DECLARATION
of 28 April 2003
on the details of the determination and designation of the level of secrecy and on ensuring administrative security
The National Security Office shall determine, pursuant to Articles 6 (5) and 48 (2) of Act No. 148 / 1998 Coll., on the protection of classified information and on the amendment of certain laws, hereinafter referred to as "the Act ':

ČÁST PRVNÍ

§ 1
Subject matter
(1) This Decree sets out the details of the determination and designation of the classification level and the procedures for the creation, registration, transfer, transport, lending, storage, other handling and shredding of classified documents.
(2) This decree does not apply to the processing or transmission of classified information in information systems and cryptographic means governed by special legislation.1)
§ 2
Definition of terms for the purposes of this Order
(1) Secret documents are documents, supporting media and other materials, containing classified information expressed in whatever form.
(2) The designated person shall be the Security Director, the Security Secretary or the person responsible for protecting classified information.
(3) The consignment is a classified document equipped for transport, transported or delivered to the place of destination until the end of the shipment.
(4) A copy, copy, translation or extract is a copy of the written record or a certain number of copies of the original of the classified document. The original of the classified document shall mean the copy of the classified document delivered or the copy of the classified document produced, as shown on the distribution list.
(5) The transport of the consignment is the transport of the consignment outside the object2) to the State authority or organisation for the purpose of its delivery to the addressee.
(6) The transmission of a classified document shall be carried out outside the premises of the State or organisation (e.g. for the purposes of negotiations, consultations), where it is not transmitted.
(7) The destruction of a classified document shall be such as to render it impossible to reconstruct and identify the classified information it contains.
§ 3
Determination of the classification level
(1) The level of confidentiality shall be determined by using the classified information list, depending on whether and in what extent the unauthorised handling of classified information could cause harm to the interests of the Czech Republic or the interests which the Czech Republic has committed itself to protect or could be unfavourable to those interests.
(2) When determining the classification level, each document emerging or part thereof shall be assessed separately. Where a classified document is composed of several parts, the classification level shall be determined by the part with the highest classification level or higher.
(3) If, in determining the classification level, the period during which the classification level is to be maintained is clearly necessary, the period for classification on the front of the first sheet under the upper classification shall be indicated by the words "CONTAINING DO '.
§ 4
Classification marking
(1) A classified document shall be classified as follows:
(a) "CLOSE SECRET" and "PT" in the number of the negotiating classified documents,
(b) "SECRET" and "T" in the act number of classified documents,
(c) "CONFIDENTIAL" and "D" in the act number of classified documents; or
(d) "RESERVED" and "V" in the act number of the classified document.
(2) The degree of confidentiality shall be indicated on the classified document in paper form at the top and bottom of the middle on each side of the classified document containing the information.
(3) The classification level shall be indicated on the classified document in non-paper form on the descriptive label or, where possible, directly on the classified document.
(4) The level of confidentiality shall be indicated on the cover or packaging containing classified documents, unless otherwise specified.
(5) The degree of confidentiality shall be indicated by the written word referred to in paragraph 1 or by means of a stamp in accordance with the specimen set out in Annex 1 to this Order.
§ 5
Amendment or revocation of the classification level
(1) The amendment or termination of the classification level pursuant to Article 6 (4) (b), (c) and (d) of the Act shall be decided by the statutory authority of the State or organisation where the original classification level has been established or by the person empowered by it. The amendment or revocation of the classification level shall be notified in writing to all addressees of the classified document by the person who has decided to amend or revoke it.
(2) In the cases referred to in Article 6 (4) (c) and (d) of the Act, the authorities of the State or the organisation where the original classification level has been established or their legal successor and, failing that, the National Security Office ("the Office ') shall draw attention to that fact.
(3) The amendment or cancellation of the classification level shall be carried out on the document by crossing out the classification level so that it remains legible. In the event of a change, the new classification level shall be marked at the original classification level. The amendment or cancellation of the classification level shall be confirmed by an entry on the document stating the reason, the date of execution, the name, the surname and the signature of the person who made the change or cancellation of the classification level.
