amending and supplementing the Decree of the Government of the Czech Socialist Republic No. 36 / 1977 Coll., on Regional Planning in the Czech Socialist Republic
The Government of the Czech Socialist Republic orders according to § 16 paragraph 3 of Act No. 145 / 1970 Coll., on National Economic Planning:
Decree of the Government of the Czech Socialist Republic No. 36 / 1977 Coll., on Regional Planning in the Czech Socialist Republic, is amended as follows:
1.
"(f) issue binding opinions, after discussion of proposals for the deployment of production forces [§ 8 (1) (a), § 11 (1) (b)], on proposals for the deployment of buildings which have the character of binding tasks of the State Plan or of particularly important centralised structures or are designed to be deployed outside the headquarters of the circumstantial meaning (4) and on proposals for the deployment of labour;"
2. in Article 8 (1) (a), the word "regional" shall be deleted;
3. The following sentence is added at the end of Paragraph 8 (2): "The national committees concerned shall submit to the relevant national committees supporting the development of the territorial districts of the national committees and the needs of the citizens, in particular the documents on the planned important investments, the deployment of establishments and establishments and the changes in the employment of the population."
4. Article 9 (1) (b) shall be completed by a semicolon and shall be accompanied by the following sentence: "These proposals shall be discussed with the Regional National Committees and the National Committees of the cities of Brno, Ostrava and Pilsen (hereinafter referred to as the" Regional National Committees "), which shall also inform the Council of the approved proposals and their implementation."
5. In Paragraph 9 (1) (c), the words "on the deployment of buildings' are deleted.
6. in Article 9 (1), the following shall be inserted after the provisions of (c):
"(d) issue binding opinions on proposals for the deployment of buildings, where their publication does not belong to other bodies [§ 7 (f), § 10 (1) (e), § 10a (2)];
(e) propose to the competent authorities the abolition and inclusion of obsolete and inefficient establishments and of inefficient production and their inclusion in the plan, setting out, together with the competent authority, the conditions for the abolition of obsolete and inefficient establishments and inefficient production and requiring the competent authorities to apply sanctions against organisations which do not comply with these conditions; 13). "
The current provisions of points (d) and (e) shall be renumbered as points (f) and (g).
7. Article 10 (1) (a) reads as follows:
"(a) cooperate with the regional national committees in developing the concept of district development and make comments on the proposals for regional plans; the proposals for the development of the district shall be discussed with the local national committees in the central municipalities, which shall also inform the approved concepts and their implementation; ';
8. In Article 10 (1), the following point (e) is inserted after point (d):
"(e) issue binding opinions on proposals for the deployment of buildings for the provision of services to the population and buildings of local importance; (4) cooperate with the Regional National Committee in drawing up binding opinions on proposals for the deployment of selected investments, for which this opinion is issued by the Regional National Committee and in cancelling obsolete and inefficient establishments and non-prospective establishments and non-prospective production, 14)."
The current provisions of point (e) shall be renumbered as those of point (f).
9. The following Section 10a is inserted after Section 10:
Urban National Committees
(1) Urban National Committees
(a) express their views on the proposals for binding opinions issued by the Czech Planning Commission, the Regional National Committees and the Regional National Committees on proposals for the deployment of selected investments, in particular in terms of natural resource requirements, housing, impact on the creation and protection of the environment, as well as on proposals for the abolition of obsolete and non-prospective production, and, where appropriate, give incentives for such cancellations; 15)
(b) deliver opinions on the intentions, concepts and other measures of centrally managed economic, cooperative and other organisations as far as they concern the development and construction of the city and citizens' needs, 16) as well as on proposals for development concepts and economic plans of organisations providing services managed by national higher-level committees. 17)
(2) The municipal national committees of the first category shall give binding opinions on proposals for the deployment of buildings for the provision of services to the population and to buildings of local importance outside the scope of paragraph 1. 15). "
10. In Paragraph 13, the existing provision becomes paragraph 2 and the following paragraph 1 is inserted:
"(1) Procedure of the national committees in organising and coordinating the pooling of funds and activities governed by specific provisions. 18)."
This Regulation shall enter into force on the day of its publication.
