adjusting certain compensation for loss of earnings after the cessation of incapacity for work caused by accidents at work or occupational diseases
The Government of the Czechoslovak Socialist Republic, in agreement with the Central Council of Trade Unions, hereby orders pursuant to § 202 (2) of the Labour Code (full version No. 55 / 1975 Coll.):
§ 1
(1) The compensation for the loss of earnings due under the Labour Code or previous Regulations (1) to workers after the cessation of incapacity for work caused by accidents at work or occupational diseases is adjusted by adding 2% for each calendar year following entitlement to such compensation until 31 December 1971, taking into account changes in the wage level.
(2) Compensation for loss of earnings shall be determined, at the worker's request, on the basis of the average monthly earnings raised in accordance with paragraph 1, even if the worker has not been provided by 31 December 1971, because the legislation on the amounts limiting the method of calculation and the provision of such surplus.2)
§ 2
(1) The compensation for the loss of earnings after the cessation of incapacity for work is also valid after the adjustment made under § 1 of § 195 (2) of the Labour Code.
(2) In order to increase the invalidity or partial invalidity pension provided for in Sections 136 to 141, 144 and 145 of Act No. 121 / 1975 Coll., on social security and, where appropriate, a similar increase, carried out in accordance with the previously applicable rules, (3), the calculation of compensation for the loss of earnings after the end of incapacity for work is not taken into account.
§ 3
Compensation for loss of earnings adjusted or, where appropriate, determined in accordance with Paragraph 1 shall be payable from the date of application of this Regulation.
§ 4
This Regulation shall enter into force on 1 January 1977.

2) § 7 (3), § 8, § 31 (2) of Act No. 150 / 1961 Coll., § 8 of Decree No. 7 / 1962 Coll., implementing certain provisions of the Act on compensation for accidents and occupational diseases, § 8 (2) of Act No. 30 / 1965 Coll., Article II (4) of Act No. 153 / 1969 Coll., amending and supplementing the Labour Code, § 195 (2) of the Labour Code.
3) Act No. 106 / 1971 Coll., on increasing pensions of old-age pensioners and of certain low social security pensions, Act No. 161 / 1968 Coll., on Special Admission to Benefits, on Changes in the Pension Security of Resistance Participants and on Certain Other Changes in Social Security.