(4) A change in the classification of a classified document shall be recorded in the relevant protocol and the classified document shall be reclassified according to the new classification level. In the event of a change in the classification level, reference shall be made to the reference number of the classified document under which the classified document has been newly registered (text part of Annex 2 to this Order). Where the classification of a classified document is changed to that of "Reserved ', reference shall be made to the reference to the reference to the reference number of the classified document or registration mark. Where classified documents of different levels of secrecy are registered in a single protocol, the amendment to the classification level shall be made by crossing out the abbreviation of the classification level in column 1 of the protocol, indicating the abbreviation of the new classification level and the entry in that protocol. Similarly, a change in the classification level shall be carried out for the classified document handled in the Auxiliary Protocol, if it is conducted, and in the Handbook.
(5) An alert shall be made in the relevant protocol on the cancellation of the classified document, the serial number in column 1 shall be crossed out and the document shall be removed from the register. Removing from the register shall not be carried out when the classified document is deleted in the context of the shredding procedure, if the document is destroyed or transferred to the archives.

ČÁST DRUHÁ

ADMINISTRATIVE SUPPORT AND TRANSMISSION, TRANSPORT AND CLAIMING SERVICES
§ 6
Administrative aids
(1) For the purposes of this decree, administrative aid shall be deemed to be:
(a) the Protocol of Procedure, which is a book or a notebook for the registration of a classified document. The Protocol shall contain entries in accordance with the model set out in Annex 2 to this Order,
(b) an auxiliary protocol which is a book or a notebook for recording movements of classified documents within a State or organisation. The Auxiliary Protocol contains the items in accordance with the model set out in Annex 3 to this Order,
(c) a handbook which is a book or a notebook for the recording of the receipt and transmission of a classified document by the person who creates the classified document or which has been transmitted for processing. The Manipulative Book contains the items in accordance with the model set out in Annex 4 to this Order,
(d) a delivery book which is a book or a notebook for recording the transmission of a classified document. The delivery book shall contain the items in accordance with the model set out in Annex 5 to this Order,
(e) a loan book which is a book or a notebook for the recording of loans deposited with a classified document. The loan book shall contain the items in accordance with the model set out in Annex 6 to this Order,
(f) a classified document of the classification grade "Confidential," "Secret" or "Top Secret" (hereinafter referred to as the "Control List") for keeping an inventory of persons who have become familiar with classified documents with the State authority or organisation. The control sheet shall contain the items in accordance with the model set out in Annex 7 to this Regulation.
(2) The Protocol and the auxiliary Protocol may be led by means of computer techniques. If it is not kept simultaneously in paper form, the condition that it is a system approved by the statutory authority which contains the accounting entries as administrative aids pursuant to paragraph 1 (a) and (b) shall be met, it shall be secured against subsequent or other unauthorised interference in the records kept and against access by an unauthorised person and shall record in a verifiable manner all changes made to the records kept and the movements of the classified documents.
(3) The administrative aids referred to in paragraph 1 (a), (b) and (c) must be adjusted (authenticated) before being taken into use by continuously numbering and stitching their leaves. On the inside of the plates, the ends of the stitching shall be glued, the stamp shall be stamped with the name of the authority of the State or an organisation exceeding the edge of the gluing, a document indicating the number of sheets and the signature of the authorised person and the date of secondment to use.
(4) In addition to the administrative aids referred to in paragraph 1, additional administrative aids may be used, where justified. Other administrative aids for the recording of classified documents shall contain, mutatis mutandis, an entry as a protocol and shall be adapted in accordance with paragraph 3.
(5) The control sheet shall be drawn up in the form of a classified document by the person in charge of the Protocol. The checklist does not become part of a classified document, but is deposited with it until it is eliminated. The certificate may be replaced, for example, by a stamp containing items of information on a classified document.
