GOVERNMENT REGULATION
of 13 June 2018
amending Government Regulation No 154 / 2005 Coll., laying down the amount and method of calculation of fees for the use of radio frequencies and numbers, as amended
The Government mandates pursuant to Article 150 (1) of Act No. 127 / 2005 Coll., on Electronic Communications and on the amendment of certain related laws (Act on Electronic Communications), as amended by Act No. 261 / 2007 Coll., Act No. 304 / 2007 Coll., Act No. 468 / 2011 Coll. and Act No. 252 / 2017 Coll., to implement Sections 24 (5) and 37 (2) of the Act on Electronic Communications, as amended by Act No. 304 / 2007 Coll.:
Government Regulation No 154 / 2005 Coll., establishing the amount and method of calculation of fees for the use of radio frequencies and numbers, as amended by Government Regulation No. 288 / 2007 Coll., Government Regulation No. 162 / 2008 Coll., Government Regulation No. 228 / 2009 Coll., Government Regulation No. 156 / 2011 Coll., Government Regulation No. 175 / 2012 Coll., Government Regulation No. 284 / 2015 Coll. and Government Regulation No. 43 / 2017 Coll., is amended as follows:
1. In Article 1, the following paragraph 4 is added:
"(4) In the event that the annual fee for the use of radio frequencies and numbers determined in accordance with the fee schedule would be lower or higher than the limit laid down in § 24 (2) or § 37 (2) of the Act, the amount of the fee shall be equal to the limit below or above. ';
2. In the Annex to point 1 (1), at the end of the text in point (a), the words "and one polarisation, unless otherwise specified in this Regulation by the Government 'shall be added.
3. In the Annex, entry 1 (A.1) reads:
"A. 1. Full area radio networks
CZK per year according to calculation
For charging purposes, flat-screen radio networks are networks in which radio frequencies can be used by radio devices throughout the Czech Republic. All-area terrestrial mobile service radio networks shall not include radio networks with a national radio frequency used only for mobile radio equipment. Furthermore, radio networks through which the important interests of the State are ensured shall be understood as flat-screen radio networks.
Calculation:

C 1 radio frequency charge
S1 Rate per 1 kHz of frequency band width used
S1 = 1600 CZK
K1 Coefficient of frequency bandwidth used
This coefficient shall be calculated from the width (in kHz) of 1 frequency channel equal to the channel pitch in the frequency band used.
K1 = 1 x width [in kHz]
for frequencies outside the 380- 385 / 390-395 MHz frequency band
K1 = 0,25 x width [in kHz]
for frequencies in the 380- 385 / 390- 395 MHz frequency band
K16 Frequency band coefficient
K16 = 1 for f < 1 GHz
K16 = 0,7 for 1 GHz ≤ f < 2,2 GHz
K16 = 0,2 for f ≥ 2,2 GHz '.
4. In the Annex, entry 1 (A.2) (A) 2.1 reads as follows:
"A 2.1 Regional and local radio networks
Regional and local radio networks are for charging purposes radio networks where radio frequencies can be used by radio equipment in the defined territory of the Czech Republic under the conditions of radio frequency allocation, for the purpose of providing publicly available electronic communications services.
Calculation:

K1 Coefficient of frequency bandwidth used
This coefficient shall be calculated from the width (in kHz) of 1 frequency channel equal to the channel pitch in the frequency band used.

K16 Frequency band coefficient
K16 = 1 for f < 1 GHz
K16 = 0,7 for 1 GHz ≤ f < 2,2 GHz
K16 = 0,2 for f ≥ 2,2 GHz
Kr Coefficient of regional network scope
The coefficient shall be calculated on the basis of the formula:

where is
POPreg population of the region or location, determined in terms of allocation
POPCR population of the Czech Republic. "

Note:
For MWS systems (multimedia wireless systems) of the type of arrangement of a point-to-point in the case of two-way radio operation of this system, fees shall be charged in the category of fixed service even if part of the service provided is a radio service. The charges for the use of frequencies by fixed service radio equipment with frequencies up to and including 1 GHz (except for radio directional fixed links point-point in the 405- 425 MHz frequency band) shall be measured by calculating the ground mobile service. ';
6. In the Annex under item 1 (D):
"D. DRUGS SERVICES

K12 Frequency band width coefficient prevented by transmission
K12 = 4 for bandwidth ≤ 4 MHz
K12 for bandwidth > 4 MHz is equal to the number of MHz corresponding to the frequency band width prevented by transmission
K13 Coefficient of use of multiple channel access technology
K13 = 0,1 using multiple channel access technology
K13 = 1 if technology with multiple access to the channel is not used '.
Efficacy
This Regulation shall take effect on 1 September 2018.
