year to exchange experience and discuss issues arising from the implementation of this Agreement.
Other issues relating to the activities of cultural and information centres are detailed in the Protocol which forms part of this Agreement.
1. This Agreement shall enter into force on the date of signature and shall remain in force for five years.
This Agreement shall be extended by one year each time, unless one of the Contracting Parties denies it six months before the expiry of the current period.
2. The Protocol on the activities of cultural and information centres in Prague and Berlin of 4 May 1956 and the Additional Protocol to the Protocol on the activities of cultural and information centres of 4 May 1956 will expire on the date of entry into force of this Agreement.

PROTOCOL
to the Agreement between the Government of the Czechoslovak Socialist Republic and the Government of the German Democratic Republic on the activities of cultural and information centres in Prague and Berlin
1. The two Parties shall provide for the use of the cultural and information centres of the room necessary to carry out their planned activities. Rent and expenses for electricity, gas, water, street cleaning fees, waste collection, heating and ventilation shall be borne by the receiving State, except where the centre or branch is not established on a reciprocal basis.
2. Current building maintenance is paid by the Contracting Party which provided the necessary room for use. Each cultural and information centre shall be obliged to insure the rooms provided for use against the natural damage to its cargo. The beneficiary State shall take care of the technical condition and control of all the installed equipment it has made available.
3. Expenditure related to internal equipment, its normal maintenance and expenditure on the possible conversion of cultural and information centres shall be borne by the Contracting Party which has set up the cultural and information centre.
The activities of the cultural and information centres shall be carried out on a reciprocal basis, under the direction of the Contracting Party which set up the Centre, by the following forms:
- individual sales in the cultural and information centre rooms,
- by mail, including direct consumer order,
- sales exhibitions outside the cultural and information centre,
- actions outside the cultural and information centre.
1. Sales in cultural and information centres shall include in particular:
(a) polygraphic products such as books, periodical and non-periodical publications, reproduction, postcards, leporelas, maps, atlases, globes, notes;
(b) gramophone plates, recorded tape tapes, slides;
(c) art items, art creativity products, art crafts and the art industry, art glass and jewellery.
2. The directors of cultural and information centres shall determine the type and quantity of commercial goods at the level of the validated limit under their responsibility.
The value volume of sales contenders shall be determined in the framework of the annual protocols for the exchange of goods between the Czechoslovak Socialist Republic and the German Democratic Republic.
The level of the contingent is the same for both cultural and information centres. However, a difference of up to 10% is allowed when fulfilling the contingent.
1. Goods intended for sale in cultural and information centres shall be supplied to the centres by the competent foreign trade organisation of the recipient State.
2. The supply of goods between the relevant foreign trade organisations shall be reimbursed in accordance with the terms of the trade agreement in force. The cultural and information centres shall be invoiced at retail prices in the currency of the beneficiary State.
3. Both parties shall provide cultural and information centres with 30% rebates from the retail price.
4. The creation of retail prices shall be governed by the applicable rules of the beneficiary State.
5. In the case of a State-made retail price adjustment, the resulting price differences for goods purchased and not sold by the cultural centre will be offset by the State budget of the beneficiary State.
Net profit from sales activity remains cultural and information centres to cover their operating and other expenses.
1. Cultural and information centres shall have an operating account with the relevant State banks of the host country in the currency of that country.
2. The accounts of cultural and information centres shall be kept according to the system, form and language of the State which established the cultural and information centres.