(6) The administrative documents issued pursuant to paragraph 4 and the administrative documents referred to in paragraph 1, with the exception of the control sheet, shall be recorded. The record shall be kept by the person or person in charge of the Protocol.
(7) Data shall be entered in the administrative aids referred to in paragraph 4, which are used for the recording of classified documents, in the administrative aids referred to in paragraph 1, and in the collection sheet by means of means guaranteeing the durability of the font, or by means of stamp.
§ 7
Portable
In particular, all types of briefcase, briefcase, suitcase, portable safety deposit boxes, courier bags shall be regarded as portable containers for the purposes of this Decree. A condition for their use for the transport of classified documents is the possibility of locking them (in particular by mechanical, code lock) or ensuring against unauthorised handling of their contents without the knowledge of the user (in particular sealing, sealing). Each portable box must be marked in an appropriate place: "Do not open and hand over immediately to the Police Department of the Czech Republic or to the National Security Office!"
§ 8
Storage objects
All kinds of safes and lockable metal cabinets are considered as storage objects for the purposes of this decree.

ČÁST TŘETÍ

MANIPULATION WITH THE SECURITISATION OF THE SIGNIFICANT SIGNIFICANCE OF THE "EXTENDED"
§ 9
(1) The consignment is received by a person designated to receive the consignments, subject to Article 17 (1) of the Act.
(2) The secret document must be recorded in a verifiable manner, at least within the scope of columns 1, 2, 3, 5, 6 and 7 of the Protocol; where a classified document is sent outside the authority of a State or an organisation, within the scope of column 10 of the Protocol.
(3) Corrections to the registration shall be made as follows:
(a) the original entry shall be crossed out so that it remains legible;
(b) a new entry shall be made, indicating the date, surname and signature of the person who corrected the entry.
(4) A classified document shall be marked on the document delivered:
(a) the company or name (hereinafter referred to as the "designation") of the consignee,
(b) the date of registration.
These particulars may be stamped.
§ 10
(1) On the first page of the classified document in paper form, the designation of the authority of the State or organisation where the classified document was created, the reference number of the confidential document or the registration mark, the number of sheets, the number of annexes in paper form and the number of their sheets and, where applicable, the number and type of annexes in non-paper form, in accordance with Article 18 (2).
(2) The classified documents in non-paper form shall be accompanied by a descriptive label indicating the designation of the authority of the State or organisation where the classified document was created, the reference number of the classified document or the registration mark under which the medium is kept in the register referred to in Article 21 (1), or an annex to the number of the classified document and the classification level. Such data may, where possible, be indicated directly on a classified document in non-paper form.
§ 11
(1) A copy, copy, translation or extract of a classified document may be made only if necessary.
(2) Where a classified document is transmitted outside the authority of the State or outside the organisation, this may be done only against signature.
(3) A secret document is sent in two envelopes. The internal envelope shall bear the consignor's designation, the consignee's designation, the classification level and the reference number of the classified document or other registration mark. The external envelope shall bear the consignor's designation and the addressee's designation, the classification level and its abbreviation in the number of the classified document (if applicable). In the event that a classified document cannot be inserted into an envelope, it shall be placed in solid packaging.
(4) Transport of the consignment is carried out
(a) courier service;
(b) holder of a postal licence (3) (hereinafter referred to as "post office"), in the form of a recommended typograph.4)
The courier carrying the consignment shall be certified by the consignor by a valid certificate. 5)
(5) The classified document shall be transmitted in a sealed envelope or sealed packaging bearing the designation of the authority of the State or of the organisation and the inscription "Do not open and transmit immediately to the Police Department of the Czech Republic or the National Security Office!"
§ 12
(1) During and after processing, classified documents shall be stored in storage premises in secure areas (6) or in secure areas, provided that the security standards issued by the Office are met.
