on competitive catering
The Government of the Czechoslovak Socialist Republic orders, in agreement with the Central Council of Trade Unions pursuant to § 140 (2) of the Labour Code, as amended by Act No. 188 / 1988 Coll. (full version No. 52 / 1989 Coll.):
(1) Socialistic organisation1) (hereinafter referred to as "the organisation") provides racing meals and assesses its level as part of the planned management of its economic and social activity.
(2) The competent authorities of the Revolutionary Trade Union Movement are co-operating in all measures to ensure and develop food and to exercise their social control.
(1) The organisation shall provide food for racing by providing hot meals and, where appropriate, diet meals (hereinafter referred to as "main meals") during the course of the working shift, by providing additional meals and food and drinks for refreshments; In doing so, work shall be regarded as a shift of more than three hours. If health, safety or serious operational reasons do not permit this, the organisation may, with the agreement of the relevant trade union authority, exceptionally provide that the main meals are provided at another appropriate time.
(2) Racing catering means a kitchen with a dining room, a dining room, a central dining room, a food dispensary, a dining area, canteen and an auxiliary farm.
(3) The organisation may, with the agreement of the relevant trade union body, provide additional catering services for its own use or for an order of social organisations operating in the organisation in the establishment.
(4) The organisation may also provide protective drinks and protective food by means of a catering facility, in accordance with the labour legislation (2).
(5) Racing meals cannot be replaced by other transactions.
(1) Racing catering is provided by the organisation
(a) their workers;
(b) pupils of secondary vocational schools (special vocational schools), unless their meals are provided for under special regulations;
(c) pupils, students and scientific aspirants for the duration of their activities in the organisation, unless their diet is provided for under specific regulations.
(2) The organisation may, in accordance with the collective agreement, provide food for racing in food establishments in which it provides food for racing to its workers, as well as for pensioners who have worked for retirement in it, to its workers at the time of their excused absence of work and to workers working for the organisation on the basis of non-employment contracts.
(3) The organisation may, with the agreement of the relevant trade union, also provide racing meals
(a) the citizens for whom it has undertaken to eat with another organisation by means of a contract relating to catering;
(b) workers of other organisations and officials of social organisations working there or otherwise;
(c) family members of their workers and pensioners who worked there until retirement;
(d) pensioners who did not work there until retirement.
Catering contracts
(1) The organisation enters into a contract for catering with another organisation or with a citizen authorised to provide catering services (3). If the organisation in the contract does not agree on the form of participation in the provision of catering, the organisation that operates the catering establishment may charge a premium for the price of meals for the guests of another organisation up to 20% of the financial limit (Section 6 (6)); the amount of the premium must be stated in the contract for catering.
(2) An organisation operating a catering establishment may conclude, amend or terminate a contract only with the agreement of the relevant trade union.
Cost of and payment of racing meals
The costs and revenues (expenditure and income) of the catering plant are kept separately from other costs and revenues (expenditure and income).
(1) The cost of racing meals is:
(a) material costs, with the exception of those referred to in (c), services of non-material nature and financial costs of catering, hereinafter referred to as "costs in kind,"
(b) the wage and other personnel costs of the staff of the establishment (hereinafter referred to as "personnel costs");
(c) the cost of raw materials (food) consumed for the preparation of meals for racing meals, including losses resulting from natural loss of raw materials (the purchase price of raw materials);
(d) the cost of goods for sale in canteen;
(e) the cost of raw materials for auxiliary catering farms.
(2) If the organisation has several catering facilities, the personnel costs include the costs of their possible joint management.
(3) The costs in kind, the personnel costs and the reimbursement of the increased prices of food raw materials and semi-finished products of 0,60 CZK per main meal are covered by the organisation in full by the budgetary organisation from its budgets, the contribution organisation from its budget expenditure and other organisations for the cost of its main activity. From the same sources the organisation also covers the premium referred to in § 4 (1).
(4) The purchase price of raw materials, the cost of goods to be sold in canteen and the direct material cost of raw materials to the auxiliary economy is covered by the organisation by sales and other revenue from the catering industry.
(5) Where the organisation provides for catering at a public catering establishment, the calculation premium shall cover the calculation price of the raw materials consumed per main meal from the means referred to in paragraph 3.
