DECLARATION
of 31 March 2005
amending Decree No. 262 / 1999 of the Ministry of Defence Coll., on the procedure for the service evaluation of professional soldiers and their aspects
According to § 17 (3) of Act No. 221 / 1999 Coll., the Ministry of Defence provides:
Decree No. 262 / 1999 Coll., on the procedure for the service evaluation of professional soldiers and their aspects, is amended as follows:
1. In Paragraph 1 (3), "5 'is replaced by" 6'.
2. In Article 2, at the end of point (d), the dot is replaced by a comma and the following point (e) is added:
"(e) physical fitness assessment."
3. The following Section 6a is inserted after Section 6:
Physical fitness assessment
Physical fitness assessment is an assessment of the ability of a soldier to perform his duties physically. It shall be verified annually in the first half of the calendar year in the case of compulsory annual checks. The evaluation shall be carried out in writing in accordance with Annex 6 to this Order. Where, on the basis of an annual examination, a soldier is assessed as having "failed 'or has not participated in the assessment due to temporary incapacity for a disease or accident or for other official reasons, he shall be required to participate in the further examination in the second half of the calendar year concerned.';
4. In Annex No 1, Part 3, in respect of 11, the word "Physical 'is replaced by" Physical', the word "rank 'is replaced by the word" Evaluation' and the text after the colon is replaced by "4 - completed, 0 - failed '.
5. In Annex 1, Part 7, the following text is added under the text "Observation of the evaluation results': If you appeal against the evaluation, it is necessary to specify exactly which parts it refers to. '
6. In Annex No 1, Part 7, the following text shall be added under the text "Observation of the superior evaluator (appellant):" Note: The appeal of the appellant shall be decided in accordance with the applicable legislation. Only the reference number and the date of the appeal decision shall be given here. The decision to appeal shall be attached to the evaluation. ';
7. In Annex No 2, Part 3, in point 11, "Physical 'is replaced by" Physical'.
8. In Annex No 2, Part 8, under the text "Observation of the senior evaluator (appellant): ', the following entry is added:" Only the reference number and the date of the appeal decision shall be given here. The decision to appeal shall be attached to the evaluation.';
9. the following Annex 6 is inserted after Annex 5:
"Annex 6 to Decree No. 262 / 1999 Coll.
Physical fitness assessment
This decree shall take effect on the day of its publication.
