THE LAW
of 25 April 1996
amending and supplementing Act No 117 / 1995 Coll., on State Social Support
Parliament has decided on this law of the Czech Republic:
Act No. 117 / 1995 Coll., on State Social Support, is amended as follows:
1. In Article 5 (2) (c), the following shall be inserted after the words "pension insurance ':" except for an increase in the pension for helplessness'.
2. In Article 11 (3), the words "which have entered into a marriage if his spouse is not also a dependent child, or 'shall be deleted.
3. In § 12 (a), the following words are replaced by a semicolon at the end of comma: "secondary and higher education in the Czech Republic is also considered to be secondary and higher education in the Czech Republic if, according to the decision of the Ministry of Education, Youth and Sports, it is based on the same degree as secondary and higher education in the Czech Republic."
4. In Article 23 (2), the following sentence is inserted after the first sentence: "Paragraph 51 (6) shall apply mutatis mutandis for the calculation of the comparative amount."
5. Article 27 (2) reads as follows:
"(2) The commuting of a child from the place where he is registered for permanent residence to the place of residence of the school shall also be regarded as commuting from one part of the municipality to the other part of the municipality, unless urban regular passenger transport is operated between those parts of the municipality. ';
the following paragraphs 3 and 4 are added:
"(3) Where a child performs compulsory schooling through a secondary school, he shall be considered as a compulsory schooling child for the purposes of the transport allowance.
(4) The transport allowance does not apply in July and August. "
6. in Articles 28 (1) (a) and 28 (2) (a), the following shall be inserted after the words "for a child": "under 15 years of age."
7. in Articles 28 (1) (b) and 28 (2) (b), the following words shall be inserted after the words "for a child who": "has completed compulsory education and has reached 15 years of age or which have reached";
8. In Paragraph 28 (3), "60 km 'is replaced by" 100 km';
9. In Article 28 (1) to (3), the following shall be inserted after the words "the place of residence of the school ':" or parts thereof'.
10. In Paragraph 28, the following paragraph 3 is inserted after paragraph 2:
"(3) When commuting to a school abroad, it is considered as a school seat instead of a road or railway border crossing where the child leaves the territory of the Czech Republic. When commuting to a school abroad it is not possible to determine the school's registered office in the manner specified in the preceding sentence, the child's transport allowance corresponding to 200 km shall be granted. ';
Paragraphs 3 to 5 shall be renumbered paragraphs 4 to 6.
11. Article 51 shall be added to the following paragraph 6:
"(6) If the levy referred to in § 2 (a) (2) to (4) does not reach CZK 50 per calendar month, it shall be increased to that amount."
12. Article 74 shall be added to the following paragraph 5:
"(5) The permanent residence condition may be waived by the Ministry of Labour and Social Affairs in justified cases."
Under this Act, with the exception of the provisions of Article I (4) to (8), (11) and (12), the assessment of entitlement to state social aid benefits shall not take place until 1 January 1996.
This Act shall take effect on 1 July 1996.