(2) After processing, the classified document shall return to the registration place for storage. Before the document is filed, it shall indicate the shredder's mark and the year in which the shredder proceedings are to be carried out, if it is returned in a sealed envelope, the envelope shall be signed and the classification level, the reference number of the classified document or the registration mark, the shredder mark and the year in which the shredder proceedings are to be carried out.
(3) The classified documents to be drawn up shall be kept separately from the other documents, in sequence according to the numbers of the classified documents or the registration marks, or according to the issues in the file volumes. A classification level shall be indicated on the file file with classified documents. The classified documents stored in the file volume shall be kept on the list of the documents stored which is part of it.
(4) Administrative equipment used for the registration of classified documents shall be stored in such a way as to protect them against loss or misuse.
(5) A classified document deposited may be lent within the authority of the State or the organisation for the period of time strictly necessary for the contact with the classified information of the level of secrecy and scope of activity concerned.
(6) Decommissioning (shredding) 7) classified documents are carried out in accordance with the special legislation8) and the rules governing the shredding of State or organisation bodies. Excessive copies of classified documents may be destroyed outside the shredding process.
§ 13
(1) The provisions of Part Three do not apply to classified documents of cryptographic protection of classified information.
(2) The provisions of Part Four may be applied mutatis mutandis to the handling of classified documents in the "Reserved" level.

ČÁST ČTVRTÁ

MANIPULATIONS WITH THE SECRET WRITTEN WRITTEN SIGNS OF THE SECRET "CONFIDENTIALITY," "SECRET" AND "INCLUDING SECRET"
§ 14
Receipt of the consignment
(1) The consignment shall be accepted, in compliance with Article 17 (1) of the Act, by the authorised person, by the person in charge of the Protocol or by the person in charge of the receipt of the consignments (the post office). The receipt of the consignment shall be endorsed by signature, dated and stamped by the State or organisation authority. Where a consignment is accepted by a person designated to receive the consignments, it shall be forwarded without delay to the authorised person or person in charge of the Protocol for registration.
(2) If a defect occurs in the case of a consignment delivered (e.g. if there are no stamps on the envelopes or if they are damaged, if the envelope is torn or it is clear that the contents of the classified documents may have been made known by an unauthorised person, if the number of sheets or annexes does not agree), the person who took the consignment shall write an alert immediately; the consignment is registered according to its actual status. A copy of the alert shall be sent to the consignor. That information shall be communicated without delay to the addressee by the authorised person.
(3) If, after opening the envelope or packaging of the consignment, it is found that the classified document has been addressed to another addressee, the consignee shall immediately send it to the correct addressee or return it to the consignor. On the front of the first page of the classified document, "Delivered by mistake 'shall be indicated, the designation and address of the authority of the State or organisation which has received the classified document by mistake, the date, name and surname and signature of the authorised person or person in charge of the Protocol.
§ 15
Registration of a classified document
(1) The classified documents, received or generated by a State authority or organisation, shall be recorded in the Protocol of Procedure in accordance with the instructions set out in the text part of Annex No 2 to this Order, unless otherwise provided for in this Decree. The records shall be carried out by the authorised person or person in charge of the Protocol.
(2) The classified documents of the "Top Secret" classification level shall be recorded in a separate Protocol, unless otherwise specified. The classified documents of the "Secret '," Confidential' and "Reserved 'classification may be registered in a single protocol.
(3) The classified documents delivered shall bear:
(a) the designation of the consignee;
(b) the date of registration;
(c) the reference number of the classified document of the consignee.
These particulars may be stamped.
(4) The State authority or organisation may, for the purpose of recording the movement of classified documents from the negotiating protocols to the organisational departments which do not maintain the negotiating protocols, establish ancillary negotiating protocols on those organisational units. The movement of a classified document shall be recorded in the auxiliary negotiating protocols mutatis mutandis in accordance with paragraph 2. The classified documents shall be entered in the auxiliary negotiating protocols under the assigned serial numbers of the Protocol.
