DECLARATION
of 17 March 2004
amending Decree No. 252 / 2002 Coll., implementing certain provisions of the Customs Act, as amended
The Ministry of Finance provides for the Customs Act pursuant to Sections 165 (4) and 167 (1) (b) of Act No. 13 / 1993 Coll., as amended by Act No. 1 / 2002 Coll.:
Decree No. 252 / 2002 Coll., implementing certain provisions of the Customs Act, as amended by Decree No. 43 / 2003 Coll. and Decree No. 243 / 2003 Coll., is amended as follows:
1. The following Section 87a is inserted after Section 87, including the title and footnote 1:
Cases where inward processing is restricted
(Paragraph 165 (4) of the Act)
(1) In the calendar year 2004, an authorisation may be granted for the application of the inward processing procedure under a conditional system to goods falling within tariff headings and subheadings, (1) for a total quantity not exceeding 1690 tonnes, if:
(a) 1701 - cane or beet sugar and chemically pure sucrose in solid form,
(b) 1702 30 10, 1702 40 10, 1702 60 10 and 1702 90 30 - isoglucose,
(c) 1702 90 99 - other sugars, including invert sugars, other
(d) 2106 90 30 - syrups containing added flavouring or colouring matter, of isoglucose,
(e) 2106 90 59 - flavouring or colouring matter syrups, other, and
(f) 1806 10 90 - cocoa powder containing 80% or more by weight of sucrose.
(2) The use of the authorised quantity of goods shall be governed by the timetable for the declaration for release of the goods referred to in paragraph 4 for the inward processing procedure in the suspension system and accepted on one calendar day.
(3) The Ministry of Finance - Directorate-General for Customs is responsible for the allocation of quantities each working day.
(4) Where the quantity requested for drawing on a calendar day is greater than the balance available from the authorised quantity, the Ministry of Finance - Directorate-General for Customs - shall determine the allocation of the quantity of goods for that calendar day in proportion.
1) Government Decree No 462 / 2003 Coll., on the issue of the Customs Tariff and on the fixing of import duty rates for goods originating in developing and least-developed countries and the conditions for their application (Customs Tariff) and amending certain related provisions. '
2. In Article 88 (2), the words "if not for agricultural products referred to in Article 87a (1) 'shall be added at the end of the text in point (e).
This decree shall take effect on the date of its publication and shall expire on 30 April 2004.