(6) The organisation shall determine, in agreement with the relevant trade union, the use of recipes, the consumption standards of raw materials per main meal and the average annual financial limit on the purchase price of raw materials per main meal (hereinafter referred to as "the financial limit '), which correspond to the nature of the work and the working regime, where appropriate, providing that food is prepared at the cost of the raw materials consumed; where meals are prepared in several financial limits, the drawing of individual limits shall be monitored separately.
(7) In the supply of semi-finished products, prepared meals and processed raw materials, only the purchase price of the raw materials consumed for their production is included in the consumption of food-preparation raw materials as specified in the specific price list. The other costs associated with the production of the supplier (including its profit) shall be borne by the customer organisation as the cost of the catering in kind.
Food prices
(1) The price of food in a catering establishment is made up of the purchase price of raw materials, material costs and personnel costs ("full price").
(2) The organisations shall provide the guests referred to in Article 3 (1) with:
(a) the main meals at the purchase price of raw materials, reduced by part thereof, to be borne by the organisation (Article 6 (3)) and by the contribution granted from the Fund for Cultural and Social Needs (hereinafter referred to as "the reduced price");
(b) complementary meals at the cost of the raw materials.
(3) The organisation provides only one main meal per day for a reduced price. Another main meal in the same working shift can be provided by the organisation to a reduced-price worker only if his work lasts more than 11 hours.
(4) The organisation may provide one main meal per day at a reduced price in accordance with the collective agreement also to the diners referred to in § 3 (2).
(5) For individual complementary meals, the organisation may, subject to the agreement of the relevant trade union, set fixed annual prices.
(6) Prepared drinks and meals are sold in the canteen at retail prices of the raw materials and goods sold unchanged at retail prices.
(7) Additional catering services (Section 2 (3)) are provided at a price corresponding to the retail price of the raw materials consumed, material costs and personal costs.
(8) Unless otherwise provided for in this Regulation, diners shall pay the full price for meals taken.
The organisation providing racing meals using public catering facilities will agree on the price of the main food at prices of the IV. or II. price group in the contract. In doing so, the organisation provides the guests referred to in Sections 3 (1) and 3 (2) with a main meal at an agreed price reduced by a calculation premium to the calculation price of the consumables consumed, by 0,60 CZK (Section 6 (3)) and by a contribution from the fund of cultural and social needs.
The staff member of the catering establishment who is directly involved in the preparation or delivery of meals shall pay the organisation one main meal for each shift worked unless he proves that he is unable to eat in the catering establishment for health or other serious reasons. If the organisation provides food at different prices, it shall, in agreement with the relevant trade union body, fix the price to be paid by the food service worker.
The organisation may, with the agreement of the relevant trade union body, provide the diners referred to in Article 3 (1) and (2) with a contribution from the fund of cultural and social needs for racing catering up to the
(a) half the purchase price of raw materials, if it is food served during the morning or afternoon shift;
(b) the purchase price of raw materials reduced by 0,60 CZK if the meals are served during the night shift.
Profit and loss
(1) The difference between the costs and revenues of the catering industry (including the contribution from the cultural and social needs fund, the premium referred to in Article 4 (1) and the trade rainfall for goods sold in canteen and other catering services) constitutes a profit or loss on the catering industry. The profit (loss) from the catering industry is transferred to the overall economic result (budget) of the organisation.
(2) The organisation will ensure that the profit from the catering industry is not achieved by the boarders.
Common and final provisions
The organisation providing for the catering of racing in accordance with Sections 4 (1) and 8 shall agree on the conditions laid down in this Regulation in the contract for racing.
The provisions of this Regulation, with the exception of Sections 1 (2) and 10, shall apply to catering in single agricultural cooperatives, joint ventures (4) and other cooperatives, where membership also includes employment relationships (5). Where a collective agreement is referred to in this Regulation, it shall, in such cases, be understood as a resolution of the member meeting of the single agricultural cooperative or, where appropriate, of the highest authority of another cooperative.
The Decree of the Government of the Czechoslovak Socialist Republic No. 127 / 1982 Coll., on Racing Catering is hereby repealed.
This Regulation shall enter into force on 1 January 1990.