(5) Where a classified document is taken over, such as in official negotiations, consultations or inspections, it shall be immediately forwarded against the signature in the Manipulative Book to the person responsible for carrying out the Protocol for registration in the Protocol. When transporting such a classified document, the conditions of § 26 (4) and (5) must be complied with.
(6) The consignments delivered on the inner envelope or packaging, bearing the words "OPENER," shall not be opened by the authorised person or person in charge of the Protocol, shall be recorded unopened and transmitted directly to the addressee. The addressee shall immediately communicate to the person in charge of the Protocol the additional information needed to register the classified document in the Protocol and ensure that the particulars referred to in paragraph 3 are marked on the classified document.
(7) He who creates or has been assigned a classified document for processing shall record it in the handbook allocated, unless otherwise specified. The alert shall be made without delay after receipt of the classified document or the assignment of the number of the case for the underlying classified document. A person who only familiarises himself with classified documents of the "Top Secret," "Secret" or "Confidential" classification without assignment shall not record such familiarisation in his handling book, but shall confirm it by signing the checklist.
(8) At the end of the calendar year, the Protocol shall be concluded by underlining the whole of the minutes and thus terminating the allocation of the numbers negotiating that year. A record of the number of acts used, signed by the person in charge of the Protocol and his direct superior or delegate, shall be entered under the emphasis.
(9) At the end of the calendar year, the numbers of the classified documents referred to in the closing calendar year shall cease to be assigned from the Protocol drawn up using the computer. The Protocol or the auxiliary Protocol shall be printed in the form of a graphic document when the person in charge of the Protocol is changed or, where appropriate, at the latest at the beginning of the following calendar year, and adjusted in accordance with Article 6 (3).
(10) The loss or unauthorised destruction of a classified document shall be recorded in the Protocol of Procedure in which the classified document is registered (text part of Annex 2 to this Order).
§ 16
Collection sheet
(1) In the case of an assumed multiple number of classified documents delivered or incurred on a single case, it may be set up with the relevant number of the hearing collection sheet; the model of the collection sheet is set out in Annex 8 to this decree. The formation of the collection sheet shall be indicated in the negotiating protocol.
(2) Secret documents shall be entered in the collection sheet in the order in which they are received or originated. Classified documents of different levels of secrecy may be entered in the collection sheet. If the same thing applies, non-classified documents may be entered in the collection sheet.
(3) Each document entered in the collection sheet shall bear the reference number of the secret document to which the collection sheet is kept. Individual documents recorded in the register shall be distinguished in the number of the secret documents to be dealt with by the serial number of the collection sheet referred to in Article 19 (1) (b).
(4) A shredder mark and the year in which the shredding procedure will be carried out shall be marked on the file comprising the documents entered in the collection sheet before the deposit. The collection sheet becomes part of the file.
§ 17
Correction of registration in administrative aids
(1) The correction of the entry in administrative aids shall be as follows:
(a) the original entry shall be crossed out so that it remains legible;
(b) a new entry shall be made, indicating the date, surname and signature of the person who corrected the entry.
(2) Similarly, corrections to the minutes shall be made in the Protocol or the Auxiliary Protocol, which shall be carried out by computer means, by entering the surnames of the persons who have made the corrections. After printing these devices, the said person shall attach signatures.
§ 18
Forms of classified documents in paper form
(1) The classified document in paper form shall bear, in particular, the designation of the authority of the State or organisation where the classified document was created, the reference number of the classified document, the level of cover, the number of copies, the number of sheets, the number of classified and non-classified annexes in paper form and the number of their sheets and, where applicable, the number and type of other annexes in non-paper form.
(2) The number of copies, the number of sheets, the number of classified and non-classified annexes and the number of their sheets shall be indicated on the front of the first sheet, on the upper right. The number of annexes in paper form and the number of their sheets shall be expressed by a fraction, the numerator of which shall be the number of annexes and the denominator of the total number of sheets of annexes. For annexes in non-paper form (supporting media, etc.), the number and type of the attachments and, where applicable, their registration number. The documents or pages of classified documents in paper form shall be numbered on a continuous basis. The sheets or pages of the classified annexes in paper form shall be numbered separately. The sheets of the classified document and the sheets of the individual classified annexes in paper form shall be written down or otherwise firmly joined. The model of the front page of the first classified document is set out in Annex 9 to this Order.
(3) The Annex shall be marked with the number of the classified document acting by indicating on the front of the first sheet on the upper right side: "Annex No... k...." The classification level of each classified annex shall be the same as that of the classified document. The classified annex shall have its own number and number of sheets. The handling of classified documents containing annexes to different levels of secrecy shall be subject to the highest level of secrecy. The disconnected attachment shall be handled according to its classification level.
§ 19
Reference number of the classified document
(1) The reference number of the classified document shall consist, unless otherwise specified, of:
(a) an abbreviation of the classification level;
(b) the serial number of the relevant Protocol and, in the case of the use of the Register, the coupling number and the serial number of the Register shall be indicated after the serial number of the Protocol;
(c) slash,
(d) the year in which the serial number was assigned.
(2) The number of the classified documents may be followed by additional particulars or characters established by the authorities of the State or by organisations. Such data or characters shall be separated from the reference number of the classified document by a link.
§ 20
Copy of the classified document
(1) A copy of the classified document shall be drawn up in the number of copies shown on the distribution list. Those who produce a paper shall immediately destroy defective copies, copies which are not included in the division and drafts of non-approved copies.
(2) The copy of the classified document, which is intended for storage, shall be made out by means of a division and an entry in accordance with the model set out in Annex 9 to this Order. The divider may be attached to the classified document and the classified document shall be marked "The divider attached."
§ 21
Recording of notes and sub-information containing classified information
(1) Notes or sub-information containing classified information shall be recorded only in a notebook or book which has been modified in accordance with Paragraph 6 (3) before being taken into use or on a medium operated in a certified information system and marked with an appropriate classification level. The record of notebooks or books issued and removable carry media shall be kept by the authorised person or person in charge of the Protocol.
(2) Notebooks or books and removable supporting media for the recording of notes, containing classified information, shall be stored in a similar manner to classified documents of the same grade and shall always be transmitted in a portable mailbox.
§ 22
Forms of classified documents in non-paper form
(1) The classified documents in non-paper form shall be provided with a descriptive label indicating the designation of the authority of the State or organisation where the classified document was created, the reference number of the classified document, or an annex to the number of the classified document, or the registration mark under which the classified document is registered in non-paper form, and the level of the classification. Such data may, where possible, be placed directly on a classified document in non-paper form.
(2) Carrier media and other materials containing classified information shall be provided with a movement note containing the particulars referred to in Article 18 when sending them.
§ 23
Copy, copy, translation and extract
(1) A copy, copy, translation or extract of a classified document of the "Top Secret" classification level may only be drawn up on the basis of the written consent of the statutory authority or the authorised person of the authority of the State or organisation in which the classified document was created. The written consent shall include the reference number of the classified document, the number of copies, the reason for the copy, the name, the surname and the signature of the person who gave the consent and the date on which the consent was granted. The written consent shall be deposited with the original of the classified document pending its removal.
(2) A copy, copy, translation or extract of a classified document of the classification level "Secret" or "Confidential" may be made out only with the written consent of a direct superior registered on such classified document.
(3) A classified document of the classification grade "Top Secret '," Secret' or "Confidential ', from which a copy, copy, translation or extract is made, shall bear the date of the copy, the number of copies, the reason for the copy, the name and surname of the person who gave the consent and the name, surname and signature of the person who made it.
(4) A copy or a copy of a classified document shall be marked on the upper part of the front of the first sheet with the word "OPIS 'or" COPY' and shall bear the serial number of the copy or a copy of the classified document drawn up. If the number of copy sheets does not agree with the number of original sheets, the actual number of copy sheets shall also be indicated on the copy.
(5) An extract of a classified document shall be made only in the notebook or book referred to in Article 21 (1) or on the medium operating in a certified information system or in the form of a classified document in paper form.
§ 24
Transmission of a classified document
(1) The secret document shall be transmitted against the signature.
(2) The transmission of classified documents shall take place within the State authority and the organisation:
(a) between the organisational services through the negotiating protocols;
(b) within the organisational unit, by means of an auxiliary protocol, if not by means of a protocol.
(3) Signatures confirming take-over shall be indicated in the Protocol, the Auxiliary Protocol, the delivery book, the handling book, the collection sheet or the documents in the division.
§ 25
Sending a classified document
(1) The secret document is sent in two envelopes as follows:
(a) the consignor, the full number of the confidential document, the level of security in the upper right and the addressees shall appear on the upper left. The envelope shall be secured in such a way that all the connections of the envelope over the whole length are glued with adhesive tape and stamped by the authority of the State or organisation and the signatures of the authorised person, or by the person in charge of the protocol, or by the person who made the security of the envelope. The stamps and signatures shall be in excess of the adhesive tape. When a transparent adhesive tape is used, the stamps and signatures shall be glued to the tape. An envelope with a classified document sent by the courier service shall be marked "KURÍREM '. If the consignment is to be opened only by the consignee, the envelope shall be marked with the words" OPENING',
(b) in the case of the dispatch of a classified document, the consignor, the reference number of the classified document shall appear on the outer envelope without giving an abbreviation of the classification level and the addressee. The envelope shall be of such quality that the data on the inner envelope are not legible. Confirmed date9) shall be attached to the copy of the classified document if it is intended for storage at the consignor,
(c) in the case of the sending of a classified document by courier service, the outer envelope shall always be the portable box referred to in Section 7.
(2) A receipt for the receipt of the classified document (Annex 10 to this Order) shall be entered in the internal envelope of classified documents carried by the courier service and endorsed by the addressee by signature and stamp, dated and returned to the consignor without delay. The return receipt shall be attached to the copy of the classified document if it is to be deposited with the consignor.
(3) In the event that a classified document cannot be inserted into an envelope, it shall be placed in solid packages which are secured and labelled in a similar manner to the internal and external envelope.
§ 26
Transport of consignments
(1) The transport of the consignment is carried out
(a) by post;
(b) courier service.
(2) Shipments of the "Confidential" classification level may be carried by post, in the form of a recommended letter or a recommended package, with a separate letter.
(3) The courier to carry the consignment shall be proved by the consignor by a certificate valid for the classification level concerned.
(4) Shipments of the "Top Secret" or "Secret" classification level always carry 1 courier accompanied by at least 1 person. Such consignments shall be excluded from transport by public means of transport, with the exception of air, sea and inland waterway transport.
(5) The consignment can only be transported by courier service in a portable box in accordance with Section 7, which is locked or secured against tampering with its contents. The consignment, which cannot be transported in a portable box due to its size, shall be covered in an appropriate manner when it is transported in such a way as to prevent the unauthorised person from being identified with such classified document.
§ 27
Transmission of a classified document
A classified document may be transmitted in a sealed envelope or sealed packaging bearing the designation of the State authority or organisation and the classification grade, subject to the following conditions:
(a) a classified document of the "Top Secret" classification level may be transmitted only with the written consent of the statutory authority or delegate; the person carrying the classified document shall have the written consent, shall not become part of the classified document but shall be deposited with it,
(b) a classified document of the classification level "Secret" may be transmitted only with the written consent of the superior; the person carrying the classified document shall have the written consent, shall not become part of the classified document but shall be deposited with it,
(c) a classified document of the "Confidential" classification level may be transmitted only with the consent of the superior.
